HomeMy WebLinkAbout10/14/1981CLUP - Various Areas Wednesday, October 14, 1981 The Board of County Commissioners of Indian River County, Florida, met in Special Session at the City Hall Council Chambers, 1053 20th Place, Vero Beach, Florida, on Wednesday, October 14, 1981, at 7:00 o'clock P.M. Present were Patrick B. Lyons, Chairman; William C. Wodtke, Jr., Vice.Chairman; Dick..Bird; Alfred Grover Fletcher; and Don C. Scurlock, Jr. Also present were Neil A. Nelson, County Administrator; R. Stephen Houlihan, Assistant Attorney to the Board of County Commissioners; and Janice Caldwell, Deputy Clerk. The Chairman called the meeting to order. The Chairman requested that two emergency items be added to the agenda; one concerning the Annual Report from the Office of the Clerk, and the other concerning the Treasure Coast Regional Planning Council. On Motion by Commissioner Scurlock, seconded by Commis- sioner Fletcher, the Board unanimously approved the addition of the emergency items to the agenda. On Motion by Commissioner Scurlock, seconded by Commis- sioner Fletcher, the Board unanimously accepted the Annual Report for year ending September 30, 1981 from the Office of Clerk of the Circuit Court. Area east of U.S. #1 from hospital to North Relief Canal. 2. A -1-A & S.R. 510 Tourist Commercial Node. 3. West Wabasso. 4. I-95 & S.R. 512 Node. 5. LD -2 area south of S.R. 60 to South Relief Canal. 6. Troglen, Global Paving & Old Race Track Area. 7. Sebastian Airport Industrial Node. Chairman Lyons stated that Mr. Avril had planned to discuss his property on U.S. #1 this evening but was called away on business. Mr. Avril had sent a letter to the Planning Department explaining his concerns. Planning Director Rever referred to Item 1, the area east of U.S. #1 from the hospital to the North Relief Canal, which contains different elements of concern such as medium density housing and environmentally sensitive areas. He advised that he has worked with attorneys and the Florida Fresh Water Fish & Game Commission and felt they had a reasonable proposal for an environmentally sensitive designation. Senior Planner Art Challacombe then gave a summary of existing conditions of the area in terms of inventory, land use, zoning and the proposed land use plan. He displayed a 1973 aerial photograph, as well as an aerial photograph dated 1981. He referred to a "special treatment" district at Lindsey Road to the North Relief Canal, and the intention of the plan is to show an overlay over an existing density classification - this would not be a density cap. Mr. Challacombe commented that under zoning, they have no special classi- fication for environmentally sensitive areas but by using the overlay, the area would receive special treatment. He stated that they can create zoning for wetland areas; and the owners in those areas could be given restrictive use through zoning. a Lengthy discussion and debate continued. Chairman Lyons did not think any one wanted to encourage higher density close to the river. Commissioner Wodtke stated that he did not care to see any density classifications given to the wetland areas. He also felt that development in the area along the river should be multi- family. Commissioner Wodtke spoke about the hospital area and felt they should have flexibility and suggested they leave the area in MD -1 and indicate that there is an environmentally sensitive area at that location and extended it up to the North Relief Canal. Mr. Challacombe interjected that if the Board wanted to have a tighter control over the densities, the recommendation for zoning would be the way to proceed. Ray Fernald, President of the Pelican Audubon Society, gave his comments about the wetlands. He stated that the County has a state-wide reputation as being protective of their wetlands and he would encourage the Board to continue this approach and take the lead role in protecting the resources. Commissioner Bird noted that the Board's basic intent was to earmark and designate the areas under discussion as environmentally sensitive and to prohibit any development. What kind of a density cap is used and how we establish that criteria is a problem that will have to be solved. Discussion ensued about the.environmentally sensitive area. Commissioner Wodtke commented that the people that own the land that is to be zoned..environmentally sensitive will have to know that it will not be developed and that the County wants to preserve it. Attorney B. T. Cooksey briefly discussed the spoil ea.seR: ments; if the County wanted to preserve them, he thought that the transfer of development rights would be the answer. Ann Robinson, Pelican Audubon Society, felt a reasonable approach would be to keep in mind the 100 year flood plan. She thought it would be premature to put anything on this area except LD -1. OCT 14 1981 BOOR 4 7 PAGE 744 5 rOCT 141981 BOOK 4 7 Pu Chairman Lyons noted that they were going to use the guidelines from the Florida Game & Fresh Water Fish Commission and outline the environmentally sensitive areas and come up with a zoning classification for the area. Discussion arose regarding transfer of development rights from one