This Ordinance is enacted pursuant to Chapteriq 69-234, Laws of ida 1969 and Chapter 69-32, Laws of Florida, 20 1969, for the purpose of providing necessary regulation of any gathering 21 of groups or individuals for the purpose of listening to or participaton 22in enter tammentwhich-consists-prirnarily-0f—musicaL,rendi#ions 23 conducted in open spaces.not win an enclosed structure in the 24 interest�of the.public;healt1i .safrty.,and welfare..of the;citizens and 25 inhabitants of Indian River County. When used in this ordinance, the following words 29 shall mean: 30 (a) . Board shall mean the Board of C9unty Commissioners of 31 Indian River County, Florida. 32 (b) Musical or entertainment festival or festival shall mean any 33 gathering of groups or individuals for the purpose of listening to or 34 participation in entertainment which consists primarily of musical 35 renditions conducted in open spaces not within an enclosed structure. 36 Section 3. No person, firm, corporation or partnership 37 shall stage, promote, or conduct any musical or entertainment festival _3B--j.n the ncorporated area of Indian River County unless he shall first 39 secure from the Board a special entertainment permit for said festival. 40 Section 4. Said permit shall not be issued unless the following � R conditions aremetacti and the follov ing plans saber itt°to the Board 42 Amp an far-ade�uat�sanitation-facilities-and-sewage-disposal, - 43 approved by the county health officer; 44 (b) A plan for parking facilities which are not within the area of 45 the festival and a plan for the transportation of the patrons from said 46 parking facilities to the festival area, approved by the county 47 administrator, 48 (c) A plan for adequate medical facilities, approved by the county 49 health officer; 50 (d) A plan for the provision of adequate security and traffic 51 control in and around the festival area, approved by the Sheriff of 52 Indian River County; _5L — — — — AeLull disclosure must be made by the promoters to the Board of 54 the financial backing of the festival and the names of all persons or groups 55 who will perform at said festival; SmeadSoft Reprint Date: Monday, August 12, 2013 - 14:41:46 - Officia[Documents:2, Attachment Id 1, Page 2 - t 56 (f) Any other reasonable condition -set by the Board in its 57 discretion. 58 Section 5. Under no circumstances shall any person, firm, 59 corporation or partnership operate any festival which will continue for 60 more than one eight (8) hour period without a twenty-four (24) hour rest 61 period before any continuation of the fPgtival_ . 62, Seetion- . Said parent or guardian shall remain with the child at all , 65 times. 66 Section 7. The Board may assess a reasonable fee for the f 67 issuance of the permit provided in Section 3. 68 Section 8. Anyone who violates any section of this ordinance 69 shall be prosecuted by the prosecuting officer in Indian River County 70 having authority to prosecute misdemeanors and, upon conviction, shall 71 be punished by fine not to exceed $500.00 or by imprisonment in the 72 cnuntyjail not to exceed sixty (60) days or by both such fine and imprison - 3 itrertt ach violation shall otu titute a ;:�paxate�lfense Tho )3aard may 74 bring suit to restrain, enjoin, or otherwise prevent violation of this 75ordinance in the Circuit Court of Indian River County. 76 Section t is declared o e int een o e r 77 any section, subsection, sentence, clause, phrase or portion of -this 78 ordinance is for any reason held invalid or unconstitutional by any court 79 of competent jurisdiction, such portion shall be deemed a separate, distinct 80 and independent provision, and such holding shall not affect the validity 81 of the remaining portions hereof. 82 Section 10.
