RESOLUTION NO. 2015- 140 A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA CERTIFYING "AS -BUILT" COSTS FOR CERTAIN ASPHALT MILLING IMPROVEMENTS TO 9" LANE, IN THE GLENDALE LAKES SUBDIVISION AND GLENDALE LAKES SUBDIVISION UNIT TWO, COUNTY PROJECT NO. 1436; PROVIDING FOR FORMAL COMPLETION DATE, AND DATE FOR PAYMENT WITHOUT PENALTY AND INTEREST. WHEREAS, the Board of County Commissioners of Indian River County determined that the ? improvements described herein specially benefited the property located within the boundaries as described in this title, designated as Project No. 1436, are in the public interest and promote the public welfare of the county; and WHEREAS, on August 18, 2015 the Board held a public hearing in the Commission Chambers at which time the owners of the property to be assessed were afforded an opportunity to appear before the Board to be heard as to the propriety and advisability of making such improvements; and WHEREAS, after such public hearing was held the County Commission adopted Resolution No. 2015-092 which confirmed the special assessment cost of the project to the property specially benefited by the project in the amounts listed in an attachment to that resolution; and WHEREAS, now that the project has been completed, the Director of Public Works has certified the actual "As -Built" cost to be $0.0663278557 per square foot, which is equal to 0.0663278557 per square foot in the confirming Resolution No. 2015-092. P \Public WorkS\ENGINEERING DIVISION PROJECTS\1436-9th Lane W of 43rd Ave -Petition Paving\Admin\agenda items\1436 Resolution -AS - built 12-15-15 doc RESOLUTION NO. 2015- 140 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: 1. To avoid interest and penalty charges, payment may be made within ninety (90) days after the passage of this resolution. 2. Payments bearing interest at the rate of 5.00% per annum may be made in 2 equal annual installments, the first to be made twelve (12) months from the due date. The due date is ninety (90) days after the passage of this resolution. 3. The assessment roll for said project listed in Resolution No. 2015-092 shall be as set forth in attached ASSESSMENT ROLL to this resolution. 4. The assessments as shown in attached ASSESSMENT ROLL shall stand confirmed and will remain legal, valid, and binding first liens against the property against which such assessments are made until paid. 5. The assessments shown in ASSESSMENT ROLL attached to Resolution No. 2015-092 were recorded by the County on the public records of Indian River County, and the lien shall remain prima facie evidence of its validity.
