AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING
ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR:
A. APPROXIMATELY ± 6.4 ACRES LOCATED AT 4650 85T" STREET,
SEBASTIAN FROM RM -6, MULTI -FAMILY RESIDENTIAL
DISTRICT (UP TO 6 UNITS/ACRE), TO CG, GENERAL
COMMERCIAL DISTRICT; AND
B. APPROXIMATELY ±6.4 ACRES LOCATED AT 4310 77T" STREET,
VERO BEACH FROM IL, LIGHT INDUSTRIAL DISTRICT, TO RM -6,
MULTI -FAMILY RESIDENTIAL DISTRICT (UP TO 6 UNITS/ACRE).
AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency
on such matters, has held a public hearing and subsequently made a recommendation regarding
this rezoning request; and
WHEREAS, the Board of County Commissioners of Indian River County, Florida, did
publish its Notice of Intent to rezone the hereinafter described property; and
WHEREAS, the Board of County Commissioners determined that this rezoning is in
conformance with the Comprehensive Plan of Indian River County; and
WHEREAS, the Board of County Commissioners held a public hearing pursuant to this
rezoning request, at which parties in interest and citizens were heard;
NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian
River County, Florida, that:
The zoning of the following described property situated in Indian River County, Florida, to wit:
Parcel A:
A parcel of land lying in Section 28, Township 31 South, Range 39
East, Indian River County, Florida, said parcel also being a portion
of Naranja tract Shellmound beach according to the plat thereof as
recorded in plat book 5, page 23 of the public records of St. Lucie
(now Indian River) County Florida and also a portion of Weona
Park, according to the plat thereof, as recorded in plat book 2, page

17, of the public records of Indian River County, Florida, said
parcel being more particularly described as follows:
Commence at the northwest corner of government lot 6, said section
28; thence S00°20'26"E, a distance of 25.82 feet to the point of
beginning and a point on the south right of way line of Bridge
Boulevard; thence N75°21'55"E, along said right of way line a
distance of 534.86 feet; thence S33°35'20"E, a distance of 136.73 feet
to a point on the northerly right of way line of State Road AlA and
a point on a line that is 40.00 feet northerly of, as measured at right
angles to, the centerline of said State Road 510 said point also being
the point of curvature of a curve, concave to the southeast, having a
radius of 2904.79 feet, a central angle of 10049'18", and a chord of
547.82 feet bearing S50°34'18"W; thence southwest along the ARC
of said curve, a distance of 548.63 feet; thence S45009'39"W, a
distance of 314.19 feet to a point on the centerline of 86th Street;
thence N89°52'02"W, along said centerline, a distance of 353.92 feet
to a point on the east right of way line of 47th Street; thence
N00021'55"W along said right of way line of 47th Street and the west
line of block 8 of said plat of Weona Park, a distance of 269.58 feet,
to the northwest corner of said block 8; thence S89054'14"E, along
the north line of said block 8, a distance of 410.08 feet to a point on
the common line between said plats of Naranja tract Shellmound
beach and Weona Park; thence N00020'25"W, along said line, a
distance of 278.53 feet to the point of beginning.
Said parcel containing 6.407 acres, more or less.
Is changed from RM -6, Multi -Family Residential District (up to 6 units/acre), to CG,
General Commercial District.
All with the meaning and intent as set forth and described in Indian River County's Land
Development Regulations.
AND
Parcel B:
A portion of the southeast quarter of the southeast quarter of
Section 33, Township 31 South, Range 39 east lying west of Florida
East Coast Railway right-of-way, being more particularly described
as follows:
Commencing at the southwest corner of the southeast '/4 of the
southeast 1/4 of said Section 33; thence N00°29'56"E along the west
line of said southeast'/4 of the southeast'/4 of Section 33 a distance of
240.01 feet to the north line of Hobart Estates as recorded in plat
book 8, page 20 of the public records of Indian River County,

Florida; thence S8905712611E along said north line of Hobart Estates
a distance of 180.01 feet to the point of beginning of the herein
described parcel; thence N00029'56"E along a line that is parallel
with and 180.00 feet east of the said west line of the southeast '/4 of
the southeast I/4 of Section 33 by perpendicular measurement for a
distance of 1090.22 feet to the north line of said southeast '/4 of the
southeast 1/4 of Section 33; thence N89°57'06"E along said north line
of southeast 1/4 of the southeast '/4 of Section 33 a distance of 328.96
feet to the westerly right of way line of the Florida East Coast
Railway; thence S25°54'29"E along said westerly right of way line a
distance of 458.27 feet; thence S63°59'19"W a distance of 513.49
feet; thence S00°29'56" a distance of 453.12 feet to the said north
line of Hobart Estates; thence N89°57'26"W along said north line a
distance of 73.26 feet to the point of beginning. Containing 6.4047
acres more or less.
Subject to easements, restrictions, reservations and rights of way of
record, if any.
All lying and being in Indian River County, Florida.
Is changed from 1L, Light Industrial District, to RM -6, Multi -Family Residential District
(up to 6 units/acre).
All with the meaning and intent as set forth and described in Indian River County's Land
Development Regulations.
Effective Date: This ordinance shall become effective upon the issuance by the State Department
of Community Affairs of a Notice of Intent to find the related Comprehensive Plan Land Use
Designation Amendment contained in Ordinance Number 2010-OOt,' in compliance with s.
163.3184(9) or the issuance of a final order by the Administration Commission finding the
referenced amendment in compliance with s. 163.3184(10).
Approved and adopted by the Board of County Commissioners of Indian River County, Florida,
on this 23rd day of March, 2010.
This ordinance was advertised in the Press -Journal on the 8th day of March , 2010, for a public
hearing to be held on the 23rd day of March, 2010, at which time it was moved for adoption by
Commissioner Davis , seconded by Commissioner Sol ari , and adopted
by the following vote:
