AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE
ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RM -6 TO
CG, FOR THE -PROPERTY GENERALLY LOCATED WEST OF U.S. #1 AND
SOUTHEAST OF ROSELAND ROAD, AND DESCRIBED HEREIN, AND
PROVIDING FOR EFFECTIVE DATE
WHEREAS, he Planning -and -Zoning Commission, sitting -as the
local ng agency on such -matters has held a public hearing
and subsequently made a recommendation regarding this rezoning
request; and
WHEREAS, the Board of County Commissioners of Indian River
Florida, did publish and send its Notice of Intent to
rezone the hereinafter described property; and
WHEREAS, the Board of County Commissioners has determined that
this rezoning is in conformance with the Comprehensive Plan of
Indian River County; and
WHEREAS, the Board of County Commissioners has held a public
hearing pursuant to this rezoning request, at which parties in
interest and citizens were heard;
NOW, THEREFORE, BE IT ORDAINED, by the Board of County
Commissioners ot Indian River county, Florida, that the Zoning of
the following described property situated in Indian River County,
Florida, to -wit:
BEING A PORTION OF LOTS 13, 14, 15 & 16. PLAT OF TOWN OF
WAUREGAN, RECORDED IN PLATBOOK 1, PAGES 178 AND 179,
BREVARD COUNTY, FLORIDA, SAID LANDS NOW LYING AND BEING
IN INDIAN RIVER COUNTY, FLORIDA BEING MORE FULLY
DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEASTERLY CORNER OF TRACT "G" AS
SHOWN ON THE PLAT OF RIVERWALK II AS RECORDED IN PLAT
BOOK 12 PAGE 36 OF THE PUBLIC RECORDS OF INDIAN RIVER
COUNTY, FLORIDA; THENCE S45044155"W ALONG THE
SOUTHEASTERLY LINE OF SAID TRACT G A DISTANCE OF 323.56
FEET TO THE SOUTHWESTERLY CORNER OF SAID TRACT "G" AND

NORTHEASTERLY OF THE NORTHEASTERLY RIGHT-OF-WAY LINE OF
WAUREGAN AVE. (AS MEASURED AT A RIGHT ANGLE); THENCE
N44025 -'06"W ALONG_ A LINE THAT IS PARALLEL TO _SAID
NORTHEASTERLY RIGHT-OF-WAY LINEdOF WAUREGAN AVE. A
DISTANCE OF 919.97 FEET; THENCE N4'5o39'24"E A DISTANCE OF
445.05 FEET; THENCE S43o3l'0611E A DISTANCE OF 380.53
FEET; THENCE S45049'17"W A DISTANCE OF 103.89 FEET;
THENCE S44010'35"E ALONG THE NORTHWESTERLY PROPERTY LINES
OF TRACTS "D", "F" AND "G" OF SAID PLAT OF RIVERWALK II
A DISTANCE OF 540.31 FEET TO THE SOUTHWESTERLY CORNER OF
SAID TRACT "G" AND POINT OF BEGINNING. CONTAINING 8.00
ACRES MORE -OR LESS.

All wit__h the meaning and intent and as set and described in
said Zoning Regulations.
Approved and adopted by the Board of County Commissioners of
Indian River County, Florida, on this 17 day of December 1991.
This ordinance was advertised in the Vero Beach Press -Journal
on the 25 day of November , 1991 for a public hearing to be
held on the 17 day of December , 1991 at which time it was
moved for adoption by Commissioner Wheeler , seconded by
Commissioner Eggert , and adopted by the following
