AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY,
FLORIDA, AMENDING THE INDIAN RIVER CODE
OF ORDINANCES, SECTIONS 101.03, COUNT
OFFICERS; 101.07, THE EXECUTIVE AIDE TO THE
COMMISSION; SECTION 101.08, BOARD OF
COUNTY COMMISSIONERS EMPLOYEE
RELATIONS; ELIMINATING THE POSITION OF
EXECUTIVE AIDE TO THE COMMISSION;
PROVIDING FOR CODIFICATION; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Indian Diver County Code Chapter 101 provides for the organization
of County govennrriertt; and
WHEREAS, Section 101.07 establishes a position for an Executive Aide to the
Commission; and
WHEREAS, the Board has decided that the Commissioners would be better
served by having an assistant assigned to each district in order to conduct the day to
day business of the Commissioners; and
WHEREAS, with the establishment of the position of the Commission Assistant,
there no longer is a need for the Board to ernploy an Executive Aide to the Commission
as the Commissioner Assistants will assume those duties; and
WHEREAS, as the Executive Aide to the Commission position has been
eliminated, Chapter 101 must be amended to reflect trte changes,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERSCOMMISSiONERS OF INDIAN RIVER COUNTY, FLORIDA, that;
SECTION 1. AMENDMENT.
sections 101.03, 101.07 and 101.08 of the Indian River County Code of
Ordinances are amended to read as follows;

Section 101.08. Board -employee relations.
Except as provided in Section 101.03 and with regard tosupervision of their
commissioner assistant in accordance with r)ersonnel rules of the County, neither the
board nor any of its members shall in any manner dictate the appointment or removal of
any county employee nor shall the board or any of its members give orders or directions
to any county employee. The board or its members shall proceed on all matters through
the appropriate county officer. Nothing in this section shall preclude a board member
from communicating with a county employee for the purpose of inquiry or information.
SECTION 2. CODIFICATION.
It is the intention of the Board of Counter Commissioners that the provisions of
this ordinance shall become and be mane a part of the Indian River County Code and
the word "ordinance" may be changed to "section," "arficle," or other appropriate word or
phrase and the sections of this Ordinance may be renumbered or relettered to
accomplish such intention; providing, however, that Sections 2, 3 and 4 shall not be
codified.
SECTION 3. SEVERABILITY.
If any section, or any sentence, paragraph, phrase, or word of this ordinance is
for any reason held to be unconstitutional, inoperative, or void, such holding shall not
affect the remaining portions of this ordinance, and it shall be construed to have been
the legislative intent to pass the ordinance without such unconstitutional, invalid or
inoperative part.

SECTION 4. EFFECTIVE DATE
This ordinance shall take effect upon fling with the Florida Secretary of State.
This ordinance was advertised in the Press Journal on the 2nd day of June 2007, for a
public hearing an the 19th day of June 2007, at which time it was moved for adoption by
Commissioner Bowden, and seconded by Commissioner Davis, and adopted by the
following vote.
