RESOLUTION NO. 2009- 179 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, CONFIRMING THE SPECIAL ASSESSMENTS IN CONNECTION WITH SEWER MAIN EXPANSION TO SHELL LANE EAST (A PORTION OF SUMMERPLACE) IN INDIAN RIVER COUNTY, FLORIDA; AND PROVIDING FOR SPECIAL ASSESSMENT LIENS TO BE MADE OF RECORD. WHEREAS, the Board of County Commissioners of Indian River County ("Board") has, by Resolution No. 2009-168, determined to make special assessments against certain properties to be specially benefited and serviced by a sewer main extension ("Assessment Project") to Shell Lane East (a portion of Summerplace) in Indian River County, Florida; and WHEREAS, Resolution No. 2009-168 described the method of assessing the cost of the Assessment Project against the specially benefited properties in the Assessment Area and how the special assessments imposed on the specially benefited properties in the Assessment Area are to be paid; and WHEREAS, Resolution No. 2009-168 was published in the Vero Beach Press Journal, as required by Section 206.04, Indian River County Code; and WHEREAS, Resolution No. 2009-169, adopted by the Board, set a time and place for a public hearing at which the owners of the specially benefited properties in the Assessment Area to be assessed for the Assessment Project and other interested persons would have the chance to be heard as to any and all complaints as to the Assessment Project and the special assessments imposed on the specially benefited properties in the Assessment Area, and for the Board to act as required by Section 206.07, Indian River County Code; and WHEREAS, notice of the time and place of the public hearing was published in the Press Journal Newspaper on November 12, 2009, and on November 19, 2009 (at least twice one week apart; the last being at least one week prior to the hearing), as required by Section 206.06, Indian River County Code; and WHEREAS, the land owners of record were mailed notices at least ten days prior to the hearing, as required by Section 206.06, Indian River County Code; and WHEREAS, the Board, on Tuesday, December 1, 2009 at 9:05 a.m. (or as soon thereafter as the public hearing was heard) conducted the public hearing with regard to the special assessments; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: RESOLUTION NO. 2009- 179 1. The foregoing recitals are affirmed and ratified in their entirety. 2. The special assessments imposed for the Assessment Project against the specially benefited properties in the Assessment Area shown on the assessment roll attached hereto as Exhibit "A" and incorporated herein by this reference are hereby confirmed and approved, and shall remain legal, valid, and binding first liens against the specially benefited properties shown on attached Exhibit "A" until paid in full. The special assessments for the Assessment Project shall constitute a lien against the specially assessed property in the Assessment Area equal in rank and dignity with the liens of all state, county, district or municipal taxes, and other non -ad valorem assessments. Except as otherwise provided by law, such special assessment lien shall be superior in dignity to all other liens, titles and claims, until paid. The special assessment lien shall be deemed perfected upon adoption by the Board of this Resolution and recordation of this Resolution in the Official Records of the County maintained by the Clerk of Indian River County. Such recordation shall constitute prima facie evidence of the validity of the special assessments imposed for the Assessment Project in the Assessment Area. 3. The Board hereby finds and determines that the special assessments imposed in accordance with this Resolution and Resolution No. 2009-168 provide an equitable method of funding the construction of the Assessment Project by fairly and reasonably allocating the cost to specially benefited property, based upon the square footage attributable to each parcel of property in the manner described in Resolution No. 2009-168. The Board hereby finds and determines that the properties assessed by this Resolution will receive special benefits equal to or greater than the cost of the special assessment. The resolution was moved for adoption by Commissioner Davi s , and the motion was seconded by Commissioner Fl escher and, upon being put to a vote, the vote was as follows: Chairman Peter D. The facilities shall provide sewage collection infrastructure to serve the ten (10) home sites on East Shell Lane, and provide stub=outs for future connections and extensions to serve other areas of the Summerplace Unit 1 subdivision and other adjacent properties. The gravity sewer main will be constructed from the east end (cul-de-sac) of East shell Lane, and run west approximately 393 1f to the east side of the intersection of East Shell lane and State Road A -1-A; then the main shall run south along the east right-of-way of State Road A=I -A approximately 1121f, where it will then turn east for 20 If, and connect to an existing Indian River County Department of Utility services Sewage Lift station, where the sewage collected will be pumped to the Indian River County Department of Utility services wastewater treatment Plant. In addition, another gravity sewer main will be constructed from a point approximately 160 if north of the east side of the intersection of East Shell lane and State Road A -1-A, and will run south for 160 if where it will connect to the proposed gravity sewer main at the east side of the intersection of East Shell lane and State Road A -I -A. The construction will provide existing utility customers that currently only are provided with water service, the ability to connect to the IRC regional wastewater collection and treatment system; and the connection of existing customers to the system will provide opportunities for existing residences to abandon existing septic systems, which shall benefit the environment and water quality enjoyed by all Indian River county residents. Scope of Services Schulke, Bittle & Stoddard, L.L.C. will provide services including surveying, engineering design, preparation of construction plans, preparation and submittal of permit applications, preparation . of contract / bid documents, construction administration and periodic construction field inspection for the construction of the new 8" Gravity Sewer Collection system within BIock A of the Summerplace Unit 1 subdivision. (see Attachment "A" for location and Attachment "B" for construction cost tabulation). The estimated construction cost of this project is $ $81,850.23. In connection with this project, the County will provide the Engineer with a copy of any pertinent Preliminary Data or Reports; all available drawings in electronic AutoCADD format; all surveys, maps and other documentation in the possession of or reasonably available to the County that are pertinent to the project. Services not included in this scope of services are listed as follows: • Excavation for field verification of actual locations of existing underground utilities and structures. It is requested that Indian River County provide the excavation as directed by Schulke, Bittle & Stoddard, L.L.C. • Any services associated with assisting Indian River County in review and evaluation of patent related disputes, issues, or claims including preparing to serve or serving as a consultant or witness for Indian River County in Iitigation, arbitration, public or private hearings, or other legal administrative proceedings involving patent related disputes, issues or claims. • Any services in connection with the project not otherwise provided for in this scope of services. In order to execute this project in the most cost effective manner with the most aggressive schedule, Schulke, Bittle & Stoddard, L.L.C. is retaining Houston, Schulke, Bittle & Stoddard, Inc. to prepare a route survey necessary for the design and construction of the project, and will retain KSM Engineering and Testing, Inc., for the geotechnical evaluation of the soils within the project.
