EIEREAS, the Board of County CommissLoners of Indian River County adopted Resolution No. 99-Lg, providing for certain paving and drainage inprovenents to Lg'h Avenue between l"t Place and 2nd Street; and IfllEREAg, said resolution described the manner in which the special assessnents are to be rnade and how the special assessments are to be paid; and lfHERBAg, the resolution was published as required by Section 206.06, Indian River County codei and HIIEREAS, the Board of County Conrnissioners of Indian River CouFjy passed Resolution No. 99-19, on March 2, 1-999, which set a time and place for a public hearing at which the owners of the properties to be assessed and other interested persons would have the chance to be heard as to any and all complaints as to said project and said special assessnents, and for the Boatd to act as required by Section 206.07, Indian River County Code; and _lftlEREAa, notice of the time and place of the public hearihg was published in the Vero Beach press Journal Nertspaper on March L6,L999, and March 23, ]-ggg, (twice one week apart,, and the last being at least one week prior to the hearing), as required by Section 206.06, Indian River county Code; and IYHEREA8, the land otJners of record were mailed notices at least ten days prior to the hearing, as required by Section 206.06, Indian River County Codei and I|IIEREAS, the Board of County Comrnissioners of Indian River Coriirty on Tuesday, April 6. 1999 9:05 A.M. conducted the public hearing with regard to the special assessments, l\tl\)(, C3 (tr oo atrrt-o (, 3= o (3E C^)(Jl (4)-0 Ot -_J n Z ?L.-elYDt -vat Plepaed by ed lhoutd be seturnGd to the county Engln€e!.s office, 1B{O 25th stleot, voso(> 86rch, FL 32960 t:. 3. 4. L RESOLUTION NO. 99- 33 NOf, THEREFORET BE IT REAOITVED By THE BOARD OF COUNTY COtltlIggIONERg OF INDIAII RMR COUNTy, FITORIDA, as follor'ts! 1. The foregoing recitals are affirmed and ratified in their entirety. 2. The Board finds that the properties assessed by this resolution r.till receive special benefits equal to or greater than the cost of the assessrnent. The special assessrnents shown on the attached assessnent roll are hereby confirmed and approved, and shall rernain legal, valid, and binding first liens against the properties assessed until paid in fuII. The County will record the special assessments and this resolution, which descri,bes the properties assessed and the amounts of the special assessments, on the public records, which shall constitute prirna facie evidence of the validity of the special assessrnents. The resolution was moved for adoption by commissioner Gi !l , and the motion was seconded by Comrnissioner stanbridqhd, upon being put to a vote, the vote was as follovts: Chairrnan Kenneth R.
