HomeMy WebLinkAbout2010-019ORDINANCE NO. 2010- 019 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, REPEALING CODE SECTION 105.041.1; LOCAL PREFERENCE IN PURCHASING OR CONTRACTING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, on July 14, 2009 the Board enacted an ordinance providing for local preference in purchasing or contracting; and WHEREAS, included in the ordinance was a provision for the Board to review and possibly sunset the ordinance one year after the effective date of the ordinance; and WHEREAS, the Board conducted the review of the ordinance at its meeting of September 7, 2010; and WHEREAS, the Board desires to sunset and repeal Indian River Code Section 105.041.1, Local Preference in Purchasing or Contracting; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: SECTION 1. AMENDMENT. ORDINANCE NO. 2010- 019 - - - - • - _ - _ _ - � - Errs - all PART II: GENERAL PROVISIONS SECTION 2. CONFLICTS The application of any Indian River County ordinance in conflict herewith is hereby suspended during the time period set forth in Section 1 to the extent of such conflict. SECTION 3. SEVERABILITY. If any section, or any sentence, paragraph, phrase, or word of this ordinance is for any reason held to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance, and it shall be construed to have been the legislative intent to pass the ordinance without such unconstitutional, invalid or inoperative part. SECTION 4. ORDINANCE NO. 2010- 019 This ordinance was advertised in the Press Journal on the 18thday of September, 2010, for a public hearing on the 5th day of October, 2010, at which time it was moved for adoption by Commissioner Sol ari , and seconded by Commissioner Wheel er , and adopted by the following vote: Chairman Peter D.
