AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING
ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR ± 0.886 ACRES
LOCATED AT THE SOUTHWEST QUADRANT OF U.S. HIGHWAY 1 AND 8TE1
STREET, FROM CH, HEAVY COMMERCIAL DISTRICT, TO CG, GENERAL
COMMERCIAL DISTRICT; AND PROVIDING CODIFICATION, SEVERABILITY, AND
EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency
on such matters, held a public hearing and subsequently made a recommendation regarding this
rezoning request; and
WHEREAS, the Board of County Commissioners of Indian River County, Florida, did
publish and send its Notice of Intent to rezone the hereinafter described property; and
WHEREAS, the Board of County Commissioners held a public hearing pursuant to this
rezoning request, at which parties in interest and citizens were heard; and
WHEREAS, the Board of County Commissioners determined that this rezoning is in
conformance with the Comprehensive Plan of Indian River County.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of
Indian River County, Florida, that the zoning of the following described property situated in
Indian River County, Florida, to -wit:
Commence at the Northwest corner of the Northwest 1/4 of the Northeast 1/4 of Section 13,
Township 33 South, Range 39 East, run South a distance of 10.00 feet to the South right of way
line of State Road 612, also known as Glendale Road and 8th Street; S.89°18'26"E., along said
South right of way line a distance of 248.65 feet to the intersection with the East right of way
line of the Florida East Coast Railway and the Point of Beginning; thence continue
S.89°18'26"E., a distance of 139.17 feet to the intersection of the West right of way of State
Road No. 5, also known as U.S. Highway No. 1, to the point on a curve concave to the Northeast
having as its elements, a radius of 4961.15 feet, a central angle of 03°49'04", and a chord bearing
and distance of S.25°47'54"E., 330.53 feet; thence run Southeasterly along the arc of said curve a
distance of 330.59 feet; thence leaving said West right of way line, N.89°25'25"W., along the
North line of property described in Official Records Book 469, Page 561, of the Public Records
of Indian River County, Florida, a distance of 125.37 feet, to the East right of way line of the
Florida East Coast Railway; thence N.27°59'32"W., along said East right of way line a distance

of 139.98 feet; thence continue along said East right of way line a distance of N.27°47'03 "W., a
distance of 197.15 feet to the Point of Beginning. Said Parcel contains 0.886 acres more or less.
is changed from CH, Heavy Commercial District, to CG, General Commercial District.
All with the meaning and intent as set forth and described in said Land Development
Regulations.
This ordinance shall become effective upon filing with the Department of State.
Approved and adopted by the Board of County Commissioners of Indian River County,
Florida, on this 23rd day of March, 2010.
This ordinance was advertised in the Press -Journal on the 8 day of March 2010, for a
public hearing to be held on the 23rd day of March, 2010 at which time it was moved for
adoption by Commissioner Wheel er , seconded by Commissioner F1 escher , and
adopted by the following vote:
