WHEREAS, Chapter 418, Florida Statutes, authorizes a county to create_ mobile home park recreation districts by ordinance with boundaries to be that of the mobile home park in question, for the purposes enumerated in Chapter 418, and, in particular, for the purpose of levying and assessing a special assessment against each mobile home parcel within the district to raise funds to rrequir,r and imprwe streets and lights, recreation facilitic,, and ether eoiumon areas of all types, including real property and personal pr„perty; and WHEREAS, certain residents of lireeiv %!Have !lobile 'j-- Pirk have• petitioned the County to oro -at- s,Ych a ri.,hil, hon.• :-K. rerrentinn district; and WHEREAS, the t'ounty Hud, `i;a! such 1 gioro Y v, uw h- in the public interest; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: SLCfION 1. CREATION AND CHARTER OF ulsl'ItIc1' 'Chis ordintinee shall create and serve as the Charter for the Nreezy wringe mobile Ifome Park Recreation Dislrici. "Che boundaries of the district shall he as shown on Exhibit "A" attached to this ordinance. SECTION 2. NO REFERENDUM HLOUIRED The Hoard of County Commissioners finds that a majority of the electors of the proposed district has signed n petition requesting that the County create the mobile home park recreation district, and, therefore, pursuant to 3418.30, Florida Statutes, no referendum shall be required to create the district. 'rhe petition shall be kept on file at the Clerk's Office. SEC'T'ION 3. GOVERNING BODY OF DIS'T'RICT The governing body of the district shall consist of a nine -member board of trustees elected pursuant to 3418.302, Florida Statutes. The date of the election required in subparagraph 2 of ORDINANCE NO. 85- 103 (continued) 9418.:302 shall be the first Tuesday in March of each year; provided that it' at any time there are no more candidates for the office of trustee than the required number, then no election need be held. P0WEItS OF 'fHE O10BI1,1.' 110Mh: PARK RECREATION DISTRICT; RECREATION DISTRICT TAX The recreation district shall have all the powers and duties ati authorized by Chapter 418, Part 11, Florida Statutes. SECTION 5. BONDS OF THE RECREATION DIS I'ItIC t' The district shall have such po,cers concerninu hands as given in 9418.306, Florida Statutes. SEXTION 6.
