HomeMy WebLinkAbout2010-018ORDINANCE NO. 2010- 018 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR f 2.17 ACRES LOCATED AT THE NORTHWEST QUADRANT OF S.R. 60 AND 74" AVENUE, FROM PRO, PROFESSIONAL OFFICE DISTRICT, TO CN, NEIGHBHORHOOD COMMERCIAL DISTRICT; AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; and WHEREAS, the Board of County Commissioners determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, to -wit: A portion of Tract 8, in Section 1, Township 33 South, Range 38 East, Indian River Farms Company subdivision, as recorded in Plat Book 2, Page 25, of the public records of St. Lucie County, Florida, said land now lying and being in Indian River County, Florida, and being more particularly described as follows: Commence at the Southeast corner of the Northeast 1/4 of said section 1; thence N 00'27'18"E. along the East line of said section 1 a distance of 162.73 feet; thence N 89°40'39"W. Along the North right-of-way line of State Road 60 (232 foot wide right of way) a distance of 80.00 feet to an intersection with the West right-of-way line of 74th Avenue (80.00 foot wide right-of-way) and the point of beginning of the herein described parcel; thence continue N 89°40'39"W. Along the said North right-of-way line of State Road 60 a distance of 361.50 feet; thence N 00'27'17"E, a distance of 261.49 feet; thence S 89°40'40"E. A distance of 361.50 feet to the said West right-of-way line of 74th Avenue; thence S00°27' 18"W along said West right-of-way line a distance of 261.49 feet to the point of beginning. Contains 2.17 acres more or less. Page 1 of 3 ORDINANCE NO. 2010- 018 Subject to easements, restrictions, reservations and rights of way of record, if any is changed from PRO, Professional Office District, to CN, Neighborhood Commercial District. All with the meaning and intent as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 5th day of -Oct , 2010. This ordinance was advertised in the Press -Journal on the 26 day of —August 2010, for a public hearing to be held on the 7th day of September—, 2010. That public hearing was tabled to the 5�" day of October 2010, at which time it was moved for adoption by Commissioner Solari _,seconded by Commissioner F1 escher , and adopted by the following vote: Peter D.
