RATE RESOLUTION NO. 2008-001
A RESOLUTION OF THE SOLID WASTE DISPOSAL DISTRICT OF
INDIAN RIVER COUNTY, FLORIDA, AMENDING A PORTION OF
ATTACHMENT 2 OF RATE RESOLUTION NO. 95-01, AS FURTHER
AMENDED BY RATE RESOLUTION NO. 2004-001.
WHEREAS, on August 12, 2008, the Solid Waste Disposal District Board approved staff
recommendation to:
(a) modify the tipping fees for a certain category of contaminated soils; and
(b) approve a disposal protocol for such soils.
WHEREAS, Rate Resolution No. 95-01, setting forth Solid Waste Disposal District rates
and fees on Attachment 2 was approved by the Solid Waste Disposal District Board on June 20,
1995; and
WHEREAS, Rate Resolution No. 2004-001 amended certain Solid Waste Disposal District
rates and fees, as set forth on Attachment 2, was approved by the Solid Waste Disposal District
Board on January 6, 2004, following a duly -noticed public hearing [Resolutions No. 95-01 and
2004-001 are herein collectively "SWDD Rate Resolution"]; and
WHEREAS, the Code of Indian River County requires that a duly noticed public hearing be
held prior to amending the SWDD Rate Resolution; and
WHEREAS, the amendment to Attachment 2 of the SWDD Rate Resolution is specifically
set forth in Exhibit "A" attached hereto and by this reference made a part hereof.
NOW, THEREFORE, BE IT RESOLVED BY THE SOLID WASTE DISPOSAL
DISTRICT BOARD OF INDIAN RIVER COUNTY, FLORIDA, that the SWDD Rate Resolution is
hereby amended as set forth in Exhibit "A" effective immediately upon adoption of this Resolution.
This Resolution was moved for adoption by Commissioner Peter D. 0' Bryan , and the
motion was seconded by Commissioner Joseph E. Fiescher , and upon being put to a vote, the
vote was as follows:
