HomeMy WebLinkAbout1975-6(; INDIAN RIVER COUNTY ORDINANCE NO. 75-� I I i i An Ordinance to be entitled: An Ordinance relating to set backs on each side of State Road 60 from the West Boundary of the Main Canal to the Interstate 95 Interchange; providing for building construction i, set backs of at least seventy-five (751) feet from the right of way line of State Road 60; providing penalties; and providing an effective date. I I WHEREAS, the Board of County Commissioners of Indian River i' County recognizes that the opening of Interstate 95 will tend to attract a corridor of auto -oriented enterprises along State Road 60 and this movement should be carefully regulated in order to protect the locality's main traffic f accessway to Interstate 95 to insure sound stabilized economic growth, and f'. WHEREAS, a Master Plan for the orderly development of Indian i j River County has not yet been adopted by Ordinance, and j !i WHEREAS, rapid development of property on each side of State Road 60 would frustrate the purposes of the Master Plan, i NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Indian River County: Section 1. There is hereby established a seventy-five (751) foot building construction set back on all real property fronting on State Road 60 I from the West boundary line of the Main Canal to the Interstate 95 Interchange! �! The required set back shall be measured from the road right of way line. ! I i; Section 2. Anyone who violates this Ordinance shall be guilty of a is I. inisdeameanor and upon conviction, shall be punished by a fine not exceeding ,i Five Hundred Dollars ($500. 00) or by imprisonment in the County Jail not I I' j: exceeding sixty (60) days or by both fine and imprisonment. Each day in u li violation shall constitute a separate offense. The 13oard of County 1' Commissioners may bring suit to restrain, enjoin or otherwise prevent I I, II i m Ijviolation of this Ordinance in the Circuit Court of Indian Ftiver County. {i Section 3. This Ordinance shall take effect on December 3, 1975 � i� and be in effect for a period of one (1) year.
