HomeMy WebLinkAbout2014-019 (2)ORDINANCE NO. 2014- 019 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTION 204.12 "STANDARDS FOR FRANCHISE ISSUANCE" AND SECTION 204.15 "FRANCHISE RENEWALS" OF CHAPTER 204 OF THE CODE OF INDIAN RIVER COUNTY ENTITLED "SOLID WASTE DISPOSAL" TO REQUIRE THE APPLICATION PROCESS TO BE CONSISTENT WITH THE REQUEST FOR PROPOSAL PROCESS; AND PROVIDING FOR SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: Section 1. Amendment of Chapter 204 (Solid Waste Disposal). Sections 204.12 and 204.15 of Chapter 204 of the Code of Indian River County, Florida are hereby amended to read as follows (added language is underlined, and deleted language noted by strikethrough): Section 204.12. — Procedure Standards for franchise issuance. d*GtFiGt'6 days'with at least teR (10) that:meeting. The district board may include process requirements for applications in addition to those set forth in the policies and procedures manual prepared pursuant to Section 105.06 of the County Code. Section 204.15. - Franchise renewals. (a) The district board shall renew a franchise in a manner consistent with the terms set forth in the franchise agreement and if necessary, follow the Request for Proposal process set forth in the policies and procedures manual prepared pursuant to Section 105.06ofthe County Code. If any part of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, the remainder of this ordinance shall not be affected by such holding and shall remain in full force and effect. Section 3. Codification. It is the intention of the Board of County Commissioners that the provisions of this ordinance shall become and be made part of the Indian River County Code, and that the sections of this ordinance may be renumbered or re -lettered and the word ordinance may be changed to section, article or such other appropriate word or phrase in order to accomplish such intention. Section 4. Effective Date. This ordinance shall become effective upon filing with the Florida Department of State. This ordinance was advertised in the Vero Beach Press Journal on the 8th day of November, 2014, for a public hearing to be held on the 18th day of November, 2014, at which time it was moved for adoption by Commissioner seconded by Commissioner Flescher , vote: Commissioner Wesley S.
