CLERK OF COURT INDIAN RIVER COUNTY FL BK 2675 PG 1952 Page 1 of 7 6/6/2013 2-48 PM RESOLUTION NO. 2013-__a43 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, FORMALLY ACCEPTING THE DEDICATION OF UTILITY EASEMENTS, LIFT STATION TRACT `J', AND A LIFT STATION EASEMENT AS DEPICTED ON THE PLAT OF CROSS CREEK LAKE ESTATES PLAT ONE, RECORDED IN PLAT BOOK 26, PAGE 70 OF THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA. WHEREAS, Cross Creek Lake Estates Plat One is located north of C.R. 510, south of Barber Street, and west of 70th Avenue within the City of Sebastian and consists of eleven lots; a copy of the recorded plat is attached to this resolution and incorporated by reference herein; and WHEREAS, water and sewer services to this development are provided by Indian River County; and WHEREAS, the plat of Cross Creek Lake Estates Plat One: (1) Dedicates to both Indian River County and the City of Sebastian perpetual utility easements for the construction, installation, maintenance and operation of utilities by any utility provider, in compliance with such ordinances and regulations as may be adopted from time to time by the Board of County Commissioners of Indian River County, Florida and the City of Sebastian City Council, and (2) Dedicates Tract `J' to Indian River County for construction and maintenance of sanitary sewer facilities, and 1 RESOLUTION NO. 2013- 043 (3) Dedicates a lift station easement to Indian River County for construction and maintenance of sanitary sewer facilities; and WHEREAS, on the face of the plat there are no acceptances of the above recited dedications by the Board of County Commissioners of Indian River County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: 1. The dedication of utility easements, Tract 'J', and the lift station easement all as shown on the face of the plat of Cross Creek Lake Estates Plat One, as recorded in Plat Book 26, Page 70 of the public records of Indian River County, Florida are hereby expressly and formally accepted for the purposes set forth in said plat; and 2. This resolution shall be recorded in the Public Records of Indian River County, Florida, and as soon as recorded, the Clerk of Court is instructed to make a notation of the face of the plat of Cross Creek Lake Estates Plat One referencing the book and page of this resolution. The resolution was moved for adoption by Commissioner Dads , and the motion was seconded by Commissioner _! escher , and, upon being put to a vote, the vote was as follows: Chairman Joseph E.
