ORDINANCE __9.1 -12
AN ORDINANCE OF INDIAN RIVER COUNTY,
FLORIDA ESTABLISHING CHAPTER 401 -
BUILDING CODES OF TITLE IV, PROVIDING
REPEAL; PROVIDING. SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the Board of County
Commissioners of Indian River County, that:
SECTION 1.
BUILDING CODES.
Chapter 40] - Building Cokes oTrtf�V as set
forth in,Attachment A to this ordinance is hereby adopted.
SECTION 2.
REPEAL.

(1974 edition) superseded or in conflict with the provisions
herein adopted, in particular Chapter 4, are hereby
repealed.
SECTION 3.
SEVERABILITY.
If any section, or if any sentence, paragraph,
phrase, or word of this ordinance is for any reason held to
be unconstitutional, inoperative, or void, such holding
shall not affect the remaining portions of this ordinance,
and it shall be construed to have been the legislative
intent to pass the ordinance without such unconstitutional,
invalid or inoperative part.
EFFECTIVE DATE.
This ord.inance shall become effective upon
becoming law.
Approved and adopted by the Board of County
Commissioners of Indian River County, Florida, on this 26
day of March 1991.

Section 401.01 Standard technical codes
Indian River County hereby adopts and incorporates the following
standards technical codes as part of the Code of Indian River
County, except to the extent that specific additions, deletions, or
amendments are set forth in this title, or the zoning ordinances,
provided, however, should the State of' Florida enact standards
which adopt later editions than herein specified, the editions set
forth in the Florida Statutes shall apply.
Standard Building Code (SBC), 1988 Edition with 1989/90
revisions.

Standard Plumbing Code (SPB), 1988 Edition with 1989/90

Standard Mechanical Code (SMC), 1988 Edition with 1989/90
revisions.

Standard Housing Code (SHC), 1988 Edition with 1989 revisions.

National Electrical Code (NEC), 1990 Edition.
Section 401.02 Florida Thermal Efficiency Code
Compliance with the "Florida Thermal Efficiency Code," Chapter 553,
Florida Statutes, and all requirements promulgated under this code,
but -not limited to-, the c=r-ent "Florida Model Energy Efficiency
Code for Building Construction" is required.
Section 401.03— The -minimum standards for mobile -homes
The minimum standards for mobile homes, house trailers, or modular
homes shall be as specified in the Florida Administrative Codes.
Secti-on-401.04 Fire prevention codes and standards
Indian River County and the respective fire districts in Indian
River County adopt the following codes for the purpose of
prescribing rules and regulations governing conditions that could
cause a potential hazard to life and property:
(1) The National Fire Protection Association, (NFPA) 1, 1987
edition and its supplement codes
(2) The State Fire Marshal's Rules and Regulations (also
known as Florida Fire Prevention Code).
(3) The National Fire Protection Association (NFPA) 101 Life
Safety Code, 1985 Edition.
Section 401.05
- Construction and application of the technical
codes
In order to better protect -and preserve the public health, welfare,
and safety, whenever any provisions contained in the technical
codes adopted by this chapter is in conflict or inconsistent with

an application provision contained in the fire prevention code then
in force in the County dealing with or pertaining to the same
subject, then and in that 'event the mote stringent provision shall
apply and govern to the exclusion of the less stringent provision.
Section 401.06
Violation of technical codes
The violation of any applicable provision of a technical code
adopted by this chapter is a violation of the Code of Ordinances of
Indian River County and any violator is subject to the penalties as
prescribed in this Code.

'PART II AMENDMENTS TO SBC
Section 401.10 Building Code Board of Adjustment and Appeals
1.�Membershlp
The membership provisions of the SBC are amended to read as
follows:
The membership of the board shall consist of at least one
architect, one engineer, one general contractor, and four (4)
members with experience in the building industry. One member
of the board shall be a representative of the board of zoning
adjustments. ,
Section 401.11 Fire Districts
Chapter III, Fire Districts of the SBC is hereby repealed.
Section 401.12 Standpipes
Section 902 of the SBC is amended to read as follows:
(1) Section 902 shallapp y only tobuildings -to— be
constructed with a height of three (3) or more stories.
(2) All requirements of section 902, except to the extent
modified by paragraph (a) of this section, shall apply.
Section 401.13 Hurricane requirements
Appendix D, Hurricane requirements of the SBC are hereby declar
to be mandatory.
Section 401.14 Agricultural exemption
Nothing contained in this article shall be construed to apply
to or affect buildings, structures or appurtenances located
outside the corporate limits of municipalities and used solely
for housing of storing agricultural animals, supplies,
equipment or products by person, firm, or corporations engaged
in agriculture. The exemption shall be construed consistent
with applicable state exemptions.

