AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA
EXTENDING THE DEADLINE BY THREE YEARS FOR
PLANNED DEVELOPMENTS TO COMMENCE CONSTRUCTION
OR HAVE THEIR ZONING REVERT TO THE SITE'S ORIGINAL
(PRE -PLANNED DEVELOPMENT APPROVAL) ZONING; AND
PROVIDING FOR EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of Indian River County
has approved four (4) Planned Development projects and included within those
approvals is a requirement that the Planned Development zoning approval
sunset if project construction did not commence by a certain date; and
WHEREAS, due to current economic conditions the Board finds that it is
reasonable to extend those deadlines for an additional three years;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that the zoning
reverter deadlines for construction commencement of the following planned
developments be extended for three years:
Liberty Park PD to October 14, 2018 [revises Ordinance No. 2008-017]
Mandala Club PD to May 17, 2011 [revises Ordinance No. 2005-016]
Turtle Creek Preserve PD to April 4, 2014 [revises Ordinance No. 2006-0091
Sunnyside Up PD to January 20, 2022 [revises Ordinance No. 2009-0011
EFFECTIVE DATE.
This ordinance shall take effect upon filing with the Florida Department of
State.
This ordinance was advertised in the Vero Beach Press -Journal on the
26thday of October, , 2009, for a public hearing to be held on the 10th day
of November, 2009,.at which time it was moved for adoption by Commissioner
F1 escher , seconded by Commissioner 0'l3r-y9;�—' and adopted
by the following vote:
Wesley S. Davis, Chairman AYE
Joseph E. Flescher, Vice Chairman AYE
Commissioner Gary C. Wheeler AYE
ORDINANCE NO. 2009- 020
Commissioner Peter D. O'Bryan AYE
Commissioner Bob Solari AYE
The Chairman thereupon declared the ordinance duly passed and
adopted this 10th day of November, 2009.
