A RESOLUTION OF INDIAN RIVER COUNTY,FLORIDA,RELEASING
EASEMENTS(OR PORTION THEREOF) ON LOT 96, CASTAWAY COVE
SUBDIVISION
WHEREAS,Indian River County has an interest in a planting easement and utility easement on Lot
96 of Castaway Cove Subdivision; and
WHEREAS,the retention of the easements, or portion thereof, as described below, serves no public
purpose;
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Indian River
County,Florida that:
INDIAN RIVER COUNTY DOES HEREBY RELEASE and abandon all right,title, and interest
that it may have in the following described easements or easement portions:
the easterly five (5)feet of the westerly ten (10)foot rear yard planting easement, together with the
westerly rear yard ten (10)foot utility easement, of Lot 96, Castaway Cove, according to the plat thereof
recorded in Plat Book 9, Page(s) 85 &85A of the Public Records of Indian River County, Florida.
This release of easement is executed by Indian River County, a political subdivision of the State of
Florida,whose mailing address is 1801 27th Street,Vero Beach, Florida 32960.
THIS RESOLUTION was moved for adoption by Commissioner Solari , seconded by
Commissioner Adams , and adopted on the 2nd day of
October 2018, by the following vote:

Commissioner Susan Adams AYE
Commissioner Joseph E. Flescher AYE

RELEASE OF EASEMENTS
INDEX NO: 2.618 - 18P-A
WHEREAS, Indian River County has easements as described below;and

WHEREAS, CHAD HEINZ, the owner of the property encumbered by the described easements, has made
application to Indian River County requesting that the County release those easements; and
WHEREAS, in coordination with interested entities, County staff has determined that the retention of those
easements serves no public purpose; and
WHEREAS, the Indian River County Board of County Commissioners, at its regular meeting on November 9,
1993, adopted Ordinance 93-34, which amended County Code Section 101.05 to authorize the County Administrator or
his designee, after proper coordination with interested entities, to execute releases of side or rear lot easements that are
found to serve no public purpose;
NOW, THEREFORE, THIS RELEASE OF EASEMENTS IS EXECUTED on behalf of the Board of County
Commissioners of Indian River County, a political subdivision of the State of Florida, whose mailing address is 1801
27th Street,Vero Beach, Florida 32960.
INDIAN RIVER COUNTY DOES HEREBY RELEASE and abandon all right, title, and interest that it may
have in the following described easements:
the west ten(10)foot rear yard drainage& utility easements on Lots 7-9, together with the east rear yard ten(10)foot
drainage& utility easements on Lots 10- 12, Block E, Pine Lake Estates Unit 1, as shown on an instrument of information recorded
in Official Records Book 115, Page 214 of the Public Records of Indian River County, Florida, more particularly described by metes
and bounds description filed in Official Records Book 153 Pages 399, 401, 403, 405, 407, and 409 of the Public Records of Indian
River County, Florida.
