HomeMy WebLinkAbout2000-100RESOLUTION NO. 2000-100 A RESOLUTION OF T}IE BOARD OF COT.JNTYCOMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDAESTABLISHING ITS INTENT TO REIMBURSE CERTAIN PROJECT COSTS INCURRED WITH PROCEEDS OF FUTI.JRETAX-E)GMPT FINANCING; PRoVIDING CERTAIN OTTIERMATTERS IN CONMCTION THEREWTTH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Board of county Commissioners of Indian River County, Florida (the "Issu€r") has detemined ttut the need exists to acquire lands known as Dodgertown and to cause to be constructod cerlainimprovements thereon related to spring training facilities to be utilized therafter by the Los Angeles Dodgers, lnc. (..Dodgers"); NOW, TTIEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORJDA THAT: SECTION l' AUTHORITY. This Resolution (hereinafter catled the ,'Resolution,,) is adopted pursuant to the provisions of the Florida consritution, chapter 125, Florida statutes, and other applicable provisions of law. sEcTtoN 2' DECLARATIoN oF INTENT. The Issuer hereby expresses ils intention to be reimbursed fiom proceeds of a future tax-exempt financing for the acquisition of certain lands known as Dodgertown and the costs of construction, expanding and improving facilities which will constitute a spring training facility to be used by the Dodgers (the ,,project,,). pending reimbursement, the Issuer expects to use funds on deposit in its general funds or that the Dodgers witl advance certain funds to pay costs ofthe Project. It is not reasonably expected that the totat amount of debt to be incuffed by the Issuer to reimburse itsetf for expenditures paid with respect to the Project will excced $t8,000,000. This Resolution is intended to constitute a ,,declaration of official RESoLUTIoN N0. 2000_ 100 intent" within the meaning of section l . I 50-2 of the Income Tax Regulations. SECTION 3' SE\/'ERABILITY. Ifany one or more ofthe provisions of this Resotution shall for any reason be held illegal or invatid, zuch ilegality or invalidity shall not affect any other provision of this Resolution, but this Resotution shall be construed and enforced as if such iltegal or invalid provision had not been contained therein. SECTION 4' REPEALING CLAUSE. All resotutions or orders and parts thereof in conflict herewith to the extent ofsuch conflicts, are hereby superseded and repealed. SECTION 5' EFFECTIVE DATE.
