HomeMy WebLinkAbout1992-0412/24/92(WCrt)TBT(PWD)ree EXHIBIT E FLORIDA DEPARTMENT OF TRANSPORTATION LOCAL GOVERNMENT COOPERATIVE ASSISTANCE PROGRAM Application Agency: Indian River County RESOLUTION NO. 92-41 A RESOLUTION OF INDIAN RIVER COUNTY, AUTHORIZING THE COUNTY ADMINISTRATOR AND THE BUDGET DIRECTOR TO ENTER INTO A LOCAL GOVERNMENT COOPERATIVE ASSISTANCE PROGRAM MEMORANDUM OF AGREEMENT AND JOINT PARTICIPATION AGREEMENT WITH THE DEPARTMENT OF TRANSPORTATION. WHEREAS, the Legislature has created the Local Government Cooperative Assistance Program, Chapter 335.20, Florida Statutes; and, WHEREAS, it is a policy of the State of Florida to construct and make improvement to the state transportation system in a cooperative partnership; and, WHEREAS, such partnership shall be promoted and encouraged through the joint funding of projects that improve traffic flow and reduce congestion on the State Highway System; and, WHEREAS, Indian River County desires to receive matching financial assistance for such projects; and, WHEREAS, Indian River County wishes to authorize the County Administrator and the Budget Director to make an application(s) for such projects, enter into a Memorandum of Agreement(s) and, if the proposed projects are selected for funding, enter into a Joint Participation Agreement with the State of Florida Department of Transportation. NOW THEREFORE: BE IT RESOLVED, by Indian River County: Section 1. Indian River County hereby authorized the County Administrator and the Budget Director to apply for matching funds under the Local Government Cooperative Assistance Program. Section 2. Indian River County hereby authorized the County Administrator and the Budget Director to enter into a Memorandum of Agreement with the State of Florida Department of Transportation.. Section 3. Indian River County hereby authorizes the County Administrator and Budget Director to enter into a Joint Participation Agreement with the State of Florida Department of Transportation, if such project(s) are selected for funding. Section 4. The Clerk of Indian River County is hereby directed to send copies of this RESOLUTION to the Department of Transportation and all other persons as directed by Indian River County. I'S •(� INDIAN RIVER COUNTY BOARD OF COUNTY COMMISSION Carolyn Eggert airman EXHIBIT 1) LOCAL GOVERNMENT COOPERATIVE ASSISTANCE PROGRAM MEMORANDUM OF AGREEMENT BETWEEN TILE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND APPLICATION AGENCY INDIAN RIVER COUNTY THIS MEMORANDUM OF AGREEMENT, made and entered into this 3 day Of Marr.h , 1922_, by and between the STATE OI- FLORIDA DEPARTMENT OF TRANSPORTATION, hereinafter referred to as the "DEPARTMENT", AND INDIAN RIVER COUNTY (local government entity), a body corporate and politic and a political subdivision of the State of Florida, hereinafter referred to as the "LOCAL GOVERNMENT". W I T N E S S E T If: WHEREAS, the DEPARTMENT has announced an anticipated appropriation of matching funds for the Local Government Cooperative Assistance Program (Florida Statutes 335.20) for the upcoming fiscal year; and, WHEREAS, the LOCAL GOVERNMENT desires to submit an application and apply for such funds when they become available; and, WHEREAS, the DEPARTMENT has indicated to the LOCAL GOVERNMENT and the LOCAL GOVERNMENT acknowledges that the funding for the Local Government Cooperative Assistance Program is contingent on legislative appropriation; and, WHEREAS, the DEPARTMENT has indicated to the LOCAL GOVERNMENT and the LOCAL GOVERNMENT acknowledges that ti►e DEPARTMENT will review, evaluate and rank all project applications received and that project funding will be based on the rank order listing of projects and the amount of available district appropriation allocation; and, WHEREAS, the LOCAL, GOVERNMENTis qualified to participate in the Local Government Cooperative Assistance Program and has complied with the requirements of Chapter 335.20, Florida Statutes and Department of Transportation Rule Chapter 14-89, Florida Administrative Code. NOW THEREFORE: IN CONSIDERATION of the mutual benefits to be derived from the joint participation funding of projects in the Local Government Cooperative Assistant Program, the parties agree to the following: 1. The LOCAL GOVERNMENT certifies that matching funds are available for the joint funding of this project. 2. The application project is included in a transportation plan of either the state, county, MPO, or local government. 3. The LOCAL GOVERNMENT agrees to administer the project in compliance with all the rules, policies and laws governing the DEPARTMENT. 4. This MEMORANDUM OF AGREEMENT and project application do not obligate the commitment of funds by the DEPARTMENT. 5. The LOCAL GOVERNMENT, if the application project is selected for funding, agrees to enter into a Joint Participation Agreement with the DEPARTMENT.
