HomeMy WebLinkAbout1983-45ORDINANCE NO. 83- 45 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, PROHIBITING THE SALVAGING OF ITEMS FROM INDIAN RIVER,COUNTY TRANSFER STATIONS AND REQUIRING THE POSTING OF NO SALVAGING SIGNS, PROVIDING FOR PENALTIES; INCORPORATION IN CODE; SEVERABILITY; AND EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Indian River County has recently been put on notice of certain salvaging activities being conducted by members of the general public at the County's various transfer stations, and WHEREAS, it has been determined that such salvaging activities constitute a hazard to those salvaging as well as to the members of the general public using the transfer stations for the purposes they were intended. NOW, THEREFORE B2 IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: NO SALVAGING It shall be illegal and subject to the punishment as provided herein for any person or business entity to salvage materials from any of the County owned and operated transfer stations. For the purposes of this ordinance "salvaging" shall mean the removal of any item from, or sorting through items in a transfer station site after they have been deposited for collection and disposal. SECTION 2 PENALTIES Any violation of the provisions of this ordinance shall be subject to punishment by a fine not to exceed FIVE HUNDRED DOLLARS ($500.00), or by imprisonment in County jail, not to exceed sixty (60) days, or by both such fine and imprisonment. Each day a violation continues after the violator has been notified to cease the violation by an agent of the Board of County Commissioners shall constitute a separate offense. INCORPORATION IN CODE The provisions of this Ordinance shall be incorporated into the County Code and the word "ordinance" may be changed to -1- "section", "article", or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intentions. T/.TTl A SEVERABILITY If any section, part of a sentence, paragraph, phrase or word of this Ordinance is for any reason held to be unconstitu- tional, inoperative or void, such holdings shall not affect the remaining portions of this Ordinance; and it shall be construed to have been -the legislative intent to pass the ordinance without such unconstitutional, invalid or inoperative part. SECTION 5 EFFECTIVE DATE The provisions of this ordinance shall become effective upon receipt from the Florida secretary of state of official acknowledgment that this ordinance has been filed with the Department of State.
