INDIAN RIVER COUNTY RESOLUTION DECLARING
STATE OF LOCAL EMERGENCY
WHEREAS, the National Hurricane Center recognizes the danger
to coastal residents of Florida from Hurricane Erin
by posting a hurricane warning
from Monroe County to Indian River County; and
WHEREAS, Indian River County has high evacuation times to
evacuate residents from the hazards of a hurricane; and
WHEREAS, the current forecast error of the National Hurricane
Center does not allow for a confident prediction of the track
of Hurricane Erin at that point in time,
coinciding with Indian River County's high evacuation times;
and
WHEREAS, Hurricane Erin has the potential for
causing extensive damage to public utilities, public
buildings, public communication systems, public streets and
roads, public drainage systems, commercial and residential
buildings and areas; and
WHEREAS, Section 252.38(3), Florida Statutes, provides
authority for a political subdivision such as Indian River
County to declare a State of Local Emergency and to waive the
procedures and formalities otherwise required of political
subdivisions by law pertaining to:
1. Performance of public work and taking whatever
action is necessary to ensure the health, safety,
and welfare of the community.
2. Entering into contracts.
3. Incurring obligations.
4. Employment of permanent and temporary workers.
5. Utilization of volunteer workers.
6. Rental of equipment.
7. Acquisition and distribution, with or without
compensation of supplies, materials and facilities.
8. Appropriation and expenditure of public funds.
NOW THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Indian River County, Florida, this 1st
day of August 1995, that:
1. Hurricane Erin poses a serious
threat to the lives and property of residents of
Indian River County and that a State of Local
Emergency shall be declared, effective immediately,
for all of Indian River County, including, all
unincorporated and incorporated areas.
2. The Board of County Commissioners hereby exercises
its authority and waives the procedures and
formalities required by law of a political
subdivision, as provided in Chapter 252.38(6)(e),
Florida Statutes.
The resolution was moved
for adoption by Commissioner Adams
and the motion
was seconded by Commissioner
Bird , and, upon being put to a vote, the vote was
as follows:
