Macht, Chairman; Caroline D. Ginn, Vice Chairman; and Commissioners Fran B. Adams, Thomas S. Lowther and Arthur R. Neuberger. Also present were County Administrator James Chandler; County Attorney Paul G. Bangel; and Deputy Clerk Patricia "PJ" Jones. The Chairman called the meeting to order. FINAL PUBLIC HEARING: ORDINANCE 2003-004 AMENDING LAND DEVELOPMENT REGULATIONS (LDRS) CHAPTER 911. ZONING. AND ESTABLISHING THE SMALL-SCALE HOME FURNISHINGS SHOWROOMS (EXCLUDING FURNITURE AND MAJOR APPLIANCES) USE CATEGORY (CREATING NEW SECTION 971.42(5) TO ALLOW SMALL-SCALE HOME FURNISHING SHOWROOM USES IN THE OCR DISTRICT) (LEGISLATIVE) PROOF OF PUBLICATION OF NOTICE OF HEARING IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD The Board reviewed a Memorandum of January 23, 2003 and Planning Director Stan Boling stated that this is the second and final hearing on this Land Development Regulations amendment. The first public hearing was held on January 21, 2003 and no changes were requested by the Board. The Professional Services Advisory Committee (PSAC), the Planning & Zoning Commission (P&Z) and staff all support the amendment and recommend approval of the ordinance. The Chairman opened the public hearing and asked if anyone wished to be heard in regard FEBRUARY 4, 2003 to this matter. There being none, the Chairman closed the public hearing. ON MOTION by Commissioner Lowther, SECONDED by Commissioner Adams, the Board unanimously adopted Ordinance 2003-004 amending Land Development Regulations (LDRs) Chapter 911, Zoning, establishing the Small -Scale Home Furnishings Showrooms (excluding furniture and major appliances) Use Category; and providing for repeal of conflicting provisions, codification, severability and effective date. ALL BACKUP DOCUMENTATION AND ORDINANCE ARE ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD AND ARE HEREBY MADE A PART OF THESE MINUTES COMMENTS REGARDING CLOSING ON LOST TREE ISLANDS The Chairman announced that the closing on the purchase of Lost Tree Islands will take place Wednesday, February 5, 2003, here at the County Administration Building. Deputy County Attorney Will Collins stated that a lot has changed since this morning's Board meeting but he believed that all obstacles could be overcome. One of the problems was that St. Johns River Water Management District did not want to sign the release provided by Lost Tree regarding any claim SJRWMD might have to any of the property. St. Johns has now agreed to execute a joint stipulation of dismissal on the lawsuit. St. Johns believed that they had no claim to any of the lands and they were just defending their inclusion in the lawsuit. The City of Vero Beach and the Town of Indian River Shores had expressed concern regarding the Andlinger, Woodruff, and Holm Trust platted lots and Lost Tree has agreed to execute quit claim deeds relinquishing any claim they might have in and to those lots and all the attorneys involved in the closing have agreed that they are comfortable with that procedure. He hoped all would now go smoothly at the closing tomorrow. Chairman Macht then thanked Attorney Collins for all his hard work in this matter and noted that there will be a congratulatory ceremony tomorrow when the closing has been completed and all documents officially executed and received. INTRODUCTION OF CHARTER SCHOOL STUDENTS FEBRUARY 4, 2003 Chairman Macht then introduced 3 students from Indian River Charter School who were attending the meeting as a requirement of one of their government classes and noted that one of the students, Crystal Ploszay, has several paintings hanging in the Administration Building hallway. He stated that Crystal is a successful product of the Cultural Arts Camp which has been supported by the Board for many years.
