Th -e Board of County Commissioners in and for Indian River County, Florida, met at the Court House in hero Beach, at 10:00 o'clock A.M.Monday, .August 21st 1933, in specie) session, with the following members of the Board present: J,.J.P.Hamilton, Chairman; J.D. Yoague;- John M Knight and Edwin A. Helseth.. - Also present were Miles alarreAt Clerk and Wn W Frick, Mheriff. The following resolution was introduced by Commissioner Aelseth and unanimously adopted: WHEREAS, Divine Providence in its wisdom has seen fit to remove from earthly affai a beloved Member of this Board in the person of 'gym. E. Feazel, a member of this Board f rom the Fe llsmere Di strict,- and WHEREA-S, Mr. Fea.zel has served the interest of his district and County faithfully and well during his short, but conspicious term of service as a member of this Board, WHEREAS, in his passing each member of the Board feels a distinct personal loss and the State of Florida, County of Indian River, and the Fellsmer© community have lost a faithful public servant, a. useful citizen and a man whose place in life it will be hard to fill; therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County,Florida, that we do as a Board, and as individual members thereof, deeply deplore the ps,ssing of Commissioner Wm. E. Feazel, and that the deep sympathies of the Board and each member thereof, are extended to his bereaved family; BE IT FURTHER RESOLVED that a copy of this resolution be spread at large upon the minutes of this Board, a copy sent to Commissioner Fea.zel's widow, and a copy furnished to the Vero Beach Press -Journal for publication. The Clerk was instructed to write the State Road Department for a map of Indian River County showing all State roads as designated and taken over by that Department f maintenance. It was moved, seconded and carried that $100.00 be appropriated for the County .Attorney to defend any mandamus action filed against the Tax Collector to require him to accept bonds for taxeq under the local law passed s.t the 1933 session of the Legis- lature. It being understood that this action is being done in view of the requests of the State Comptroller. Commissioner Yongue submitted plans and specifications for a proposed Court House building as prepared by W.H.Gaarms of Indianapolis, Indiana. The- Clerk was instructed to write C.B.Treadaway, Chairman, State Advisory Board of Public Works, Tallahassee, and ascertain whether or not the sum of $60,000.00 can be borrowed from the Federal Government to erect a Court House with the understanding that 30fe would be donated by the Government and 70°® is to be repaid within 40 years. 1 1 1 The following `resolution was introduced by Commissioner Knight, and was unanimously adopted: BE IT RESOLVED, by the Board of County Commissioners of Indian River County,Flo- rida, in special session assembled this 21st day of August, 1933, that this Board hereby elects to invoke and does hereby accept and adopt the provisions of Paragraph (d) of House Bill #30 approved May 270 19339 and does hereby determine that it is for the best interest of rrW. ian River County to use any and all moneys derived from the gasoline tax and now or hereafter c,)Zedited to the account of this County or Road and Bridge Districts therein, for the purpose of purchasing at a price below the par value thereof and at the lowest acceptable offer subject to the specific limitations hereinafter prescribed* any road and bridge bond or bonds of such County or Special District, and the exclusive use of such funds by the State Board of Administration for the purchase of such County and District road or road and bridge bonds to which such moneys as credited to this County would be applicable.' is hereby sanctioned and approved, and the State Board of Adminis.• tration is hereby authorized and requested, until further notice, to use such funds exclusively for the purchase of such bonds in open market transections in accordance with the general provisions of the 1933 Act, and subject to the following limitations as specifically provided in Paragraph (g) thereof: Price to be paid shall not excded 28 FLAT for all bonds. In the event bid is submitted for more than 28 Flat notify Board County Commissioners and additional resolution will be adopted if bid is satisfactory. BE IT FURTHER RESOLVED, that any and all transactions consummated or negotiations instituted and or commitments made by the State Board of Administration on behalf of Indian River County under and by virtue of the authority hereby extended pursuant.'to the terms of H: B. #301, are hereby ratified and Confirmed. BE IT FURTHER RESOLVED9 that a certified copy of this resolution be immediately furnished the State Board of Administration. The Chairman announced thea, among other things, this special meeting was held for the purpose of considering and acting upon and adopting the estimates of the expenses for the fiscal year commencing October 1st 1933, and ending September 30th 19349 which were prepared and entered upon the minutes of the meeting of the Board of County Commissioners, held on the 2nd day of .August, 1933, and to fix the rote of taxation for the year 1933. The Board then proceeded with the matter of fixing the rate of taxation for County and Special District purposes for the year 19339 and after a careful consideration of the estimates of receipts and the estimates of expenditures it was the determination of the Board that the rate of taxation necessary to meet such expenses would be for each of the following mentioned purposes the amounts estimated, declared and levied, viz: �� In order to meet the estimated current expenses of the County of Indian River of 017,789.82, it is determined and hereby declared that a tax rate of Seven (7) mills upon the dollar be levied and is hereby imposed upon all of the property lying .and being in the. County of Indian River on the first day of January, 1933, for the GENERAL FOD, to meet the current expenses of the County and to provide for the expenditure as estimated in the budget hereinbefore set