HomeMy WebLinkAbout1990-051 I - 1117190(SPB02)LEGAL(SPBlnhm) ORDINANCE NO. 90- 5 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTIONS 3-2, 3-5, 3-10, and 3-16 OF THE INDIAN RIVER COUNTY ANIMAL CONTROL ORDINANCE OF THE INDIAN—RIVER COUNTY—CODE-10F SAWS AND ORDINANCES; PROVIDING FOR DEFINITIONS; PROVIDING FOR OWNERSHIP RESPONSIBILI- TIES; PROVIDING FOR PUBLIC RESPONSIBILITIES; PROVIDING FOR VIOLATION FOR UNLAWFULLY HARBORING WILD ANIMALS; PROVIDING FOR ADOPTION OF RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA SETTING FINES FOR CITATIONS FOR VIOLATIONS OF THE INDIAN RIVER COUNTY ANIMAL CONTROL ORDINANCE; PROVIDING FOR CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCORPORATION IN CODE; AND PROVIDING FOR EFFECTIVE DATE. BE IT ORDAINED by the Board of County Commissioners of Indian River County that Chapter 3 of the Indian River County Code of Laws and Ordinances is hereby amended as follows: SECTION 1. Section 3-2 (Definitions), Code of Laws and Ordinances of Indian River County, is hereby amended to add the following definitions: €nc-Iosu-r-e- Enel_asure shall mean a_ fence or structure at 'least six feet in height _forming or causing enclosure_suitable_to prevent the injury _of young children, and suitable to confine a vicious dog_ in conjunction with other measures which may be_ taken bY_the_owner or keeper_ suchas tethering of the vicious dog __ Such _enclosure _shall be securely enclosed and locked and designed_ with _secure sides, top and bottom _and _shall _be_designed to _prevent the animal from escaping_ the enclosure. Additional ownership responsibilities. Responsibilities -of -the public_ (4) Keep any vicious animal,- following a -formal determination of that status -in accordance -with Sections 3_9 and--3-10,--confined within—a--building - or other secure enclosure, or securely leashed and -muzzled -or -caged -whenever not -so -confined; -or -to forfeit -any -such -animal -or remove same from county -as required by the- IndA ian River Animal Control Divis.ion. ----------- 0 (5) It shall be a violation -of this aniperson to impound -or confine -any -animal -in -any place wi-thout cuff i-cient taod and water da i ly_-_except- under veterinary -supervision_ -to keep any animal in -any enclosure without providing --sufficient exercise and ---adequate ventilation; to fail to provide shelter from the -weather, clean quarters, and medical attention for sickly, diseased, or injured animals; or to -fail -to inoculate - the -animal against -rabies as required -by this chapter_- However, this chapter -shall -not require the provision of -shelter -from the weather and clean quarters for livestock -in -open -pasture. If the officer is satisfied -after--such investigation that the dog is vicious as defined in this chapter, he shall declare the doa- as-a-ci vious dog and pPrope -r1y—r taf_y-flip-owner-of_the___do�__ in—ting of such declaration. If a determination -has been -made that -a-dot -II s vicious, the owner shall comply with -the provision -of-this section within thirty (30) -days -of such determination. -If the owner of the dog contests the determination made -by the officer, he -or she -may, _within --five _(5) -days of -such determination_ appeal -the declaration of viciousness -to -the Director of Department _of -Emergency_ Services- by -way --of written notice. The Director shall 'decide the issue based upon- the -preponderance- of -the evidence._if_ the�irector- determines that the dog is vicious, the Director may establish a time schedule to ensure compliance with -,this chapter -in -no case more than -fifteen (15) days -subsequent -to the-Directorl-s-fete-rm+nat-i-Gn-. -A1-1-1:hemie-te-minations of the Director should be in writin9_, signed -and- dated - by the Director, and should contain the finding of factssupporting the determination. (c) No vicious doh shall-_ be licensed within Indian River County unless the owner and keeper_ of _such vicious dog shall meet the following requirements: 1._ The owner or keeper shall present to the Indian River County Animal _Control Division proof that the owner has procured liability_insurance_in the amount of -at least one hundred thousand_ dollars ($100,000.00), -covering any damage_or_injury which may be-caused_by_s-- vicious --cod Burin the 12 -month period for------ which licensing is sought_ ---�------------- 2. The owner or keeper shall_ at his _own expense_-have__the__registration__number_-assigned to such vicious dog by _the Anima----- l- D-1v-i-si_on-ta-ttooed_ on such vicious doq_ by a veterinarian _or other person trained as _a tattooist. The tattoo shall -be placed on—the—inside right thigh -of -the -vicious dog_ 3. The owner or keeper shall -also, -at his own_expense,_purchase-a collar or harness-from_the_Animal Control Division which _shall be worn—by-the--dog at all times. -The —purpose—of--the collar or harness shall_ be to provide immediate identification to--the--Animal--Control Division and the public------- at large_that_the dog-hasbbeen declared vicious. 4. The owner or keeper-_ shall-_ sign -a Statement attesting-tha-t a. The owner or keeper_ shall _maintain and not voluntarily cancel_ the _liability insurance_ required _—_ b this section during__the_ 12_month__period__ for which licensing is sought_ unless the owner or keeper_shall_cease to own or keep the_ vicious�do�_prior_to the_expiration -of such license. b. The Division or any officer is hereby empowered -to make -whatever --inquiry -is-deemed necessary to ensure -compliance with the -provisions -of this section_ and the Division or any officer -is hereby -empowered -to -seize -and impound- any - vicious dog whose- owner or keeper fails to comply- with - the -provisions- hereof.- In the event that the owner or -keeper of -the -dog -refuses -to surrender -the animal to the Division or officer, a search warrant may beobtained from the circuit court and the dog ma upon execution of the warrant. (d) The provisions of this section shall not apply to canine dogs owned _hy—_law _enforcement _department while such dogs are engaged in the scope of law enforcement duties. SECTION 4. Section 3-10 (Unlawful for livestock to run at large), Code of Laws and Ordinances of Indian River County, is hereby amended as follows: ION 3-1.0--JnLawful for I ivestock to run at large; -harboring wild animals_ It shall be unlawful for any livestock to run at large within Indian River County, Florida. It shall _be unlawfulto keep any_ wild animal in _violation of the _- provisions of_ Chapter_ 372,_ Florida Statutes_ and -regulations promulgated__by—the _Florida Game__and__Fresh Water Fish Commission. SECTION -5. Section 3-16 �Co3e of—taws and—Ordirranc-es of Indian River County, is hereby amended as follows: (a) Any violation of this chapter, constitutes a civil infraction and may be punishable by a civil penalty not�--to---exc-eed fi-ve hurid r_ed_d_o_ ars L$500.00).
