The Chairman called the meeting to order at 10:17 a.m. to hear Item 15.B.5. in
conjunction with Item S.C. of the Regular Board of County Commission
meeting. The Chairman adjourned the District meeting at 10:37 a.m. to return
to the Regular Board of County Commission meeting.
The Chairman called this meeting back to order at 11:29 a.m.

11:29 1. Approval of Minutes July 15, 2015 SWDD Budget Workshop

ON MOTION by Commissioner O'Bryan, SECONDED by Vice
Chairman Solari, the Board unanimously approved the Solid Waste
Disposal District Budget Workshop Minutes of July 15, 2015 and
the Solid Waste Disposal District Final Budget Hearing of
September 17, 2015.

11:29 3. Landlord's Waiver for MWI, Inc.

ON MOTION by Vice Chairman Solari, SECONDED by
Commissioner Flescher, the Board unanimously approved the
Landlord's Waiver Agreement, in favor of BANKUNITED, N.A.,
and authorized the Chairman to execute same.
11:29 4. Final Pay to Geosyntec for Work Order No. 10 for Additional Site
a.m. Redevelopment Assessment Activities at South Gifford Road Landfill
(memorandum dated October 16, 2015)

ON MOTION by Vice Chairman Solari, SECONDED by
Commissioner Flescher, the Board unanimously approved
Geosyntec's final invoice amount of $603.07.
10:17 5. Request to Draw on Waste Management's Performance Bond
a.m. (memorandum dated October 26, 2015)

(Clerk's Note: This Item was heard in conjunction with Item 5.C.
of the Regular Board of County Commission meeting, and is placed
here for continuity.)
Director of Utility Services Vincent Burke provided background
and spoke about past communications with Waste Management,
Inc. of Florida (WMIF).
County Attorney Dylan Reingold explained why he did not
recommend pulling the performance bond or drawing on it, but
instead, advocated that the Board focus on the administrative
charges. He reviewed the contract and identified some of the issues
that would be discussed with WMIF.
Vice Chairman Solari felt that the focus should be on customer
service.
MOTION WAS MADE by Vice Chairman Solari, SECONDED by
Commissioner Zorc, to deny staff's recommendation to draw on
Waste Management, Inc. of Florida's performance bond.
Discussion ensued over concerns with timely trash pickups for the
upcoming holidays; a future meeting where the County and WMIF
Representatives could discuss concerns over the implementation of
the Contract; and the availability of the information in the
contract.
Ron Kaplan, Counsel for WMIF, reported that the President and
executive team of WMIF would be available next week to meet with
County staff to resolve issues, and urged the Board to not move
forward with the performance bond.

The Chairman CALLED THE QUESTION and the Motion carried
unanimously.
