HomeMy WebLinkAbout1991-016ORIGINAL RESOLUTION NO. 91-J6 A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA AUTHORIZING THE LEASE OF SPACE IN THE MAIN LIBRARY TO THE FRIENDS OF THE LIBRARY. WHEREAS, the County has recently completed a new main library, and WHEREAS, the Friends of the Library, an organization not for profit which promotes Community interest and welfare has requested to lease space in the new library, and WHEREAS, Section 125.38, Florida Statutes, allows leases of the nature sought by the Friends of the Library, NOW, THEREFORE, be it resolved by the Board of County Commissioners of Indian River County that Indian River County shall enter into a lease with the Friends of the Library under the terms and conditions set forth in the lease attached hereto as Exhibit "A" The resolution was moved to adoption by Commissioner Scurlock and the motion was seconded by Commissioner Wheeler , and, upon being put to a vote, the vote was as follows: Chairman Richard N. OcyI `� // a -2Z_1'/ Ru" Mgr. ,11 ORIGINAL EXHIBIT "A" LEASE AGREEMENT THIS AGREEMENT, entered into this 12 day of February 1991 between INDIAN RIVER COUNTY, FLORIDA, a political sub- division of the State of Florida, hereinafter called the Lessor, and FRIENDS OF THE LIBRARY, a non profit corporation organized under the laws of Florida, herein called the Lessee. WITNESSETH, that in consideration of the covenants herein contained, on the part of the said Lessee to be kept and performed, the said Lessor does hereby demise and lease to the said Lessee a portion of the Main Public Library of Indian River County located at 1600 - 21st Street in the City of Vero Beach, Florida. Said leased premises to consist of 720 square feet as designated by the Librarian. Said leased premises are hereby demised unto said Lessee from the 1st day of February, 1991 to the 1st day of February, 1992. Renewals shall be for one year and shall be automatic unless notice to cancel this lease is given by either party within 60 days of the date of renewal or unless an increase in rent is occasioned by an increase in maintenance costs or other facts in which case an addendum reflecting the new rental rate shall be executed. Said Lessee shall pay an annual rent of $1,800.00, payable on the first of February. The Lessor covenants with the Lessee that the Lessee paying the rent when due aforesaid, shall peacefully and quietly use, occupy and possess the said premises for the full term of this lease without let, hindrance, eviction, molestation or interruption whatever, except as provided below, and the said Lessee covenants with the Lessor: 1. To pay said rent at the times at which the same is made payable. 2. To maintain tenants' contents and liability insurance for the duration of the lease. 3. Not to suffer to commit any waste of the premises, nor make any unlawful, improper or offensive use of same. 4. Telephone service, if any, shall be the sole responsibility of the Lessee. 5. Not to assign this lease or sublet the said premises or any part hereof without the previous consent of the said Lessor being first obtained in writing. 6. At the termination of said tenancy to quietly yield up the said premises in as good and tenantable condition in all respect (reasonable wear and use and damage by fire and other unavoidable causes excepted) as the same now are. 7. Notwithstanding any provisions to the contrary, should Lessor desire possession at any time, Lessor may terminate this lease with 60 day written notice to vacate.
