HomeMy WebLinkAbout2011-010ORDINANCE NO. 2011 -4j.0 - AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA FURTHER EXTENDING THE DEADLINE BY SEVEN (7) YEARS FOR PLANNED DEVELOPMENTS TO COMMENCE CONSTRUCTION OR HAVE THEIR ZONING REVERT TO THE SITE'S ORIGINAL (PRE -PLANNED DEVELOPMENT APPROVAL) ZONING; AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Indian River County had approved four (4) Planned Development projects and included within those approvals is a requirement that the Planned Development zoning approval sunset if project construction did not commence by a certain date; and WHEREAS, one of the four projects is no longer viable due to foreclosure, therefore only three of the four approved projects are the subject of this ordinance; and WHEREAS, due to current economic conditions the Board finds that it is reasonable to further extend those deadlines for an additional seven (7) years; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that the zoning reverter deadlines for construction commencement of the following planned developments be further extended for seven (7) years: Liberty Park PD to October 14, 2025 [revises Ordinance Nos. 2008-017 and 2009-020] Turtle Creek Preserve PD to April 4, 2021 [revises Ordinance Nos. 2006-009 and 2009-020] Sunnyside Up PD to January 20, 2029 [revises Ordinance Nos. 2009-001 and 2009-020] EFFECTIVE DATE. This ordinance shall take effect upon filing with the Florida Department of State. This ordinance was advertised in the Vero Beach Press -Journal on the 28th day of November, 2011, for a public hearing to be held on the 13th day of December, 2011, at which time it was moved for adoption by Commissioner Sn1 Ari , seconded by Commissioner Flescher and adopted by the following vote: ORDINANCE NO. 2011-_o i o Chairman Gary C.
