A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY,
FLORIDA, PROPOSING TO ACQUIRE STATE-OWNED
LANDS FROM THE BOARD OF TRUSTEES OF THE
INTERNAL IMPROVEMENT TRUST FUND
WHEREAS, the Indian River Correctional Institution formally operated on real property
located in Indian River County, Florida ("Subject Property"); and
WHEREAS, on July 25, 2012, the Board of County Commissioners of Indian River
County ("Board of County Commissioners") received written notice from the Florida
Department of Environmental Protection, Bureau of Public Land Administration, Division of
State Lands ("State of Florida") notifying the Board of County Commissioners of the availability
of the Subject Property, pursuant to §253.034(6)(f) and §253.111, Florida Statutes. A copy of
the notice, describing the Subject Property in greater detail, is attached hereto as Exhibit A; and
WHEREAS, as set forth in the written notice, and pursuant to §253.111, Florida Statutes,
the Board of County Commissioners has adopted this Resolution proposing to purchase the
Subject Property, subject to the results of a real estate appraisal and such other terms and
conditions as the State of Florida determines and the Board of County Commissioners agrees,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA:
Section 1. This Resolution shall serve as a formal notice from the Board of County
Commissioners to the State of Florida that it proposes to purchase the Subject Property from the
Board of Trustees of the Internal Improvement Trust Fund, subject to the results of a real estate
appraisal and such other terms and conditions as the State of Florida determines and the Board of
County Commissioners agrees.
Section 2. This Resolution shall also serve as a written commitment that the Board of
County Commissioners will pay the cost of an appraisal of the Subject Property, conducted in
accordance with the standards and requirements of §253.111(3), Florida Statutes.
Section 3. A certified copy of this Resolution shall be provided fort
hwith to the State of
Florida.
Section 4. This Resolution shall take effect immediately upon its adoption.

The foregoing resolution was moved for adoption by Commissioner O'Bryan, and
seconded by Commissioner Davis, and, upon being put to a vote, the vote was as follows:

RE: NOTICE OF INTENT TO SELL SURPLUS STATE LAND

CUNIMISSION
Pursuant to Sections 253.034(6)(f) and 253.111, Florida Statutes, Indian River County is hereby notified that the state
land described in the attached legal description is available for purchase. In accordance with Sections 253.034(6)(0
and 253.111, Florida Statutes, the county has forty days from receipt of this notice to determine, by formal
resolution, whether or not it proposes to purchase this state land. Conditions of a sale include, but may not be
limited to, the following:
L Surplus state land shall be sold for a price that is equal to the parcel's appraised market value.
2. Pursuant to Rule 18-2.018, Florida Administrative Code, the parcel of surplus state land and
improvements located thereon shall be sold "as is," with no warranties or representations whatsoever.
3. All closings of surplus state land shall be in accordance with a sales contract approved and executed
by the Board of Trustees of the Internal Improvement Trust Fund and the property shall be conveyed
by quitclaim deed, which shall contain the petroleum and mineral reservation in favor of the Board of
Trustees of the Internal Improvement Trust Fund set forth in Section 270.11, Florida Statutes.
4. The county shall pay all costs of sale including, but not limited to, the cost of legal advertisement,
appraisal, survey, title insurance, documentary stamp tax, recording fees and buyer's legal fees. All
sales of surplus state land shall be for cash or cashiers or certified check.
Failure to respond within forty-five days of receipt of this notice will indicate that th
e county has no interest in
purchasing this property. Please call me at (850) 245-2796 if you have any questions.
Notwithstanding the foregoing, before a parcel of state-owned land is offered for sale to the county
, state
universities and state agencies are given the opportunity to lease the parcel. Please be advised that if a state
university, community college or state agenev elects to lease the suhiect narrel of land. the Board of Trusts will ho
recluded from selling this parcel to th
e county.
