RESOLUTION NO. 2006- 034
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
INDIAN RIVER COUNTY, FLORIDA, SETTING AN AMENDED TIME AND
PLACE AT WHICH THE OWNERS OF PROPERTIES, LOCATED IN
LAKEWOOD TERRACE SUBDIVISION (WEST SIDE OF 27TH AVENUE,
NORTH OF ST. LUCIE COUNTY LINE) IN INDIAN RIVER COUNTY,
FLORIDA, AND OTHER INTERESTED PERSONS, MAY APPEAR BEFORE
THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY
AND BE HEARD AS TO THE PROPRIETY AND ADVISABILITY OF
CONSTRUCTING THE WATER MAIN EXTENSION, AS TO THE COST
THEREOF, AS TO THE MANNER OF PAYMENT THEREFOR, AND AS TO
THE AMOUNT THEREOF TO BE SPECIALLY ASSESSED AGAINST EACH
PROPERTY BENEFITED THEREBY.
WHEREAS, the Board of County Commissioners of Indian River County has, by
Resolution No. 2006-009, determined that it is necessary for the public welfare of the citizens of
the County, and particularly as to those living, working, and owning property within the area
described hereafter, that a waterline be installed to serve 11.7 lots in Lakewood Terrace
Subdivision (west side of 27th Avenue, north of St. Lucie County line) in Indian River County,
Florida ("Improvements"); and
WHEREAS, it has been determined that the cost to be specially assessed with respect
thereto shall be $0.368930 per square foot; and
WHEREAS, the Board of County Commissioners has caused an assessment roll to be
completed and filed with the Clerk to the Board;
WHEREAS, Section 206.06 of the Code of Indian River provides that the Board of
County Commissioners shall fix a time and place at which the owners of the specially benefited
properties to be specially assessed or any other persons interested therein may appear before
the Board of County Commissioners and be heard as to the propriety and advisability of
constructing such water main extension, as to the cost thereof, as to the manner of payment
therefor, and as to the amount thereof to be assessed against each property benefited thereby;
and
WHEREAS, Resolution No. 2006-010, duly adopted by the Board of County
Commissioners on January 24, 2006, set a public hearing date of February 14, 2006; however,
the advertisement for the February 14, 2006, public hearing needed to be republished with a
new public hearing date of April 4, 2006,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows:
RESOLUTION NO. 2006- 034
1. The County Commission shall meet at the County Commission Chambers in the County
Administration Building at the hour of 9:05 a.m., or as soon thereafter as the matter may be
heard, on the readvertised date of Tuesday, April 4, 2006, at which time the owners of the
specially benefited properties to be specially assessed and any other interested persons
may appear before said Commission and be heard in regard thereto. The area to be
improved and the properties to be specially benefited are more particularly described upon
the assessment plat and the assessment roll with regard to the special assessments.
2. All persons interested in the construction of said Improvements and the special
assessments against the properties to be specially benefited may review the assessment
plat showing the area to be assessed, the assessment roll, the plans and specifications for
said Improvements, and an estimate of the cost thereof at the office of the Department of
Utility Services any week day from 8:30 a.m. until 5:00 p.m.
3. Notice of the time and place of this public hearing shall be given by two publications in the
Press Journal Newspaper one week apart. The last publication shall be at least one week
prior to the date of the hearing.
4. The Department of Utility Services shall give the owner of each property to be specially
assessed at least ten days notice in writing of such time and place, which shall be served by
mailing a copy of such notice to each of such property owners at his last known address.
The resolution was moved for adoption by Commissioner Davi s , and the
motion was seconded by Commissioner Wheel er , and, upon being put to a
vote, the vote was as follows:

Cost Estimate for Assessment
Attached is the estimated cost to install the water main and appurtenances for the Lakewood Terrace
Subdivision including Engineering, Permitting and Surveying. My estimated cost is $354,735.00.
Also a part of the Lakewood Terrace water assessment is the subdivision's fair share cost of installing the 12"
water main down 27th Avenue from 17th Street SW, which is outlined on Exhibit C in the Falcon Trace
Developer's Agreement approved by the BCC on November 9, 2004. Lakewood Terrace is responsible for
about 46% of the Area "A" share of $37,234,00. This amounts to $17,185.00 and when- added to $354,735.00
equals $371,920.00
Therefore, I recommend $372,000.00 be used for the Assessment Roll.
