RESOLUTION NO. 91- 17
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY,
FLORIDA, CONFIRMING THE ASSESSMENT ROLL
FOR CONSTRUCTION OF A RECREATION PATH ON THE
WEST SIDE OF A1A FROM THE SOUTH CITY LIMIT OF
VERO BEACH TO THE SOUTH MOORINGS LINE
(SPYGLASS LANE)
WHEREAS; on December 18, 1990 the Board of County
Commissioners adopted Resolution
construction of a recreation path on
south City Limit of Vero Beach to the
Lane); and
WHEREAS, on December 18,
Commissioners adopted Resolution No.
No. 90-189 providing for
the west side of A1A from the
South Moorings line (Spyglass
1990 the Board of County
90-190 setting the date and
time for a public hearing to discuss the advisability, costs and
amount of the assessment against each property owner; and
WHEREAS, this hearing was held on February 12, 1991,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows:
1. The foregoing recitals are affirmed and ratified in
their entirety.
2. The attached assessment roll for construction of a
recreation path on the west side of A1A from the south City Limit
to the south Moorings line (Spyglass Lane) is approved, pursuant to
Section 11-47, Code of Laws and Ordinances of Indian River County.
The foregoing resolution was offered by Commissioner
who moved its adoption. The motion was seconded

STATE OF FLORIDA
COUNTY OF INDIAN RIVER
Before me, the undersigned authority, duly qualified and acting,
personally appeared JEFFREY K. BARTON, to me well known who,
being duly sworn, deposes and says:
1. That the affiant is the Clerk of the Circuit Court for Indian
River County and pursuant to Section 125.17, Florida
Statutes is the clerk and accountant of the Board of County
Commissioners for Indian River County.
2. That one of the official duties of the affiant as set forth in
Section 11-46 Indian River County Code (1974 edition) is to make
affidavit of proof of mailing of notice of special assessments.
3. That based on the attached affidavit of Terry Thompson and
only on this information, the affiant states that compliance with
the notice provisions of Section 11-46 has been accomplished with
respect to the project described therein (Project No. 9016).

AFFIDAVIT
STATE OF FLORIDA
COUNTY OF INDIAN RIVER
Before me, the undersigned authority, duly qualified and acting,
personally appeared TERRY THOMPSON, to me well known who, being
duly sworn, deposes and says:
1. That the affiant is a professional engineer employed by Indian
River County in the Public Works Department working primarily
in the right-of-way development.
2. That the affiant in her official capacity is the project manager
for a Recreation Path (sidewalk), Project No. 9016. Said project
to be accomplished through special assessment procedures
provided for in Section 11-41 et seq. of the Indian River county
Code (1974 edition) which requires notification to all property
owners in the project area.
3. That the affiant has caused to be acquired from the Property
Appraiser of Indian River County the names of all property
owners in the project area which extends from the City of Vero
Beach south City limit on the barrier island (Orchid Island) to
Spy Glass Lane.
4. That the affiant has caused the mail out of notification of special
assessment on January 29, 1991 to all of the property owners in
the project area based on the names provided by the Property
Appraiser.
