ORDINANCE 91- 45
--AN ORDINANCE OF I-NDIAN RIVER COUNTY,
FLORIDA, ESTABLISHING A GENERAL LIEN
PROVISION WHEN COUNTY. FUNDS -ARE
EXPENDED TO BRING ABOUT CONFORMITY WITH
THE INDIAN RIVER COUNTY CODE.
WHEREAS, from time to time the County takes remedial
action to assure compliance with the Code; and
WHEREAS, said action often results in the expenditure of
public funds; and
WHEREAS, logic and orderly. administration dictate that in
many situations the County . should be reimbursed for such'
expenditures; and
WHEREAS, a lien provision w assist
any reimbursemen ,•

SECTION 1. AMENDMENT.

this Code, whenever the County takes action under a provision
of this Code that results in the County expending funds to
accomplish -the specific act required or, co rmity with the
Code, the Board of County Commissioners may cause, by
Resolution, alien to be fileU n the OfficialRecord-Booksof- the
County against the owner of the property.or person responsible
or compliance with the Code for -the -costs -incurred -by
County. Notice of intent to adopt a -lien resolution shall .be
given to the -proposed- ienee Said -lienee -.may -appear -.before the
Commission and be heard on the proposed lien resolution.
b). The lien and notice provisions of Chapter 162, Florida
Statuteshall-pertain with -consequential changes -unless other .
notice has already been provided.
SECTION 2. SEVERABILITY.

This ordinance was advertised in the Vero Beach Press -
Journal on the 3 day, of October 1991, for a public hearing to
be held on the 22 day of October 1991, at which time it was
moved for adoption by Commissioner Bowman and the motion
was seconded by Commissioner Eggert and, adopted by the
following. vote:
