COMMISSIONER LOY NOTED THAT THE BOARD APPROVED — 775 FOR THE YMCA BUDGET WITH THE HOPE THAT THE SCHOOL BOARD WOULD HELP WITH THE I 'TRANSPORTATION AND POSSIBLY A GRANT COULD BE OBTAINED TO REDUCE THIS AMOUNT TO AROUND $5,500. INDIAN RIVER COUNTY EXHIBIT - H BOARD OF.COUNTY COMMISSIONERS SUMMARY OF SIGNIFICANT ACCOUNTING POLICIES "i SEPTEMBER 30, 1977 The significant accounting policies followed by the Board of County Commissioners, Indian River County, Florida, are described below to enhance usefulness of the financial statements to the reader.Other significant accounting policies are shown In the accompanying "Notes to Financial Statements." REPORTING ENTITY Indian River County is a political subdivision of the State of Florida. It is governed by an elected Board of County Commissioners which is governed by State statutes and regulations. Pursuant to Section 125.17, Florida Statutes, the Clerk of the Circuit Court for the county is clerk and accountant for the Board of County Commissioners. The Clerk maintains the Board's accounts in accordance with uniform classification of.accounts as prescribed by the Department of Banking and Finance, State of Florida. FUND ACCOUNTING In order to ensure observance of limitations and restrictions placed on the use of the resources available to the Board, the financial records and accounts of the r Board are kept'in accordance with the principals of "fund accounting." This is the procedure by which resources for various purposes are classified for accounting and reporting purposes into funds that are in accordance with the activities or objectives specified.. Separate accounts were kept for each fund; however, in some of the accompanying financial statements, funds which have similar characteristics have been combinedinto fund groups. Accordingly, all financial transactions have been recorded and reported by fund and fund group. The funds used are classified as follows: GBneral Fdnd. This fund is used to account for resources available to meet the general financial requirements of the Board of County Commissioners. Special Revenue Funds. These funds are used to account for the proceeds of specific revenue sources kother than special assessments) or to finance specified activities as required by law. Enterprise Fund. The Board of County Commissioners has organized a Sanitary Landfill Enterprise to be operated in a manner similar to a private enterprise. The accounts•and records are therefore kept in accordance with generally accepted accounting principles applicable to the private sector of economic activity. Trust And Agency. These funds are used to account for assets held by a governmental unit as trustee or agent for individuals, private organizations, and other governmental units. General Fixed Assets. This self -balancing group of accounts is used to provide a record of fixed assets owned by the Board of County Commissioners which are available for the general operation of county government. Interest income derived from time deposits and investments were accounted for In the fund which owned such assets. HE RECOMMENDED THAT.ANY MONIES GENERATED IN EXCESS OF,COSTS BE PUT INTO THE CAPITAL IMPROVEMENT FUND FOR FUTURE CONSTRUC- TION OF THE FACILITY.- ARNOLD SCHNEIDER OF WILLIAM R. HOUGH & CO., COUNTY BOND CON- SULTANTS, STATED THAT THEY WERE ASKED BY THE COUNTY TO DEVELOP A FINANCING PLAN FOR THE 1,815,000 BOND ISSUE ($1,212,000 CONSTRUCTION COSTS AND THE REST FOR DEBT SERVICE, OPERATION, ETC.) HE STATED THAT THE BOND ISSUE RUNS TO 1994 AND THE INTEREST IS ABOUT 5.4%. THE PRINCIPAL IS GUARANTEED BY REVENUES AND GUARANTEED ENTITLEMENT.FUNDS. HE INFORMED THE.BOARD THAT STANDARD & POOR GAVE THE BONDS AN "A" RATING: MR. CHARLES PRICE OF INDIAN RIVER COUNTY BUILDING TRADES ASSOCIATION SPOKE REPRESENTING GENERAL CONTRACTORS AND CONSTRUCTION HAULERS OF THE AREA, HE STATED THAT THEY FEEL THE RATES•AS PROPOSED BASED MAINLY ON THE TONNAGES, ARE PREPOSTEROUS. HE NOTED THAT AT A CHARGE OF $6.00-A TON, IT WOULD HAVE RUN THE COST OF DEMOLITION OF THE FIRESTONE STORE FROM $6,000 TO $14,000. SIR. PRICE NEXT DISCUSSED THE FEES RECOMMENDED FOR VARIOUS TYPE VEHICLES, SMALL CARS, PICK-UP TRUCKS, ETC. AND FELT THIS WAS NOT A FAIR METHOD AS YOU MIGHT HAUL THE SAME AMOUNT IN A PICK-UP AS YOU WOULD IN A SMALL CAR. THIRDLY, HE NOTED THAT EVERYONE IS AWARE THAT A TON OF CEMENT AND A TON OF FEATHERS DON'T ATTAIN THE SAME MASS OR BULK AND ASKED WHY BULK MATERIALS SHOULD BE BASED ON A TONNAGE RATE RATHER THAN A MASS RATE. HE POINTED OUT THAT A TON OF CONCRETE IS A LOT EASIER TO DISPOSE OF THAN A TON OF BRUSH. MR. PRICE THEN PROTESTED THE DOUBLE CHARGE FOR UNCOVERED LOADS. HE NOTED THAT THEY MAKE AN HONEST EFFORT TO TARP THE LOADS, BUT HE DOES NOT FEEL THAT LEAVING THE DECISION IN REGARD TO IMPOSING THE DOUBLE CHARGE TO THE DISCRETION OF ONE MAN AT THE DUMP WOULD BE FAIR. MR. PRICE CONTINUED THAT IF THESE RATES ARE IMPOSED, THE COUNTY WILL FINDITS DITCHES LOADED WITH LITTER AND NOTED THAT RESIDENTS ARE ALREADY PUTTING THEIR GARBAGE IN COMMERCIAL DUMPSTERS. HE REQUESTED THAT THE BOARD HOLD UP ACTING ON THESE FEES UNTIL THE SCALES ARE INSTALLED AND MORE ACCURATE INFORMATION IS OBTAINED. EUGENE CRAGG, FORMER MAYOR OF SEBASTIAN, SPOKE AS A PRIVATE CITIZEN, AND STATED THAT HE THOUGHT IT WOULD BE BETTER IF A BOND ISSUE OF THIS TYPE WERE TAXED TO EVERYBODY IN THE COUNTY. HE. THEREFORE, FELT THIS COST SHOULD BE DIVIDED AMONGST EVERYONE 'IN THE'COUNTY AND SUGGESTED THAT MORE CONSIDERATION BE GIVEN TO .SOME KIND OF AN EQUALIZATION TAX TO PAY FOR THE LANDFILL. EVERETT GASS OF SEBASTIAN WENT ON RECORD ASOPPOSINGTHE IDEA* OF THE FRANCHISE OPERATOR BILLING THEIR CUSTOMERS TO HELP PAY FOR THIS BOND ISSUE. HE FELT THIS IS DISCRIMINATORY -AGAINST THOSE USING THE SERVICE OND HE FELT THAT EVERY HOME OWNER SHOULD PAY A FAIR SHARE IN- STEAD OF PENALIZING ONE GROUP. HE CONTINUED THAT HE WOULD LIKE TO SEE THE COUNTY TAKE OVER FRANCHISE LICENSES AND SET A FLAT FEE ALL OVER THE COUNTY. MR. GASS NOTED THAT THIS IS A FEDERALLYMANDATED PROGRAM, AND HE FEELS WHEN THEY MANDATE IT, THEY. SHOULD FIND A WAY TO PAY FOR IT HE SUGGESTED THAT SOME SENATORS BE CONTACTED. COMMISSIONER LOY REPLIED THAT A TRIP WAS MADE TO.WASHINGTON AND A SPECIFIC REQUEST WAS MADE OF TWO UNITED STATES SENATORS AND ONE CONGRESSMAN. ALL THREE RESPONDED AFTER CONSIDERABLE RESEARCH THAT THERE ARE NO FEDERAL FUNDS AVAILABLE FOR LANDFILL MANDATED PROJECTS. ATTORNEY COLLINS EXPLAINED TO THOSE PRESENT THE LEGAL ALTERNA- TIVES AVAILABLE TO THE COUNTY, NOTING THAT BASICALLY THERE ARE TWO TYPES OF BOND ISSUES - ONE WHERE A COUNTY WILL PLEDGE THE AD VALOREM TAX REVENUE AND THE OTHER CREFERRED TO AS A.REVENUE ISSUE) WHERE THE ENTERPRISE 'ITSELF PAYS BACK THE BONDS. HE NOTED THAT WHEN YOU HAVE THE AD VALOREM TAXES BACKING UP THE PROGRAM, THEN IT PUTS THE BURDEN ON ALL THE TAXPAYERS, AND SINCE WE ARE A RURAL COUNTY, IT WAS FELT THERE WOULD BE A DISPROPORTIONATE BURDEN ON THE RURAL AREAS AS THE LANDFILL MAINLY SERVICES THE URBAN AREAS. ATTORNEY COLLINS CONTINUED THAT MR. PRICE MADE SOME GOOD POINTS. HE NOTED THAT WE ARE REQUIRED TO PRODUCE MONIES TO SERVICE THE DEBT, AND IF WE FIND THE ESTIMATES ARE INACCURATE, WE CAN MAKE ADJUSTMENTS. RIGHT NOW, HOWEVER,.WE ARE LEGALLY REQUIRED TO RELY UPON THE DATA THAT HAS BEEN SUPPLIED TO US BY OUR CONSULTING ENGINEERS. CHAIRMAN WODTKE AGREED THAT ACTUALLY.THESE ARE INTERIM RATES 23 Boaz - 33 fwa 79 f1 STATED THAT HE DOES BELIEVE THE USER SHOULD PAY FOR.THE OPERATION, AND HE WOULD NOT BE IN FAVOR OF PUTTING THIS ON THE AD VALOREM TAX. HE NOTED.THAT OUR FRANCHISE SANITATION SERVICES DO HAVE IDENTICAL RATES, AND EMPHASIZED THAT THE LANDFILL IS NOT GOING TO BE OPERATED IN ANY TO MAKE A PROFIT. HE MENTIONED ALTERNATIVES OF HAVING A MANDATORY PICKUP IN.THE COUNTY OR POSSIBLY CHARGING AT THE COLLECTOR STATIONS, THE CHAIRMAN AGREED THAT THERE MAY BE A PROBLEM WITH PEOPLE DUMPING THEIR GARBAGE ILLEGALLY, AND NOTED THAT WE HAVE ADOPTED AN ORDINANCE AUTHORIZING A LITTER CONTROL OFFICER. HE STATED THAT IN RE- GARD TO CHARGING DIFFERENT FEES FOR. -DIFFERENT TYPE VEHICLES, WE DO NOT WANT TO PUT ALL THESE SMALL VEHICLES ON THE SCALES, AND, IN ANY EVENT, THERE IS A $2.00 MINIMUM CHARGE. THE CHAIRMAN CONTINUED THAT THE BOND ISSUE' --HAS BEEN VALIDATED, AND WE MUST ESTABLISH RATES EVEN THOUGH HE IS CONCERNED ABOUT MR. PRICES TESTIMONY IN REGARD TO THE AMOUNT OF MATERIALS HAULED. ENGINEER KEVIN COOLEY STATED THAT THEIR ESTIMATES IN REGARD TO CONSTRUCTION DEBRIS AND RUBBLE ARE NOT JUST AN EDUCATED GUESS. IN ADDITION TO A GREAT DEAL OF RESEARCH OF LOCAL RECORDS, THEY ALSO BASED THEIR FIGURES ON.STUDIES DONE ALL OVER THE COUNTRY. HE FELT MR, PRICES FIGURES REFLECTED SOMETHING THAT DOESN'T GO ON IN THE COUNTY DAY AFTER DAY,YEAR AFTER YEAR, AND POINTED OUT MR. PRICE'S FIGURES ESTIMATE THAT A SINGLE CONTRACTOR WOULD SEND APPROXIMATELY 60 TONS OF WASTE A DAY TO THE LANDFILL. MR. COOLEY INFORMED THE BOARD THAT THE ENTIRE CITY OF VERO BEACH GENERATES AND COLLECTS WASTE AT THE RATE OF ABOUT 43 TONS A DAY, AND THEREFORE,. MR.. PRICE'S FIGURES SUGGEST THAT A SINGLE CONTRACTOR WOULD TRUCK 1-1/2 TIMES AS MUCH AS THE CITY OF VERO BEACH DOES IN A DAY. MR. COOLEY DID AGREE THAT IF THEY HAVE A MAJOR PROJECT, THEY MAY TRUCK MORE IN A"jCONCENTRATED PERIOD OF TIME. 24 DEC 211977 - 33 p CONSTRUCTION MATERIALS RECEIVED AT THE LANDFILL BE CHARGED AT THE RATE OF $6.00 A TON AND ANYTHING OVER THAT WOULD. CHAIRMAN WODTKE ASKED WHAT AFFECT IT WOULD HAVE ON THE BONDS IF THE RATE STRUCTURE WAS SET UP WITH A REQUIREMENT THAT IT MUST BE RE- VIEWED IN A SIX-MONTH PERIOD OF TIME, OR ;IF WE ADOPTED A RATE LESS THAN THE ONE PROPOSED. MR. SCHNEIDER DID NOT FEEL REVIEW OF THE RATE`STRUCTURE WOULD HAVE AN ADVERSE AFFECT, BUT AS TO LOWER RATES, POINTED OUT THE COUNTY IS LEGALLY REQUIRED TO PROCEED WITH THE ENGINEERS'RECOMMENDATION. COMMISSIONER SIEBERT DISCUSSED VARIOUS ALTERNATIVES AND ASKED IF AT A FUTURE DATE WE COULD HAVE A REFERENDUM ASKING PEOPLE TO TAX THEMSELVES TO REDUCE LANDFILL RATES. MR. SCHNEIDER STATED THAT THE BOARD HAS FLEXIBILITY IN REGARD TO THE WAY THEY RAISE THE MONEY. COMMISSIONER SIEBERT REMINDED THOSE PRESENT THAT THE BOARD WAS UNDER THE SEVEREST PRESSURE TO GET THIS LANDFILL IN OPERATION, AND IT WILL NEED A LOT OF REFINEMENT BEFORE IT GETS TO A POINT -WHERE IT IS AS EQUITABLE AS WE CAN MAKE IT. MR. PRICE STATED THAT HE FELT THE STUDY HAS BEEN MADE MORE ON -HOUSEHOLD RUBBISH THAN ON CONSTRUCTION DEBRIS. HE POINTED OUT THAT WHAT. YOU ARE TALKING ABOUT IS BURYING VOLUME IN A HOLE, AND TONNAGE AND VOLUME ARE TWO ENTIRELY DIFFERENT IDEAS. MR. PRICE CONTINUED THAT THE MINIMUM CHARGE FEE FOR TAKING A SMALL PACKAGE TO THE LANDFILL SHOULD NOT BE BASED ON VEHICLE TYPE, AND IN REGARD TO TIRES, HE FELT IT WOULDNIT TAKE A WHOLE LOT OF TIRES AT $20.00 PER TON FOR THE COUNTY TO PURCHASE A GRINDING MACHINE AND SELL THIS MATERIAL. HE AGAIN ASKED THAT THE BOARD TABLE THISIMATTER TEMPORARILY, AND THE CHAIRMAN EXPLAINED THAT IT IS IMPOSSIBLE TO TABLE THIS MATTER. "COUNTY" shall refer to the unincorporated areas of Indian River County, Florida. "GARBAGE" Means materials resulting from the preparation, cooking and serving of food,` market wastes, trimmings and other discarded matter from meat or produce,including con- tainers in which packaged and any other matter, of any nature whatsoever, which is subject to decay,`putrefaction and the generation of noxious or offensive gases or odors, or which, during or after decay, may serve as breeding or feeding material for flies or other germ carrying insects, or any container of the materials defined herein. "IMPROVED PROPERTY" refers to all residential, commercial or industrial property that generates, or is capable of generating solid waste. "INDUSTRIAL WASTES" shall mean the waste products of canneries, slaughterhouses or packing plants, condemned food products, agricultural waste products, waste and debris from brick, concrete block, roofing shingle or tile plates, debris and wastes accumulated from land clearing, excavating, building, rebuilding, and altering of buildings, structures, roads, streets, sidewalks or parkways and other solid waste products generated from industrial processing or manufacturing. "LITTERING" is hereby defined as including all garbage, rubbish, garden trash and all waste materials, includ- ing, but not limited to, bottles, glass, cans, scrap metal, junk, paper, disposible packages or containers and all other similar materials, and any substance of any kind or nature whatsoever that creates a public health, safety or fire hazard or a public nuisance. "SOLID WASTE FACILITY" shall mean and include land, equipment and buildings constructed and maintained by the Board to transfer and or dispose of- solid waste within the County. "TRANSFER STATION" means a site and'equipment designated by the County for the purpose of transferring refuse from collection vehicles to long haul transport vehicles. "TRASH" shall