Section 401.20
AMENDMENTS TO.NATIONAL ELECTRICAL CODE
Construction and application of the National
Electrical code
(1) The provision of this code shall apply to any electrical
construction, installation, alteration, repair, electrical
equipment, or material connected to or installed in any
building, structure or appurtenance subject to this article as
well as maintenance thereof.
12) All plans shall have the stamp of approval of the electrical
inspector before a construction permit is issued.
(3) If an existing wiring system whichdoe�orm tie
present code is remodeled or added to and such changes cover
more than 50 per cent of the nonconforming existing system,
then the entire system shall be reconstructed to conform to
this code.
(4) A circuit of an existing system which does not conform to this
code shall not be extended or added to until the entire
circuit shall have been reconstructed to conform to this code.
Section 401.21 Electrical maintenance
All electrical systems, wiring, materials, devices, and apparatus
as now existing, or as hereater—installed, shall be maintained in
a safe condition. The owner shall be responsible for such
maintenance.
Section 401.22 Service entrance standards
(1) Service masts shall be run in galvanized rigid conduit and
shall be a minimum 2 inch trade size.
(2) All conduit exposed to the elements shall be galvanized rigid
conduit or schedule 80 PVCL.Service entrance conductors shall
be installed in conduit.
31 )1Meter rooms shall be provided in all buildings of multiple
occupancy ( 4 or more occupancies) and shall have the following
inside minimum dimensions: 4_ to 8 meters - 4 feet by 6 feet by
7 feet. If the electrical requirements or demand is larger,
the meter room shall. be increased accordingly. This meter
room may be reduced in depth providing doors are installed the
same width as the requirement. All meter rooms shall be
equipped with ventilated door(s). The meter room shall be
accessible to the power company and to all occupants of the
building at all times. The meter room shall be provided with
adequate ventilation. The purpose of the meter room shall be

to, house electrical equipment, telephone equipment, and
television equipment which serve the occupants of the entire
building. There shallbe —no storage of any kind permitted in
this room,
(4) Service disconnecting switches must be located in a convenient
and readily accessible location inside the building when a
meter room is not required. Service disconnecting switches
and other related equipment located in enclosed or semi -
enclosed porches not exposed to the weather, shall be
considered as being located inside the building;Exceptions
may be allowed by the electrical inspector on existing
installations if strict compliance is deemed by him
impractical.
(5) A service disconnect shall be located at the nearest point of
service entry (conduit not to exceed 20 feet inside building)
and shall not be installed in bathrooms, bedrooms, clothes
closets, or kitchens cabinets.
6) All service equipment of 225 amps or less shall be equipped
with a single main disconnect.
(T) The grounding electrode conductors shall be a minimum wire
size #4 cooper. There shall be a jumper between the hot and
cold water pipes above the water heater and before the shutoff
valves. The following sharr-also be required:
a) All water pipe connections shall be visible.
(b) Teardrop or acorn type clamps shall be used at the ground
--0d.
(c)All clamps shall be of compatible materials (ex. brass or
copper).
y The ground rod shall be of copper or copper -clad. Note:
Galvanized rods may be used on construction temporary
service,
Section 401.23 Commercial construction
The sub -feed to each unit space must provide at least 3 wire,
single-phase current, or 4 -wire, 3-phase of 100 ampere capacity.
The conduit shall be a minimum 1 1/2 -inch trade size.
Section 401.24 General requirements
All interior and/or exterior wiring for heat, light, and power
in all commercial buildings, schools, churches, theatres,
warehouses, and similar locations shall utilize'an approved
raceway system. In multifamily residential projects, a

nQiaetallic-sheathed cable will be allowed with the exception
that all conductors which penetrate outside the envelope of
the individual unit shall be installed in an approved raceway.
(2-) All electrical ranges and double ovens have a minimum 50 -
ampere circuit and all cooktops and single ovens a minimum 40 -
ampere circuit.
(3) All electric water heaters shall be wired with a minimum #10
copper wire.
(4 ) There shall be nor more than 2 receptacles per circuit at
kitchen counters and no more than 5 per circuit in dining and
breakfast rooms. All refrigeration equipment and garbage
disposals shall be on a separate circuit.
(5) All air conditioning compressors and air handler units shall
have a disconnect within 6 feet.
(6) When an air handler is located in an attic there shall be a
light within 10 feet of the equipment and a toggle switch at
or below the scuttle hole.

a raceway -west of the Indian River.
(8) All motors of 1/3 horsepower and larger shall be wired on a
separate circuit. Exceptions—Residential garage door openers
may be wired to a lighting or power circuit.
(9) Any fixture located less than 7 1/2 feet above the maximum
water level of a shower or tub shall be protected by a ground
fault circuit interrupter.
(10 ) Swimming pools. The common bonding grid shall be a continuous
solid copper conductor insulated, covered or bare, not smaller
than No. B.
' Section 401.25 Signs using electrical current
Signs using or designed to use electrical current shall com ly with
the SBC, NEC, and the sign ordinance.
