HomeMy WebLinkAbout1985-058RESOLUTION N0. 85- 58 A RESOLUTION OF THE BOARD OF COUNTY CCI4ISSIONER.S OF INDIAN RIVER COUNTY, 0 17JORIDA, PROVIDING FOR CERTAIN PAVING AND DRAINAGE IMPROVEMENT TO 19TH AVENUE SOUTHWEST BETWEEN 13TH AND 14TH STEMS SOUPHWE5T; PROVIDING THE TOTAL ESTIMATED 0 COST, MET1= OF PAYMENT OF PSSES&' NPS, NUMBER OF ANNUAL INSTALLMENTS, AND LEGAL DESCRIPTION OF THE AREA SPDCIALLY BR'ITED. WHEREAS, the County Public Works Department has received a public improvement petition, signed by more than a majority (but less than 2/3) of the owners of property in the area to be specially bene- fited, requesting paving and drainage improvements to 19th Avenue Southwest between 13th and 14th Streets Southwest; and WHEREAS, at the July 11, 1984 County Co viission meeting, the Board unanimously moved to initiate the requested inprovements, using the authority reserved to the Board in Section 25 of Ordinance 81-27, and authorized the Public Works Division to proceed with the project in accordance with the ordinance; and the design work including cost estimates have been completed by the P blic Works Division and the total estimated cost of the proposed improvements is $16,340.41; and WHEREAS, this resolution has been published in accordance with ordinance requirements, and a public hearing conducted; and WHEREAS, the special assessment provided hereunder shall, for any given record owner of property within the area specially bene- fited, be in an amount equal to that proportion of seventy-five percent (758) of the total cost of the project which the nunber of lineal feet of road frontage owned by the given owner bears to the total number of lineal feet of road frontage within the area specially benefited, and shall becam due and payable at the Office of the 'Pax Collector of Indian River County ninety (90) days after the final determination of the special assessment pursuant to Ordinance 81-27; and WHEREAS, Indian River County shall pay the remaining twenty-five percent(258) of the total cost of the project; and WFlEREAS, any special assessment not paid within said ninety (90) day period shall bear interest beyond the due date at a rate established by the Board of County Ccnu ssioners at the time of prepar- ation of the final assessment roll, and shall be payable in two (2) equal installments, the first to be made twelve (12) months from the due date and the second to be made twenty-four(24) months from the due date; and WHEREAS, after examination of the nature and anticipated usage of the proposed improvements, the Board of County Commissioners has determined that the following described properties shall receive a direct and special benefit from these inprovements, to wit: Lots 12 through 20, Black A; Lot 22, Block A Lots 1, Block D; Lots 3 through 11, Block D; Oslo Park Subdivision as recorded in Plat Book 4 Page 19 in the Public Records of Indian River County, Florida r 40 40 •0 NOW UMUFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: 1. The foregoing recitals are affirmed and ratified in their entirety. 2. A project providing for paving and drainage improve- ments to 19th Avenue Southwest between 13th and 14th Streets Southwest, heretofore designated as Public Works Project N0.8402, is hereby approved subject to the terms outlined above and all applicable requirawants of Ordinance 81-27. The foregoing resolution was offered by Commissioner Scurlock Who moved its adoption. The motion was seconded by Ccmnis- sioner Bowman and, upon being put to a vote, the vote was as follows: Chairman Patrick B. Lyons Aye Vice -Chairman Don C. Scurlock, Jr. Aye Commissioner Margaret C.
