HomeMy WebLinkAbout1999-34ORDINANCE NO. 99- 3 4 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM A -I AND RM -6 TO RM -81 FOR PROPERTY LOCATED ON THE NORTH SIDE OF SR 60, APPROXIMATELY 800 FEET WEST OF 74TH AVENUE, AND DESCRIBED HEREIN, AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request, and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing for this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, to -wit: THE EAST 13.77 ACRES OF THAT PART OF TRACT 7 LYING NORTH OF THE NORTH RIGHT-OF-WAY OF STATE ROAD 60 IN SECTION 1, TOWNSHIP 33 SOUTH, RANGE 38 EAST, ACCORDING TO THE LAST GENERAL PLAT OF LANDS OF THE INDIAN RIVER FARMS COMPANY SUBDIVISION, AS RECORDED IN PLAT BOOK 2, PAGE 25, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, SAID LANDS NOW LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA. ORDINANCE NO. 99- 3 4 THE WEST 531.1 FEET OF TRACT 8, IN SECTION 1, TOWNSHIP 33 SOUTH, RANGE 38 EAST, AS THE SAME IS DESIGNATED ON THE LAST GENERAL PLAT OF LANDS OF THE INDIAN RIVER FARMS COMPANY, FILED 1N THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF ST. LUCIE COUNTY, FLORIDA, IN PLAT BOOK 21 PAGE 25, SAID LANDS NOW LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA, LESS AND EXCEPT THE NORTH 495 FEET THEREOF AND LESS HIGHWAY RIGHT-OF-WAY. Be changed from A4, Agricultural District (up to 1 unit/5 acres), and RM -6, Multiple -Family Residential District (up to 6 units/acre), to RM -8, Multiple -Family Residential District (up to 8 units/acre). All with the meaning and intent and as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 16"' day of November, 1999. ORDINANCE NO. 99 - This ordinance was advertised in the Press -Journal on the 3`d day of November, 1999 for a public hearing to be held on the 16`x' day of November, 1999 at which time it was moved for adoption by Commissioner S t a n b r i d g e , seconded by Commissioner T i p p i n , and adopted by the following vote: Chairman Kenneth R.
