RESOLUTION NO. 93-
A RESOLUTIONOF THE BOARD OF COUNTY
COMMISSIONERS: OF INDIAN RIVER COUNTY,
Y FLORIDA,' 'ENDORSING DREDGING OF PORT OF
FORT PIERCE.
WHEREAS, Indian River County is located just north of the Port
:of Fort Pierce; and
WHEREAS, proposed dredging to the Port of Fort Pierce will
have a beneficial effects on the economy in Indian River County; and
WHEREAS, it appears the said improvements can be accomplished
with minimal environmental costs,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA
that the Board supports the dredging to the Port of Fort Pierce
because:
1. This dredging will have a beneficial on the economy in
Indian River County.
2. This expansion may be accomplished with minimal

environmental costs.
3. The high rate of unemployment in Indian River County
should be lessened by the strengthening of the economy resulting
from said improvements.
The resolution was moved to adoption by Commissioner
Eggert and the motion was seconded by Commissioner
Tippin , and, upon being put to a vote, the vote was as
follows:

The Chairman thereupon declared the resolution duly passed and

III. PROJECT INFORMATION
A). Project Description:
1. Brief Narrative:
Construction of 41st Street and 45th Street from Indian
River Boulevard to US 1/SR 5. Both roads exist as unpaved
roads serving adjacent groves and will be improved to
two (2) lane undivided paved roads with four foot paved
shoulders functioning as bicycle lanes.

3. Work Phases in Application Project:
Construction of Indian River Boulevard from 37th Street to
53rd Street has been advertised for bid and construction
should be complete by May 1994. Construction of the Boule-
vard is not included in this application, it received
partial funding under JPA WPA 4125347.
This application provides for construction of two (2)
east/west connectors, 41st Street and 45th Street, be-
tween Indian River Boulevard and US 1. Construction of
these east/west connectors is the final phase of the
Indian River Boulevard Project.

V. STATEMENT OF BENEFITS
EXHIBIT A, attached
Attach a narrative identifying the benefits of the project to the State Highway System.
Explain how the project will improve traffic flow and reduce congestion of the State
Highway System. Provide information on the anticipated level of service, traffic volume in
average daily traffic, safety considerations, and structural adequacy (physical condition of
facility) for the project.

qualifying phases and their accompanying costs. Total estimated project costs, cost incurred

Use EXHIBIT C to compute the state and local government project funding split.
EXHIBIT C displays the estimated total project cost (including the fair market value of
donated goods and services and qualifying and non -qualifying costs) from EXHIBIT B; the
balance of qualifying project costs (from EXHIBIT B); the percentage and amount of
qualifying project costs the local government will fund; the percentage and amount of state
matching funds requested.
EXHIBIT D, attached
A Memorandum of Agreement (MOA) must be executed by the Chief Executive
Officer and the Chief Fiscal Officer of the local Government. EXHIBIT D must be
executed subsequent to the signing of a Joint Participation Agreement (JPA). The MOA
shall be signed if a project is selected for funding under the grant assistance program.

An Authorizing Resolution must be signed, sealed and submitted as part of the project
application package. EXHIBIT E is an example of an authorizing resolution that may be
used.

LOCAL GOVERNMENT COOPERATIVE ASSISTANCE PROGRAM
Application Agency Indian River County
Construction of 41st Street and 45th Street will provide two
east/west connections between US 1/SR 5 and Indian River Boulevard.
Indian River Boulevard is being constructed to relieve traffic
congestion on SR 5 by providing an alternate or bypass route. Be-
cause of right-of-way constraints in the urbanized Vero Beach area,
construction of additional lanes on SR 5 is not feasible. With the
growth of the Grand Harbor area, Indian River Boulevard is expected
to carry 78,000 vehicles per day by the year 2011. The traffic on
45th Street for the year 2011 is anticipated to be 16,700 ADT.
Forty -First Street traffic volumes are anticipated to be slightly
less than 45th Street.
Intersection improvements on SR 5 at 41st Street and 45th Street
are included. in this project. Right -turn acceleration and decelerat-
ion lanes will be•provided on SR 5 at both intersections.
Indian River Boulevard will serve as a hurricane evacuation route
during emergency situations. Forty -First Street and 45th Street
will provide east/west connections to US 1 to expedite evacuation.
A fire station is scheduled to be constructed on the northwest
corner of Indian River Boulevard and 45th Street. Construction of
45th Street will provide a vital link for providing emergency
services on SR 5.

MEMORANDUM OF AGREEMENT

THIS MEMORANDUM OF AGREEMENT, made and entered into this _day of

WITNESSETH:
WHEREAS, the DEPARTMENT has announced an anticipated appropriation of matching
funds for the Local Government Cooperative Assistance Program (Florida Statutes 335.20) for the
upcoming fiscal year; and,
WHEREAS, the LOCAL GOVERNMENT desires to submit an application and apply for
such funds when they become available; and,
WHEREAS, the DEPARTMENT has indicated it) the LOCAL GOVERNMENT and the
LOCAL GOVERNMENT acknowledges that the funding for the Local Government Cooperative
Assistance Program is contingent con legislative appropriation; and.
WHEREAS, the DEPARTMENT has indicated to the LOCAL. GOVERNMENT and the
LOCAL GOVERNMENT acknowledges that the DEPARTMENT will review, evaluate and rank all
project applications received and that project funding will be based on the rank order listing of
Projects and the amount of available district appropriation allocation; and,
WHEREAS, the LOCAL GOVERNMENT is qualified to participate in the Local Government
Cooperative Assistance Program and has complied with the requirements of Section 335.20, Florida
Statutes and Department of Transportation Rule Chapter 14-99, Florida Administrative Code.

NOW THEREFORE:
IN CONSIDERATION of the mutual benefits to he derived from the joint participation
funding of projects in the Local Government Cooperative Assistance Program, the parties agree to the
following:
I. The LOCAL GOVERNMENT certifies that matching funds are available for the joint
funding of this project.
2. The application project is consistent with the Florida Transportation Plan, the
Metropolitan Planning Organization Transportation Improvement Program where applicable and any
appropriate local government comprehensive plan.
3. The LOCAL GOVERNMENT agrees to administer the project in compliance with all the
rules, policies and laws governing the DEPARTMENT.
4. This MEMORANDUM OF AGREEMENT and project application do not obligate the
commitment of funds by the DEPARTMENT.
5. The LOCAL GOVERNMENT, if the application project is selected for funding, agrees to
enter into a Joint Participation Agreement with the DEPARTMENT.
