AN EMERGENCY ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS
OF INDIAN RIVER COUNTY, FLORIDA, APPROVING A TEMPORARY USE
PERMIT ISSUED TO CDS MANUFACTURING, FOR A TEMPORARY
CONSTRUCTION SITE LOCATED AT 16505 20TH STREET.
WHEREAS, all land uses and development orders must be consistent with the comprehensive
land use plan; and
WHEREAS, if this specific use was permitted as a permanent use, it would be inconsistent with
the comprehensive land use plan; and
WHEREAS, the long range use of the property will be consistent with the comprehensive land
use plan; and
WHEREAS, this use is,temporary. and its approval is a. direct result of international, national.
and local economic emergencies;.and
WHEREAS, the latest reading of the unemployment rate for Indian River County was 15% and
it is anticipated that this temporary use will create up to 40 new jobs in the County; and.
WHEREAS, the United, States govermllent, in response to the national economic crisis, passed
the federal stimulus prograin lcriown as the American Recovery and Reinvestment Act. The
stimulus program is funding "shovel ready" construction projects throughout the country. The
Indian Street Bridge was ranked the No. I stimulus project by the Florida Department of
Transportation ("FDOT") for the State of Florida; and
WHEREAS, the Indian.Street Bridge project will require temporary facilities; such as a casting
yard, to be located within the treasure coast area; and
WHEREAS, an Indian Street Bridge subcontractor has identified a site in Indian River County
as a location for a temporary casting yard.
WHEREAS, the site for the proposed temporary use was recently utilized for the same or
similar purposes on another FDOT project; and
WHEREAS, the temporary use permit will terminate upon completion of the Indian Street
Bridge; and
WHEREAS, the country is facing the worst economic crisis since pre -World War II; and
WHEREAS, the temporary use permit will have a positive impact on the local economy; and
WHEREAS, passing an emergency ordinance will promote economic recovery consistent with
national and local objectives while maintaining comprehensive land use plan consistency when
the temporary use project is completed; and
WHEREAS, The Board,6f.CotintyComnnissioners finds that approving the temporary use
permit is In the vest interest of the public health, safety and welfare.
NOW, THEREFORE, DE IT ORDAINED, by the Board of County Commissioners of Indian
River County that the temporary use permit for CDS Manufacturing located at 16505 20th Street
is approved until the "stimulus or recovery" Indian Street Bridge project is completed.
SECTION #1:
Recitals: The Recitals set forth above are incorporated by reference and made apart hereof as
fully as if set forth herein verbatim
SECTION #2:
The application for the Temporary Use Permit is completed and referenced hereinto as
Attachment "A".
SECTION 43:
This ordinance is legislative authority for a temporary use pen -nit and is not an amendment to the
land development regulations and shall not be codified.
SECTION 44:
EFFECTIVE DATE.
This Ordinance shall be deemed to be filed and shall take effect when a copy has been accepted
by the postal authorities of the Govenunent of the United States for special delivery by certified
mail to the Department of State.
Approved and adopted. by the Board of County Commissioners of Indian River County, Florida,
on this 15th day of September , 2009.
This ordinance was not advertised in the Press -Journal as the notice requirements are waived if
the ordinance is adopted pursuant to Florida Statutes § 125.66(3).

county engineering staff may require a $300.00 removal and restoration cash bond in addition to the $200.00 clean-
up bond.
*Renewals: When renewing a construction trailer/office or sales trailer/office you MUST provide a letter fi-om the
governing party for the project stating that it is okay for the trailer/office to be renewed and remain at that location.
