RESOLUTION NO. 91-_21
A RESOLUTION OF INDIAN RIVER COUNTY,
FLORIDA, ADOPTING A SCHEDULE OF RATES,
FEES, AND CHARGES FOR OPERATION OF THE
INDIAN RIVER COUNTY FAIRGROUNDS.
WHEREAS, on May 2, 1988, Indian RIver County obtained a completed
Parks and Recreation User Fee Revenue Study from Mayes, Suddruth &
Etherege, Inc., parks consultants; and
WHEREAS, pursuant to that report, the County has been charging
certain daily fees and trash deposits for the County fairgrounds, depending
on the number of acres leased by any user; and
WHEREAS, recently a new pavilion has been constructed at the
fairgrounds which will necessitate a new fee schedule,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that:
1. The attached Exhibit "A," Daily Rate Schedule for Lease of Indian
River County Fairgrounds, is hereby adopted as the official fee
schedule for rates, fees, and charges to be charged at the
fairgrounds.
2. The attached Exhibit "B," Insurance Requirements, Fairgrounds Lease,
contains the minimum requirements with which any user of the
fairgrounds must comply.
The resolution was moved for adoption by Commissioner Eggert ,
the motion was seconded by Commissioner Scurlock , and, upon being
put to a vote, the vote was as follows:

* Any direct costs such as porta-lets, bleachers, etc. will be
negotiated with applicant, deposit will be refunded in part or
full if not used. All applications must be filed at least two
weeks before event unless waived.
Proper insurance as required above must be submitted at least one
week before scheduled event. (See attached requirements)
All events which charge any admission or any type of fee or sell
any products will pay to the County, ten percent (10%) of the
gross charges unless negotiated by the proper County authority on
a different basis.

INSURANCE REQUIREMEMPS
FAIRGROUNDS LEASE
Lessee shall procure and maintain for the duration of the lease insurance
against claims for injuries to persons or damages to property which may
arise frau or in connection with the Lessee's operation and use of the leased
premises. The cost of such insurance shall be borne by the Lessee.
A. MINIMUM LIMITS OF INSURANCE
Lessee shall maintain limits no less than:
1. General Liability: $500,000 combined single limit per occurrence for
bodily injury, personal injury and property damage. If Commercial
General Liability Insurance or other form with a general aggregate limit
is used, either the general aggregate limit shall apply separately to
this project/location or the general aggregate limit shall be twice
the required occurrence limit.
2. Workers' Compensation and Employers Liability: Workers' Compensation
limits as required by the Sate of Florida and Ehployers Liability limits
of $100,000 per accident.
B. OTHER INSURANCE PROVISIONS
The policies are to contain, or be endorsed to contain, the following
provisions:
1. General Liability
The County, its officers, officials, employees and volunteers are to be
covered as insureds as respects: liability arising out of premises owned,
occupied or used by the Lessee. The coverage shall contain no special
limitations on the scope of protection afforded to the County, its
officers, officails, employees or volunteers.
The Lessee's insurance coverage shall be primary insurance as respects
the County, its officers, officials, employees and volunteers. Any
insurance or self-insurance maintained by the County, its officers,
officials, employees or volunteers shall be excess of the Lessee's
insurance and shall not contribute with it.
Any failure to comply with reporting provisions of the policies shall not
affect coverage provided to the County, its officers, officials, employees
or volunteers.
Insurance Requirements
Coverage shall state that the Lessee's insurance shall apply separately
to each insured against wham claim is made or suit is brought, except
with respect to the limits of the insurer's liability.

2. Workers' Compensation and Employers Liability Coverage
The insurer shall agree to waive all rights of subrogation against the
County, its officers, officials, employees and volunteers for losses
arising from the leased premises.
C. AFFABILITY OF INSURERS
Insurance is to be placed with insurers with a Best's rating of no less than
A+ VII.
D. VERIFICATION OF RAGE
Lessee shall furnish the County with certificates of insurance and with
original endorsements effecting coverage required by this clause. The
certificates and endorsements for each insurance policy are to be signed by
a person authorized by that insurer to bind coverage on its behalf. All
certificates and endorsements are to be received and approved by the County's
Risk Manager ten (10) days prior to use of the Fairgrounds. The County
reserves the right to require complete, certified copies of all required
policies, at any time.
