HomeMy WebLinkAbout1998-046 4/6/98(reeo\criminaicoete)ow RESOLUTION NO. 98- 46 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, ADOPTING FINES AND COSTS IN CERTAIN CRIMINAL PROSECUTION. WHEREAS, a standardized "Order assessing fines, costs, and additional charges, and, if indicated, entering judgment" and a related standardized final judgment will conduce the orderly administration of justice, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: 1. The attached two forms entitled "Order assessing fines, costs, additional charges, and, if indicated, entering judgment" and "Final Judgment for fines,costs,and additional charges"are hereby approved and adopted." The resolution was moved to adoption by Commissioner Macht and the motion was seconded by Commissioner Ginn , and, upon being put to a vote, the vote was as follows: Chairman John W. Tippin Aye Vice Chairman Kenneth R. Macht Aye Commissioner Fran B. Adams Aye Commissioner Carolyn K. Eggert Aye Commissioner Caroline D. Ginn Aye The Chairman thereupon declared the resolution duly passed and adopted this 21 day of April , 1998. BOARD OF COUNTY COMMISSIONERS Attest: INDIAN RIVER COUNTY, FLORIDA Bye JeWey K.'Barton, rk John W.Tip in, airman n: FOURTH AMENDMENT TO a OPTION AGREEMENT FOR SALE AND PURCHASE This Amendment, made this s N day of , 1998 between INDIAN RIVER COUNTY(Purchaser)And the IRWIN (Seller); WITNESSETH: WHEREAS, on July 2, 1997 an Option Agreement for Sale and Purchase was entered into between Purchaser and Seller;and WHEREAS, Purchaser is entering into a cost share purchase with the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida;and WHEREAS, the Option Agreement contains an incorrect legal description of the Property;and WHEREAS, all parties are hereto wish to amend the Option Agreement to correct the legal description of the Property. NOW, THEREFORE, in consideration of the mutual terms, conditions, promises,covenants and other consideration which is hereby acknowledged,Purchaser and Seller agree as follows: 1. The Option Agreement is amended to substitute the legal description of the Property which is attached hereto as Exhibit A and made a part hereof for the legal description of the Property attached as Exhibit A to the Option Agreement. 2. The terms of this Amendment shall be binding upon and inure to the benefit of the parties hereto and their respective heirs,personal representatives,successors and assigns. 3. Except as expressly set forth herein, the Option Agreement shall remain in full force and effect and is hereby ratified and confirmed as of the Amendment date.
