HomeMy WebLinkAbout1983-013 INDIAN RIVER COUNTY ORDINANCE NO. 03-1 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTION 4-32 OF THE CODE OF LAWS AND ORDINANCES, KNOWN AS THE STANDARD BUILDING CODE; PROVIDING FOR INCREASE IN THE MEMBERSHIP OF THE BOARD OF ADJUSTMENTS AND APPEALS TO SEVEN MEMBERS; INCREASE IN THE QUORUM REQUIREMENTS TO FOUR MEMBERS; INCORPORATION IN THE CODE; SEVERABILITY; AND EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: SECTION 1 Subsection 111.1 of Section 4-32 of the Code of Laws and Ordinances of Indian River County, Florida is hereby amended to read as follows: BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS/ APPOINTMENT. There is hereby established a Board to be called the Building Code Board of Adjustments and Appeals. All references within the Standard Building Code to the Board of Adjustments and A2peals shall be construed to be a reference to the Building Code Board of Adjustments and Appeals The Board shall consist of seven (7) €}ve-f5t members. Said Board shall be appointed by the Board of County Commissioners of Indian River County, Florida by resolution. The membership of the Board shall consist of at least one architect, one engineer, one general contractor, and four members with experience in the building industry. One member of the Board shall be a representative of the Board of Zoning Adjustments. SECTION 2 Subsection 111.3 of Section 4-32 of the Code of Laws and Ordinances of Indian River County is hereby amended to read as follows: QUORUM. Four (4) Three -fat members of the Board shall constitute a quorum. In varying the application of any provisions of this Code or in modifying an order of the Building Official, affirmative votes of the majority present, but not less than four (4) three-f3� affirmative votes shall be required. A Board member shall not act in a case in which he has a personal interest. -1- CODING: Words in struck -through type are deletions from existing law; words underlined are additions. SECTION 3 INCORPORATION IN CODE, The provisions of this ordinance shall be incorporated into the County Code and the word "ordinance" may be changed to "section", "article", or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intentions. SECTION 4 SEVERABILITY. If any section, part of a sentence, paragraph, phrase or word of this ordinance is for any reason held to be unconstitutional, inoperative or void, such holdings shall not affect the remaining portions hereof and it shall be construed to have been the legislative intent to pass this ordinance without such unconstitutional, invalid or inoperative part. SECTION 5 EFFECTIVE DATE. The provisions of this ordinance shall become effective upon receipt from the Florida Secretary of State of official acknowledgment that this ordinance has been filed with the Department of State.
