RESOLUTION NO. 2017- 005
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
INDIAN RIVER COUNTY, FLORIDA, SETTING A TIME AND PLACE
AT WHICH THE OWNERS OF PROPERTIES FROM 699 S. EASY
STREET TO AND INCLUDING 774 S. EASY STREET; 193 CHELLO
AVENUE TO AND INCLUDING 209 CHELLO AVENUE; 100 BECKER
AVENUE TO AND INCLUDING 109 BECKER AVENUE; 100
CHARLES AVENUE TO AND INCLUDING 108 CHARLES AVENUE;
738 HOLDEN AVENUE TO AND INCLUDING 786 HOLDEN AVENUE;
AND 800 HOLDEN COURT TO AND INCLUDING 807 HOLDEN
COURT, WITHIN THE SUBDIVISION OF COLLIER CREEK ESTATES,
PHASES 1, 3, 4, 5 AND PORTIONS OF PHASES 2 AND 6, LOCATED
WITHIN THE CITY OF SEBASTIAN, IN INDIAN RIVER COUNTY,
FLORIDA; AND OTHER INTERESTED PERSONS, MAY APPEAR
BEFORE THE BOARD OF COUNTY COMMISSIONERS OF INDIAN
RIVER COUNTY AND BE HEARD AS TO THE PROPRIETY AND
ADVISABILITY OF CONSTRUCTING THE WATER MAIN
EXTENSION, AS TO THE COST THEREOF, AS TO THE MANNER OF
PAYMENT THEREFOR, AND AS TO THE AMOUNT THEREOF TO BE
SPECIALLY ASSESSED AGAINST EACH PROPERTY BENEFITED
THEREBY.
WHEREAS, the Board of County Commissioners of Indian River County has, by
Resolution No. 2017-004 , determined that it is necessary for the public welfare of the
citizens of the County, and particularly as to those living, working, and owning property
within the area described hereinafter, that a waterline be installed from 699 S. Easy Street
to and including 774 S. Easy Street; 193 Chello Avenue to and including 209 Chello Avenue, 100
Becker Avenue to and including 109 Becker Avenue; 100 Charles Avenue to and including 108
Charles Avenue; 738 Holden Avenue to and including 786 Holden Avenue; and 800 Holden Court
to and including 807 Holden Court, within the subdivision of Collier Creek Estates, Phases 1, 3,
4, 5 and portions of Phases 2 and 6, located within the City of Sebastian, in Indian River County,
Florida, to serve 141 parcels ("Improvements"); and
WHEREAS, as access to water provides an equal benefit to each property served,
the assessment will be equal per parcel; and
WHEREAS, it has been determined that the cost to be specially assessed with
respect thereto shall be $881,250.00 or $6,250.00 per parcel; and
WHEREAS, the Board of County Commissioners has caused an assessment roll
to be completed and filed with the Clerk to the Board; and

WHEREAS, Section 206.06 of The Code of Indian River County provides that the
Board of County Commissioners shall fix a time and place at which the owners of the
specially benefited properties to be specially assessed or any other persons interested
therein may appear before the Board of County Commissioners and be heard as to the
propriety and advisability of constructing such water main extension, as to the cost
thereof, as to the manner of payment therefor, and, as to the amount thereof to be
assessed against each property benefited thereby,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows:
1. The Count Commission shall meet at the Count Commission Chambers in the

County Administration Building at the hour of 9:05 a.m., or as soon thereafter as the
matter may be heard, on Tuesday, March 14, 2017, at which time the owners of the
specially benefited properties to be specially assessed and any other interested
persons, may appear before said Commission and be heard as to the propriety and
advisability of making the improvements, the cost thereof, the manner of payment
therefor, and the amount to be assessed against each property. The area to be
improved and the properties to be specially benefited are more particularly described
upon the assessment plat and the assessment roll with regard to the special
assessments.
2. All persons interested in the construction of said Improvements and the special
assessments against the properties to be specially benefited may review the
assessment plat showing the area to be assessed, the assessment roll, the plans and
specifications for said Improvements, and an estimate of the cost thereof at the office
of the Department of Utility Services and the Clerk to the Board any week day from
8:30 a.m. until 5:00 p.m., excluding holidays.
3. Notice of the time and place of this public hearing shall be given by two publications
in the Indian River Press Journal Newspaper one week apart. The last publication
shall be at least one week prior to the date of the hearing.
4. The Department of Utility Services shall give the owner of each property to be specially
assessed at least ten days' notice in writing of such time and place, which shall be
served by mailing a copy of such notice to each of such property owners at his last
known address obtained from the records of the property appraiser.

The resolution was moved for adoption by Commissioner sol ari , and
the motion was seconded by Commissioner Flescher , and, upon being
put to a vote, the vote was as follows:

The Chairman thereupon declared the resolution duly passed and adopted this
