AN AMENDMENT TO INDIAN RIVER COUNTY ORDINANCE 78-18
EXTENDING FOR AN ADDITIONAL THREE MONTHS THE MORATORIUM
ON ISSUANCE OF NEW SEWER AND/OR WATER FRANCHISES OR THE
ENLARGEMENT OF ANY EXISTING SEWER OR WATER FRANCHISE AREAS
WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER
COUNTY, FLORIDA, pursuant to Chapter 59-1380, Laws of Florida,
has authority to issue, modify, amend and revoke Sewer and
Water Franchises within Indian River County, Florida; and
WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER
COUNTY, FLORIDA, has previously adopted Indian River County
Ordinance 78-18, which Ordinance became effective July 12, 1978;
and
WHEREAS, the basic purpose of Indian River County Ordinance
78-18 was to declare a moratorium enabling appropriate governmental
planners to evaluate the County sewer and water needs and to
prepare a general overall plan; and
WHEREAS, it appears .that an additional three (3) months will
be required to obtain the necessary engineering and geological
review of existing sewer and water reports and preparation of
new County studies; and
WHEREAS, the BOARD OF COUNTY COMMISSIONERS for Indian River
County determines that it is in the best interest of the County's
public health and welfare to extend the sewer and water moratorium
affecting issuance of new franchises or enlargement of existing
franchises for an additional three (3) month period of time; and
WHEREAS, it is anticipated that in addition to the necessary
studies, new rules and regulations affecting franchises will be
implemented by the Board prior to April 10, 1979;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COM-
MISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, That Indian River
County Ordinance 78-18 is hereby amended by extending the moratorium
on the issuance of new sewer and/or water franchises or the

enlargement of any existing sewer and/or water franchise
areas for an additional three (3) month period of time from
January 10, 1979, with the exception that as in Indian River,
County Ordinance 78-18, this moratorium shall not apply to
areas where the Board previously has granted tentative or
final subdivision plat approval.
This Ordinance shall become effective as provided by law.
This Ordinance shall take effect January 15, 1979.