mean and include all horticultural trimmings and all accumulations of grass,'weed, palm fronds, leaves, flowers, shrubs, vines, tree limbs, and other similar accumulations incidental to yard keeping. SECTION 13-10 No person shall dispose of any garbage, trash rubbish, office of industrial waste, except through franchise DEC 21.1977.. . No person shall cast; place, sweep or deposit anywhere within the.County, any refuse in such a manner that may be carried or deposited by the elements upon street, sidewalk, alley, sewer,, parkway, or other public place or into any occupied premises within the County. SECTION 13-11 LITTERING A. No person shall throw, place or deposit, or cause to be thrown, placed or deposited., any offal, trash, junk, vehicle, garbage or filth of any kind, into or on any of the public streets, roads, highways, bridges, alleys, lanes, thoroughfares, waters, canals, or vacant lots, or upon the premises of any person within the limits of Indian River County, Florida. B. The properties of all privately owned establishments which serve the public including, but not limited to, drive-in restaurants, retail shopping .centers, grocery stores, convenience stores, gasoline service stations, commercial parking lots, camp grounds, trailer parks and all other such establishments shall be required to place litter receptacles of a'size and nature suitable to the need and bearing in large print thereon the label "TRASH". The nature of such receptacles, their size, composition, number and place of location shall be determined by the appropriate county official based on the size location and circumstances of said establishment. The type and number of such litter receptacles shall be based on the nature and type of business and the customers of such establishments. Failure on the part of proprietors to provide adequate receptacles shall result in action by the Board to compel compliance. Said proprietors shall -6- BuoK .33 98 J caused by the nature and type of business and customers of such establishments. Failure on the part of the proprietor to provide such signs shall result in action by the Board to compel compliance. Said proprietors shall, within thirty (30) days of notification by the Board of the required information, comply with the terms of this section. The Board may produce said signs and offer them for sale at cost and with no profit to the County to establishments requiring them. Any litter discarded or deposited in violation of this article which can be established to have been in the possession or ownership of any person, shall be presumed to have been discarded or deposited by such person; this presumption may be rebutted by competent evidence or testimony establishing that such item of litter had left the ownership or possession of such person prior to being deposited or discarded in violation of this article. 