Dear Mr. Olsen / Mr. Collins; Follotcing review of some of the requested materials provided by Mr, Jcsse Roland \Nhich arc attached hereto, and discussion with Mr. Olseo, Utilities Director; Immanuel Church offers and encloses herein a check for $4,100 dollars as outlined below as full and final seltlemenl and satisfaction of all impact, connection fees, and deposits for the sewer, fire line, and water service to the referenced project. Attached is a copy of the 1990 Building Application and Permit and a 1989 recalculation of the impact fee that would have been due on the referenced project along with an as-huilt drawing of the \atcr and sewer improvements dated at sone point during 2004. 1 understand that the county has adjusted the 11RU assessment to one 1?RU tiuc to the reduction in the size of the project and assembly room occupancy during the first phase of occupancy. Pagel oft Since m\ last letter to both addressees 1 have spoken to Mr. Olsen and there was another calculation done which was in general agreement with an amount ($12.000) that Pastor Rogcr Rall had remembered paying to the county prior to the issuance of the building permit. Recause neither the County nor Immanuel have original records of the impact fee payment we must rely on Pastor Roll's recollection as to the impact Ices actually paid. its it turns out pastor Roll's recollection was consistent (within a few hundred dollars) of prepayment of all County impact fees as they would have been calculated in 1990 including water, sewer, fire line. There is no evidence either documentary or testimonial, of payment of the monthly "service availability fee,' or "base facility charge"dcs that Such Ices is it is now known. Immanuel Church therefore concedes that such Ices will hacc to be paid in accordance with this negotiated agreement to update Immanucl's entitlement to connect. Actual availability was established during 2004 as evidenced by the attached as -built of inaprmerrients along 58'x' Avenue. As such ImmanUCI agrees to pa}file service avaihihilit\ charge assessed ($26 for I FRU X 60 months $1560) from January 2005 to present. lnunanucl also agrees to pay''/, ERU for the period between permitting in 1990 and 2005.