parcel to another. Motion was made by Commissioner Wodtke, seconded by Com- missioner Bird, that the area from Barber Avenue to the North Relief Canal would be MD -1, and the burnt orange portion of the map, that was designated as environmentally sensitive, would have a maximum density class of LD -1, using the 1981 map. More discussion followed along those lines. Commissioner Fletcher stated that the CLUP is supposed to be directly related to resources available; there are no resources available, so he was not in favor of increasing the density at that location. Mr. Robinson, Laurel Homes, expressed concern about moderate housing in the area and stressed to the Board that somewhere they are going to have to provide affordable housing. He felt Hibiscus Airport property would provide this need very well. Dean Luethje spoke briefly about the comparison of develop- ment costs of the property on the river vs. the Hibiscus Airport property. He noted the river property would be approximately $20,000 additional per acre to cover the fill, storm water control and the problem of encountering rock. Ron Arendas, representing the working class individual and Piper Aircraft, came before the Board. He felt the plan should do more.than determine density - it should enable people to be able to own homes in the County. Mr. Arendas stated that many of their employees have to leave because hotsing is not available - the cost of housing should not be out of the range of the working class. He did not believe that a plan allowing for 6 units an acre could provide housing at mortgage rates that the people could afford. Mr. Arendas urged the Board to review the CLUP by keeping the working people in mind. Chris Hubbard, Chamber of Commerce, spoke about decent housing that people could afford, and about a land use mix that should be encouraged. He stressed that the Board should make sure all elements of the community have a place in which tb live. Mr. Hubbard felt it was important to consider having the necessary services nearby, if possible. He urged the Board to focus their attention on trying to supply affordable housing. Bob Fleckenstein pointed out that people are bringing many things into the density question that do not belong there. He then spoke about the current high interest rate, which was why people could not afford housing any more. Mr. Fleckenstein objected to the sleight of hand methods being used and hoped that sanity would prevail. David Nolte, Property Appraiser, read from an article in the New York Times printed last Sunday. The article stated that if we do.not provide houses that our employees can afford, higher salaries would have to be paid to -them. The Chairman called for the question. It was voted on and carried 4 to 1, with Commissioner Fletcher voting in opposition. Motion was made by Commissioner Scurlock, seconded by Com- missioner Fletcher, that the Board designate the remaining environ- mentally sensitive areas to RR -1, and that the Planning staff come up with the criteria within the plan, notwithstanding the previous Motion. rights. It was voted on and carried 4 to 1, with Commissioner Wodtke voting in opposition. Jackie Sypar came before the Board regarding the LD -2 area south of S.R. 60 to the South Relief Canal. She read the 1953 restrictions which called for two houses per acre, and stated she would like to keep it that way. BOOK 47 PAGE 746 BOOK 7 ��� OCT 141981 ,E 747 Commissioner Wodtke felt that deed restrictions were strong and would prevail in case of a problem. Attorney Houlihan noted that deed restrictions are between parties limited to each other, and have no effect on the County's land use and land decisions. The property owners would have to initiate enforcement of the deed restrictions. Senior Planner Challacombe referred to the aerial map and pointed out that the majority of the land in that particular area is 2 units per acre or less - the existing zoning is R-1 or for agricultural use. On Motion by Commissioner Scurlock, seconded by Commissioner Fletcher, the Board unanimously approved the Planning staff's recom- mendation to change LD -2 to LD -1 from Rosewood Road to South Relief Canal and from,43rd Avenue to Kings Highway. Senior Planner.Challacombe next discussed Item #1 - AlA and S.R. 510, Tourist Commercial Node. He stated that the existing area is approximately 31.87 acres and the site plan of Sea Oaks has been approved. He felt that to propose a hotel/motel complex inn this area wouldgenerate traffic. The impaction, due to the traffic generators at Summerplace, would have an adverse effect on the residents and would clog the arterial intersection. Mr. Challacombe stated that the Planning Staff would not be opposed to having a village shop -type designation at that location, and they recommend that it be C-lA or else the LD -2 classification, as shown on the map, leaving the tourist commercial node of 25 acres. Attorney B. T. Cooksey, representing William Collins, stated that the land does not abut Summerplace - it is about 300' or 400' north of that location. He added that the people purchased the land for the purpose of putting up a hotel/motel complex, where it is a permitted use. Attorney Cooksey requested that the node be split and not just be situated south of Summerplace. Thad Wilkins, real estate broker, discussed the traffic impaction. He said that the plan would eliminate commercial to the north and considerably increase the node to the south. He proposed that if the commercial area was divided to the north where it originally was, it would eliminate some of the impaction and it would lessen the traffic congestion. Mr. Wilkins stated that his client closed on this property in February and it was deeded to him as a commercial piece of property. He then referred to a letter from Dewey Walker stating the property was C-lA, and the owner has spent time and money in the advent of developing the hotel/motel complex. Lengthy.discussion followed regarding the intersection. Motion was made by Commissioner Scurlock, seconded by Commissioner Fletcher, that the Board accept the Planning Department's recommendation to make the subject property LD -2. Discussion followed about the intersection. The Chairman called for the question. It was voted on and carried with a vote of 3 to 2, with Commissioners Bird and Wodtke voting in opposition. Planning Director Rever next discussed the West Wabasso area, where they are considering a mixed use designation. Primarily, he explained, the use is residential, with commercial type of use taking place next to it. This area lends itself more to redevelopment and rehabilitation of the present buildings. Mr. Rever stated that the Planning Staff recommendation is that it remain as it is at LD -2, or 6 units per acre. Ken Pangburn, Wabasso, approached the Board and felt some attention should be given to the West Wabasso area, as was given to the areas in Oslo and Gifford. Discussion followed about redevelopment and rehabilitation of old homes. Planning Director Rever commented that this area should be left as is; LD -2 to the north of Wabasso Road, and LD -1 to the south. Motion was made by Commissioner Scurlock, seconded by Commissioner Fletcher, that the Board accept the recommendation of OCT 141991 9 600K 4 7 PAGE 748 OCT 14 1981 806K 47 PAcE74 9 the Planning Department that the area be left in its present LD -2 and LD -1 designation. Discussion followed. The Chairman called for the question. It was voted on and carried with a vote of 3 to 2, with Commissioners Wodtke and Bird voting in opposition. Mr. Rever next discussed the area at I-95 and the S.R. 512 node, and suggested that it be split between industrial and commercial. He then discussed the annexation in Sebastian and the Sebastian Airport Industrial Node and felt that node of 130 acres should be eliminated. Discussion followed. Commissioner Fletcher objected to the Sebastian Airport Node being brought up now instead of discussing it in Sebastian. Motion was made by Commissioner Bird, seconded by Commis- sioner Wodtke to reconsider the node at I-95 and S.R. 512 to accommodate both industrial and commercial; and to reconsider the Sebastian Airport Node with the concerned people being notified of the meeting. The Chairman called for the question. It was voted on and carried with a vote of 3 to 2, with Commissioners Fletcher and Scurlock voting in opposition. Mr. Rever next discussed with the Board the Trodglen, Global Paving & Old Race Track Area, which has acreage of about 100 acres. He recommended that this area be taken out of LD -2 and placed into a 100 acre industrial node. On Motion by Commissioner Wodtke, seconded by Commissioner Bird, the Board unanimously approved the subject area be taken out of the LD -2 classification and placed into a 100 acre industrial node. Chairman Lyons discussed Mr. Avril's property, which is on the east side of U.S. #1 in the Wabasso area. Discussion followed and it was determined that the Planning Department had addressed Mr. Avril's request. � s � The Board reviewed the Hibiscus Airport property, and Commissioner Scurlock felt the Board should be receptive to the Planning Department's recommendation. Motion was made by Commissioner Bird to change the designation of the property known as the Hibiscus Airport from LD -2 to MD -1, and those that are affected by it would have a full opportunity to express their feelings at the next County Commission meeting. Motion died for lack of a second. Debate continued. Chairman Lyons stated that the maps would have to be redone and then the Board could make their decision regarding this matter. A gentleman appeared on behalf of Steve Henderson regarding property owned by John.Cole on Kings Highway, and requested that the boundary line be moved. Planning Director Rever responded that in this particular area, there was no need to change and it was best to use the road for a boundary line. Steve Henderson's representative next discussed property owned by Henry Parman next I-95. Mr. Rever stated that this item was addressed at the last CLUP meeting and they did not make the change he requested. Judd Barker, 38th Avenue, briefly discussed LD -1 zoning for Kings Highway. The Chairman announced that there would be a CLUP meeting at 7:00 P.M. in City Hall Council Chambers on November 2, 1981.