0 SECTION 13-12 It is hereby declared that the construction, •f operation and maintenance of a solid waste facility is a -7- DEC 211977 BOOK 3-" PAGE r - to prosecute misdemeanors, and, upon conviction in a court having jurisdiction of misdemeanors, shall be purnished by a fine not to exceed five hundred dollars ($500,00) or by imprisonment in the. SECTION 13-14 The provisoes of this Ordinance shall not be applicable in any municipality within Indian River County, Florida, except where mutually agreeable. SECTION 13-15 If any section, subsection, paragraph, clause, sentence, phrase or portion of this Ordinance is for any reason held invalid, unlawful or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. SECTION 13-16 All Special Acts or Ordinances or parts of Special Acts or Ordinances in conflict herewith be and the same are hereby repealed with the effective date of this Ordinance. (f) At large shall mean when an animal is off of the premises of the owner and not under the actual control, custody, charge or possession of the owner or other responsible person either by leash, cord, chain, or other means of actual control. Enforcement for violation of ordinance. (a) The animal control director, or impounding officers, or Sheriff's department shall impound: (1) . Any animal suspected or believed to be infected with rabies or any infectious disease. Each animal so apprehended which is suspected to have or exhibits symptoms of having rabies or an infectious or contagious disease shall be segregated from other animals so as to prevent said animal from coming into contact with other animals. (2) Any dog not licensed as provided for in this ordinance and Indian River County Ordinance 72-7, Section 4, now in effect or hereafter revised or amended. (b) The animal control director or his impounding officers, or Sheriff's department shall, in the event an animal is deemed in violation of this chapter, or is owned, harbored, or maintained in violation of this chapter: (1) Issue a "notice of violation" to the owner of such animal; such "notice of violation" shall state the date and time of the issuance of the -notice. the name and address of the person (s) in violation, the date (s) of the offense (s), the offense committed, a description of the animal (s) involved and a demand that the offense (s) be abated within seventy-two (72) hours after the issuance of the notice. Section 3-11. Notice to owners of impoundment. When any animal shall be impounded under the provisions of this chapter, the animal control director or his designated assistants shall give immediate notice in person, or by United States mail,- to the owner of said animal at his, or her, address, if the same is known after reasonable effort and search has been made to ascertain the same, which notice shall inform the owner of the impounding of such animal. Section 3-12. Redemption of. impounded animals. (a) If any animal is impounded for any reason other than for quarantine and is not redeemed within five (5) consecutive days after impoundment of such animal, including the day of impoundment, the animal control director, or designated agent, -without further notice to the owner of such animal, if any, may dispose of the animal as provided in Section 3-7. (b) The owner or owners agent shall be entitled to resume possession of any animal upon compliance, if applicable, of the licensing provisions of this chapter and the payment of impoundment fees set forth by Resolution. Proof of ownership must be given prior to being entitled to resume possession. Proof of ownership may include a license receipt, affidavits of neighbors, photographs or other reliable documentary evidence. This section shall not apply to animals impounded under .. Sections 3-36 (b) and 3-6. (c) The final day of the five-day period shall only occur on a day the pound is open for normal operating activities. Section 3-13. Disposition of impounded animals. Any animal impounded under the provisions of this chapter and not redeemed as provided in Section 3-12 shall become the property of Indian River County, Florida. The animal control director, or designated agent, shall humanely destroy such animal, transfer its title to the humane society or place it in the custody of some person deemed to be a responsible wK 33 €pct'OU It shall be the duty of the owner, or custodian, of any dead animal within Indian River County to remove the carcass of said animal within twenty-four (24) hours of the death. It shall be unlawful for any person or persons to, without authority of a court having jurisdiction to try violations of this ordinance or without authority under this chapter, seek to release or remove any animal from the custody of the animal control department, the Sheriff department or any of their contracted agents or tear down, burn, deface, destroy or otherwise injure any county pound, enclosure, animal control department vehicle or county -owned impounding vehicle or equipment thereof. DISCUSSION.ENSUED IN REGARD TOTHE DITCH BEING FILLED IN AND NO NEW ONE OPENED UP. COMMISSIONER Loy POINTED OUT THAT APPROVAL'WAS GIVEN TO MR. WILMOTH TO RELOCATE THIS DITCH ON DECEMBER12;:1971,AND NOTHING HAS BEEN DONE ABOUT IT UNTIL NOW. SHE ASKED IF IT IS COMMON PRACTICE TO CLOSE UP A DITCH.BEFORE YOU BUILD THE NEW ONE. MR. WILMOTH REPLIED THAT HE COULDN`T.GET HIS EQUIPMENT IN THIS MARSHY AREA. THE ADMINISTRATOR NOTED THE.PROBLEM WAS THAT THIS WAS DONE IN SUCH WET WEATHER. COMMISSIONER LOY ASKED MR. WILMOTH WHAT HE CAN DO IMMEDIATELY TO RELIEVE THE PROBLEM. MR. WILMOTH STATED THAT HE HAS OPENED THE DITCH IN BETWEEN LOTS 13 AND 14, BLOCK C, ON CEDAR STREET. ATTORNEY COLLINS ASKED HOW LONG IT WOULD TAKE TO COMPLETE DIGGING OF THE NEW DITCHES, AND MR. WILMOTH STATED THREE OR FOUR DAYS. COMMISSIONER SIEBERT FELT NO RELOCATION SHOULD BE DONE PRIOR TO AN ACCEPTABLE PLAT BEING FILED AND THAT ANYTHING THAT IS BLOCKING THIS AREA AND PUSHING WATER ON PEOPLE IS PROPERTY SHOULD BE CORRECTED IMMEDIATELY. HE STATED HE FELT THE ORIGINAL DITCH SHOULD BE REOPENED, AND HE WOULD LIKE TO BE SURE BEFORE IT IS RELOCATED THAT IT WILL DO THE JOB', THE.ADMINISTRATOR CONCURRED THAT THE ORIGINAL DITCH SHOULD BE OPENED TO LET THE WATER DRAIN OFF. HE STATED THAT THE OLD DITCH, IS THE BEST DRAINAGE THEY WILL GET UNTIL NEW.EASEMENTS ARE OBTAINED, BUT STATED ONCE AGAIN THAT IF THE NEW DITCH WAS CUT TO THE PROPER GRADES, HE DID NOT FEEL IT WOULD MAKE ANY MATERIAL DIFFERENCE IN THE DRAINAGE OF THE AREA. DISCUSSION CONTINUED, AND COMMI§SIGNER SIEBERT POINTED OUT THAT MR. SIMONS FELT THE PROPERTY OWNERS SHOULD GET LEGAL ADVICE ABOUT WHAT WILL HAPPEN WHEN THE LOCATION OF THE DITCH IS CHANGED. COMMISSIONER SIEBERT NOTED THERE ARE ONLY TWO SOLUTIONS - EITHER MR. WILMOTH OPENS UP THE OLD DITCH OR, PROCEEDS WITH THE NEW ONE