INDIAN RIVER COUNTY ORDINANCE NO. 77- 32
AN ORDINANCE CREATING THE INDIAN RIVER COUNTY PARK
AND RECREATION DEPARTMENT; AUTHORIZING SAID DEPART-
MENT TO ESTABLISH PROCEDURES, RULES AND REGULATIONS
FOR THE OPERATION OF PARKS WITHIN INDIAN RIVER COUNTY,
FLORIDA; AUTITORIZING TITE APPOINTMENT BY THE DEPARTMENT
HEAD OF LITTER ENFORCEMENT OFFICERS; MAKING VIOLATIONS
OF THIS ORDINANCE A MISDEMEANOR AND ESTABLISIIING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
. INDIAN RIVER COUNTY, FLORIDA:
Section 1. This Ordinance shall be known and cited as the Indian River
County Parks and Recreation Department Ordinance.
Section 2. The regulation of County owned or controlled Parks and
Recreation areas in Indian River County is declared to be in the public
interest and this Ordinance is an exercise of the police power of the County
for the protection of the public health, safety and welfare. Provisions of
this Ordinance shall be liberally construed for the accomplishment of this
purpose.
Section 3. There is hereby created in Indian River County, Florida, a
department known as the Indian River County Parks and Recreation Department.
The Department shall be headed by the Indian River County Administrator.
Section 4. The Indian River County Parks and Recreation Department
shall establish standards, rules and procedures for the use and operation of
Parks and Recreational areas under the jurisdiction of Indian River County
Commission in the unincorporated or incorporated portion of Indian River
County, Florida.
Section 5. The County Administrator shall appoint pursuant to Florida
Statute 403.413 (1975) an Indian River County Litter Officer or officers who
shall be employees of the Indian River County Parks and Recreation Depart-
ment. Said employees shall qualify as law enforcement officers for the
purposes of enforcing Florida Statute 403.413 (1975) and this Ordinance.
Section 6. The Board of County Commissioners shall determine the
t raining and qualifications of each employee of the Indian River County Parks
a nd Recreation Department designated to enforce the provisions of Florida
Statute 403.413 (1975) if the designated employee is not a regular law en-
forcement officer.
Section 7. Violations of this Ordinance shall constitute a misdemeanor
a nd shall be punished in accordance with the law.
Section 8. The Board of County Comm issioners of Indian River County,
Florida, may petition the Circuit Court of Indian River County for injunctive
relief to enforce the requirements of this Ordinance.
Section 9. This Ordinance shall become effective upon its passage
and receipt by the Secretary of State..
