HomeMy WebLinkAbout1989-186/26/89 PNOT2 LR -Planning VJ/RL ORDINANCE NO. 89- 18 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN; ENLARGING THE COMMERIAL NODE AT U.S. #1 AND THE NORTH RELIEF CANAL FROM 10 ACRES TO 92 ACRES; AND PROVIDING FOR CODIFICATION, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, Chapter 163 of the Florida Statues requires that local governments prepare and adopt Comprehensive Plans; and WHEREAS, the Board of County Commissioners has adopted a Comprehensive Plan pursuant to Florida Statutes; and WHEREAS, Florida Statues provide for the amendment of Compre-h€n-s-ive-P-la- ns -twice -per ca-lenda-r-year-;-and WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency, has held public hearings and made recommendations concerning these amendments; and WHEREAS, the Board of County Commissioners has held public hearings at which parties in interest and citizens were allowed to be heard; and WHEREAS, the Board of County Commissioners has determined that these amendments are consistent with the general spirit and intent of the County's Comprehensive Plan; NOW THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Indian River County, Florida, and the accompanying Land Use Map, be amended as follows: SECTION 1 The section entitled "Winter Beach/Gifford Area" on pages 35-36 of the Land Use Element of the Comprehensive Plan is hereby amended as follows: A t¢4/,10Y ninety-two (92) acre commercial node is located on the east side of U.S. #1 46tt4 on either side of the north relief canal. SECTION 3 SEVERABILITY If any section, part of a sentance, paragraph, phrase or word of this ordinance is for any reason held to be unconstitutional, inoperative or void, such holdings shall not affect the remaining po-r-tions hereof and it—shallbe construed to have been the legislative intent to pass this ordinance without such unconstitutional, invalid or inoperative part. SECTION 4 The provisions of this ordinance shall become effective upon receipt from the Florida Secretary of State of offil acknowledgement that this ordinance has been filed with the Department of State.