AT HIS'RISK. AFTER FURTHER DISCUSSION�CHAIRMAN WODTKE INFORMED MR. WILMOTH THAT HE MUST IMMEDIATELY RELIEVE THE WATER SITUATION, AND IF HE DOES PROCEED TO CUT THE NEW DITCHES, IT IS WITH THE UNDERSTANDING THAT IF THEY DON'T DRAIN PROPERLY, HE WILL HAVE TO GO BACK TO THE OLD DRAINAGE METHOD. MRS. SCHUYLER ASKED ABOUT THE TIME PERIOD, AND THE CHAIRMAN ASSURED HER THAT THE ADMINISTRATOR WILL STAY CURRENT WITH THE SITUATION. ADMINISTRATOR JENNINGS DISCUSSED WITH THE BOARD THE WAYSIDE PARK ON FELLSMERE ROAD WHICH THE DOT HAS RECENTLY RECONVEYED TO THE COUNTY. HE REPORTED THAT THIS PROPERTY HAS BEEN CHECKED OUT AND HE WOULD RECOMMEND THAT WE PLACE THE COLLECTOR STATION FOR THE FELLSMERE AREA AT THIS LOCATION. HE FELT WE SHOULD ADVISE THE NORTH INDIAN RIVER COUNTY IMPROVEMENT ASSOCIATION OF THIS LOCATION, BUT NOTED THAT HE KNOWS OF NO OTHER PROPERTY IN THIS AREA THAT COULD BE USED FOR THIS PURPOSE AND NO ONE HAS COME IN TO GIVE US ANY ALTERNATES. HE CONTINUED THAT A FUNCTIONAL STATION COULD BE BUILT THERE, WHICH COULD BE SCREENED FROM THE ROAD WITH THE RECEPTACLES LOCATED TO THE REAR. ADMINISTRATOR .JENNINGS REPORTED TO THE BOARD THAT THE ROAD AND BRIDGE DEPARTMENTS NEW COMMUNICATION SYSTEM IS WORKING BEAUTIFULLY, BUT HE FEELS THEY WILL NEED FIVE ADDITIONAL UNITS AS THE COUNTY WILL BE GOING INTO SECONDARY ROAD MAINTENANCE AND ALSO FOR USE AT THE LANDFILL. HE CONTINUED THAT RCA WHO WAS AWARDED THE CONTRACT FOR OUR PRESENT SYSTEM HAS AGREED TO SELL US THESE ADDITIONAL UNITS AT THE CONTRACT PRICE, AND HE WOULD LIKE TO ORDER THESE WHILE WE ARE INSTALL- ING THIS SYSTEM. HE NOTED THAT THE LANDFILL SITE WOULD REQUIRE A BASE STATION ASSISTANT ADMINISTRATOR NELSON EXPLAINED THAT THIS WOULD GIVE THE LANDFILL ATTENDANT POSITIVE CONTACT WITH THE LANDFILL SUPER- VISOR AND IS NEEDED FOR A NUMBER OF REASONS. HE FELT IF WE COULD HAVE COMMUNICATION WITH EVERY TRUCK WE HAVE, IT WOULD BE AN ADVANTAGE AND THAT IT IS IMPORTANT TO LOOK TO THE FUTURE AND TAKING OVER SECONDARY ROAD MAINTENANCE. THE ADMINISTRATOR STATED THAT HE HAS FOUND EFFICIENCY IS GREATLY INCREASED BY HAVING THESE UNITS. INTERGOVERNMENTAL COORDINATOR THOMAS POINTED OUT THAT A BREAK- DOWN COULD TIE UP THREE OF FOUR MEN FOR SEVERAL HOURS, AND SOMETIMES YOU NEED TO TRANSFER THEM. DISCUSSION CONTINUED IN REGARD TO THE NEED FOR UNITS IN ALL THE DIFFERENT TRUCKS. ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER DEESON, THE BOARD UNANIMOUSLY APPROVED FIVE ADDITIONAL MOBILE RADIO UNITS AND ONE FIXED UNIT FOR THE LANDFILL; THE UNITS FOR THE MOWER TRUCK, GROUP LEADER, SPRAY TRUCK AND SIGN TRUCK TO BE PAID FOR OUT OF FEDERAL REVENUE SHARING FUNDS, AND THE UNIT FOR THE CONTAINER TRUCK AND THE -LANDFILL STATION TO BE PAID OUT OF LANDFILL FUNDS. INTERGOVERNMENTAL COORDINATOR THOMAS INFORMED THE BOARD THAT HE DOES NOT FEEL THE TRANSFER OF $20,000 FROM FEDERAL REVENUE SHARING TO PAY FOR THIS COMMUNICATIONS SYSTEM HAS EVEN BEEN SPECIFICALLY AUTHORIZED, AND HE FELT THIS SHOULD BE DONE. ATTORNEY COLLINS INFORMED THE BOARD THAT THE FLORIDA CABINET YESTERDAY APPROVED AMENDING THE RESTRICTIONS ON WABASSO ISLAND TO PERMIT THE COUNTY TO ENTER INTO A LEASE WITH THE DEPARTMENT OF INTERIOR TO DEVELOP THE ISLAND FOR RECREATIONAL AND EDUCATIONAL PURPOSES.
