AGREEMENT.TO PURCHASE AND SELL REAL ESTATE
THIS MODIFICATION TO AGREEMENT TO PURCHASE AND SELL REAL ESTATE is made and entered
into as of 2017 by and between INDIAN RIVER COUNTY,a political subdivision of
the State of Florida ("County")and DATAPATH TOWER LLC("Buyers").

WITNESSETH:
WHEREAS, County and Buyers entered into that certain Agreement to Purchase and Sell Real
Estate("Agreement")as of July 5,2016;and
WHEREAS,the closing date was to take place within 30 days following the effective date of said
Agreement;and
WHEREAS, the closing was not consummated within the required qu red time set forth in said
Agreement, however both County and Buyers mutually desire to extend the closing date to February 15,
2017;

NOW,THEREFORE,upon good and valuable consideration set forth in said Agreement,the parties
mutually agree to extend the closing date to February 15,2017.
IN WITNESS WHEREOF, the undersigned have executed this Modification to Agreement to
Purchase and Sell Real Estate as of the date first set forth above.
