AN ORDINANCE RELATING TO SET BACKS ON EACH SIDE
OF STATE ROAD 60 FROM TIIE WEST 13OUNDARY OF THE
MAIN CANAL TO INTERSTATE 95 INTERCHANGE; PROVIDING
FOR BUILDING CONSTRUCTION SET BACKS OF AT LEAST
SEVENTY-FIVE (75 1) FEET FROM TIIE RIGHT OF WAY LINE
OF STATE ROAD 60; PROVIDING FOR PENALTIES; AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the Board of County Commissioners of Indian River County
recognizes that the opening of Interstate 95 into St. Lucie County will tend to
attract a corridor of auto -oriented enterprises along State Road 60 and this
movement should be carefully regulated in order to protect the locality's
main traffic accessway to Interstate 95 to insure sound stabilized economic
growth; and
WHEREAS, Indian River County is attempting to comply with the State
Comprehensive Land Use Statutes for the purposes of insuring orderly
development within Indian River County; and
WHEREAS, a rapid development of property on either side of State
Road 60 would frustrate the purposes of orderly planned growth within the
County;
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
INDIAN RIVER COUNTY, FLORIDA, That:
Section 1. There is hereby established a seventy-five (751) foot
building construction set back on all real property fronting on State Road 60
from the West boundary line of the Main Canal to the Interstate 95 Interchange.
The required set back shall be measured from the road right of way line.
Section 2. Anyone who violates this Ordinance shall be guilty of a
mibdemeanor and upon conviction, shall be punished by a fine not exceeding
Five Hundred Dollars ($500. 00) or by imprisonment in the County Jail not
exceeding sixty (60) days or by both fine and imprisonment. Each day in
violation shall constitute a separate offense. The Board of County Commissioners
may bring suit to restrain, enjoin or otherwise prevent violation of this
Ordinance in the Circuit Court of Indian River County.
Section 3. This Ordinance shall take effect on December 27, 1977
and be in effect for a period of one (1) year. All other Ordinances and
Amendments thereto that are in conflict with this Ordinance are hereby
repealed.