forth. To meet the expenses estimated to be necessary to be paid out of the FINE & FORPEITI ;, the sum of $7,360.28, it is determined and hereby declared that a tax rate of Three (3) mills upon the dollar be levied, assessed, and is hereby imposed upon all the property lying and being in the County of Indian River on the first dayof January919339 for the FINE & FORFEITURE FOND, to meet the current expenses as estimated in the budget. To cover the amount of the estimated expenses for beeping the County Roads in good condition and for the construction and repairing of bridges and other necessary expen- ses to keep the roads'of the County in good shape and provide other roads when necess- . a,ry of $10,000.13 it is determined and hereby declared that a tax rate of Six (6) mills upon the dollar be levied, assessed, and is hereby imposed upon all of the property lying and being in the County of Indian River on the first day of January, 19339 to meet the current expenses of the County as estimated in the budget. To meet the current expenses incidental and necessary to the operation of the Public Schools of the County, and to pay a part of the salaries of teachers, outstanding general administration, -fixed charges and transportdtion, debt, and repair school houses/as estimated by the County Board of Public Instructions, the sum of $61,868.97, it is determined and hereby declared that a tax rate mf Ten (10) mills upon the dollar be levied, assessed, and is hereby imposed upon all the property in the County of Indian River on the first day of January, 1933, for the GENERAL SCHOOL FUND . To meet the outstanding indebtedness, and interest thereon, according to the esti- mates or budget the sum of $11,632.32, it is determined and hereby declared that a tax rate of Seven (7) mills upon the dollar be levied, assessed, and is hereby imposed upon all the property in the County of Indian River on the first day of January, 1933, to meet the obligations in the OUTSTANDING INDEBTEDNESS FUND, as estimated in the, budget, To provide a fund for the payment to worthy mothers in order that their children attend the public free schools of the County, the sum of $2,326.761 it is determined and hereby declared that a, tax rate of One (1) mill on dz the dollar be levied,assessed, and is hereby imposed upon all the. property in the County of Indian River on the first day of January 19339 for the MOTHERS PENSION FUND. .According to the millage so determined, fixed and assessed the total millage to be entered in the column provided for County taxes in the assessment roll for the year 19339 is 41 mills upon the dollar, to cover a total estimated expenditure of $127,433.28. Estimates having been made by the Trustees of Special Tax School District No.l, (SEB.Aa'T� and the Trustees having certified the rate of millage voted to be assessed it was determined that a. tax rate of Ten (10) mills upon the dollar be levied, and is hereby fixed and assessed for the year 1933, on all of the property in the County of Indian River lying and being within the boundaries of the said District No. 1, which boundaries are as follows, to -wit: Beginning at the North-east corner of Section 3, Township 31 'South Mange 39 East, then run West along County line to N.W.Co rear of Towhship 31 Range 38 East, thence South along Range line to S.W.Corner of :section 18, Township 31 South Range 38 East, thence East along Section line to Atlantic Ocean, thence North along Ocean Beach to starting point. To meet the interest payments and provide a sinking fund for the ultimate redemp- tion of Bonds and Time Warrants of Special School District No. 79 and in the pursuance of the requirements of law, and as estimated by the County Board of Public Instructions, it is determined and hereby declared that a tax rate of'42 mills upon the dollar be levied and is hereby fixed and assessed for the year 1933, on all of the property in the County of Indian River, lying and being within the boundaries of Special Tax School District No. 7, the boundaries of which said District being described above in these minutes. To meet the interest payments and provide a sinking fund for the ultimate redemp- tion of Bonds and Time Warrants of Special School District No. 8 & 9, and in the pursu- ance of the requirements of law, and as estimated by the County Board of Public Instru- etions,it is determined and hereby declared that a tax rate of 42 mills upon the dollar' levied and is hereby fixed and assessed for the year 19339 ondftl of the property in the County of Indian River, lying and being within the boundaries of Special Tax School District No. 8 & 91, the boundaries of which said District being described above in these minutes. To meet the interest payments and provide a sinking fund for the ultimate redemp- tion of Bonds and Time Warrants of Special -School District,No. '11, and in the pursuance of the requirements of law, and as estimated by the County Board of Public Instructions, it is determined and hereby declared that a tax rate of 192 mills upon the dollar be levied and is hereby fixed and assessed for the year 1933, on all of the property in the County of Indian River, lying and being within the boundaries of Special Tax School District No. 119 the boundaries of which said District being described above in these minutes. To meet the interest payments and provide a sinking fund for the ultimate redemp- tion of Bonds of'Special School District No. 149 and in the pursuance of the require- ments of law, and as estimated by the County Board of Public Instructions, it is deter- mined and hereby declared that a tax rate of 5 mills upon the dollar be levied and is hereby fixed and assessed for the year 19330 on all of the property in the County of Indian River, lying and being within the boundaries of Special Tax School District No.14, the boundaries of which said District being described above in these minutes. Estimates having been made by the Board of Commissioners of INDIAN RIFER MOSQUITO CONTROL DISTRICT, and a certified copy of the resolution filed with this Board, as required by law, and as estimated by the said Board of Commissioners, it is determined and hereby declared that a tax rate of Three (3) mills upon the dollar be levied, and is hereby fixed and assessed for the year 19339 on all of the property in the County of Indian River, lying and being within the boundaries of said Mosquito Control District,, the boundaries of said District being as being the entire County as a whole. Four (4) mills of which shall be used solely for interest payments and create a sinking fund for the redepption of bonds, notes and other obligations outstanding and One (1) mill shall be used for repairs, maintenance and general work and construction on said Inlets as provided by Chapter 7976 Acts of 1919. Estimates having been made by the Board of Commissioners of the.1?ETMSMRRE CROSS STATE ROAD DISTRICT, and having filed certified copy of resolution declaring the -tax ilate-the necessary expenditures and for the purpose of paying interests creating a sinking fund,, and the ultimate redemption of Road District bonds,, it is determined and hereby declared that a tax rate of Ton (10) mills on the dollar be levied, and is hereby fixed and assessed for the year 19339 on all of the property in the County of Indian River, lying and being within the boundaries of said Fellamere Cross State Road District. Kine (9) mills of which shall be usedforinterest and sinking fund, and One (1) mill shall be used solely for thepurposesauthorized and prescribed by Chapter 103739 Section 159 Acts of 1925, Laws of Florida. The Board then proceeded to fix and set the millage for the QUAY BRIDGE DISTRICT Lin accordance with the laws of Florida, as amended by the 1927 Legislature, .and it was determined that a tax rate of Five (5) mills on the dollar be levied and is hereby fixed and assessed for the year 19339 on all of the property in the County of Indian River lying and being within the boundaries of said Quay Bridge District for the purpose of properly operating the bridge in said District and the reasonable and usual repairs and maintenance of said bridge and the approaches thereto, the total sum estimated in the budget being x`3,478.57. The Board then proceeded to fix and set the millage for the VABASSO BRIDGE DISTRICT, in accordance with the laws of Florida, as amended by the 1929 Legislature,and it was determined that a tax rete of Ten (10) mills on the dollar be, levied and is hereby fixed and assessed for the year 19339 on all of the property in the County of Indian River lying and being within the boundaries of said Wabasso Bridge District for the purpose of properly operating the bridge in said District and the reasonable and usual repairs and maintenance of said bridge and the approaches thereto, the total sum estimated in the budget being $2,194.02. 1-- RESOLVED, That the Tax Assessor in and for the county of Indian River, State of Florida, be and he is hereby directed to levy and assess all of the foregoing taxes as fixed and levied by this Board upon the property as levied and that he extend the taxes on the valuation of such property according to said millage as fixed and determined by this Board on all the property subject to taxation in the said county of Indian River, as to all taxes levied and intended to be entered on the assessment roll under the head of county taxes and upon all property lying and being within the Districts as described within the county of Indian Rivers as of>the First day of Januaryp A. D. 1933. r7 470 RTSOLVED , Further, That the Clerk of the Circuit Court and Clerk. of this Board, be and he is hereby directed to furnish to W. R*. Duncan, Tax Assessor of Indian River county, a full and complete copy of the fore'oing minutes in so far as the same relates to the subject of levying taxes, describing boundaries, etc. RESOLVED, Farther, That the Clerk and Auditor of the county be notified of the amount to be apportioned to the different accounts out of the total taxes levied for all purposes. It was ordered that the County Attorney be paid one half of the amount appropriated to defend mandams action against the Tax Collector, as soon as the suit has been filed. The several bills and accounts against the County, having been audited, were and found correct, were approved and warrants ordered issued in settlement of same. Such bills and accounts being on file in the office of Clerk Circuit Court. The warrants issued from the respective funds being listed completely in the County Finance Record as provided by law, reference to such record and the list so recorded being made a part of these minutes as fully and completely as if the surae were set out herein in detail. The Board of County Commissioners in and for Indian River County, Florida, met at the Court Rouse in Vero Beach, Florido., at 10:00 o'clock A.M.Tuesday, September 5th 1933 with the following members of the Board present: J.J.P.Bamilton; J.D.Yongue; John H. Knight and Edwin A. He lseth. Also present were Miles Warren, Clerk and William Frick Sheriff. The minutes of the previous meetings were read and approved. It was ordered that bridge be replaced over sub -lateral ditch No. R-1 just west of point at which it enters range line canal and also open up road to traffic from Osceola Boulevard along range line canal to West terminal of Glendale Avenue, when funds are available to do this work. Troy E. Moody, Tax Collector, appeared before the Board regarding reduction in his official bond from x$209000.00 as at present. Af ter discussion on motion made, seconded and carried it was ordered that the Bond of the Tax Collector be set at $10,000.00 instead of $20,000.00 as heretofore until the further orders of this Board. On motion made, seconded and carried it was ordered the Sheriff be instructed to prosecute all persons cutting timber on lands where taxes have not been paid. The Notary Public bond of Troy E Moody in the sum of $500.00 withAmerican Surety Company, a corporation, as surety was approved. The mothers Pension application of Xina Et ters 9 Wabasso, was received and careful considered.
