Flescher, Vice Chairman Tim Zorc Peter O'Bryan Bob Solari 1 PROCLAMATION s� DESIGNATING JANUARY 16 THROUGH 19, 2020 AS FELLSMERE FROG LEG FESTIVAL DAYS WHEREAS, the 29th Annual Fellsmere Frog Leg Festival will be held from January 16 through January 19, 2020; and WHEREAS, the Fellsmere Frog Leg Festival showcases the unique local cuisine, resulting in frog legs and gator tail that are unsurpassed; and WHEREAS, the fame of the Festival has reached beyond the borders of the County and State, with the Fellsmere Frog Leg Festival holding two Guinness World Records for most frog legs served in one business day and the largest Frog Leg Festival in the world; and WHEREAS, the Fellsmere Frog Leg Festival has attracted hundreds of thousands of visitors and tourists to the area; and WHEREAS, the proceeds are used to further recreation and park activities as well as support youth organizations in the North County area; and WHEREAS, the City of Fellsmere has been designated as the Frog Leg Capital of the World, and it is appropriate to recognize this Festival as a Premier Event in Indian River County. The property is under contract and will be used for future right-of-way for the expansion of 26th Street. Mr. Bartosiewicz, currently holds a residential lease on the Property with tenants Nick and Ember Pappas. At closing, the Seller will assign all of his right, title and interest in the Lease to the County on the same terms as those set forth in the Lease. The closing will take place in the next few days. The lease expires on March 1, 2020, and the Tenants will continue to lease the Property on the same terms as those set forth in their Lease and will vacate the property when the Lease expires on March 1, 2020. The Lease will not be renewed or extended. In accordance with the Agreement, the County will become the Landlord and is entitled to receive rental payments from the tenants. The tenants will be formally notified of the sale so the rental payment for February will be sent to the County instead of the previous owner. The attached Assignment of Lease and Rent formally provides notice to the tenants and assigns the right to receive rent to the County. Funding. The rental income will be deposited into the General Fund/Miscellaneous Revenue/Rents & Royalties, Acct. #001038-362010. Recommendation. Bike Walk Indian River County, Inc. has the stated mission "To promote safe bicycling and walking as transportation and recreation for a healthier, more vibrant and connected Indian River County." The club approached the Parks and Conservation Resources Director with the intent of donating and installing a bicycle repair stand at Wabasso Beach Park on an existing concrete pad. Bike Walk Indian River County, Inc. will be responsible for the maintenance and repairs to the repair stand and pump for the lifecycle of the equipment. The Indian River County residents and visiting cyclists who enjoy cycling to, from and stopping over at Wabasso Beach Park will benefit from having a repair station conveniently located at the park. On September 10, 2019, the Board approved and accepted the donation and installation of the same model bicycle repair station, pump and tools for use at the Fran B. Adams Park along the Trans Florida Railroad Trail from Vero Cycling, Inc. As indicated in the staff report for the sale of that parcel, a second attempt was made to sell the remaining parcels. In accordance with F.S. 125.35, legal advertisements announcing the sealed bid sales appeared in the Press Journal on December 15t and 8th, 2019. The sales were also posted on the Purchasing web page, and yard signs placed on each lot. Sealed bids were received and opened January 7, 2020, with the results shown in the table below. Szpyrka, P.E., Public Works Director SUBJECT: Report on 66th Avenue Right -of -Way Acquisition Costs DATE: December 26, 2019 DESCRIPTION AND CONDITIONS The Board requested that staff review the current costs of right-of-way acquisition to past costs for 66th Avenue right-of-way acquisition and report back to the Board with their findings. The following is a synopsis of the findings and the attached information shows differences in right-of-way purchases approved by the Board in the past and present for 66th Avenue. The first segment of widening for 66th Avenue was from SR -60 to north of 49th Street and was completed in 2015. However, right-of-way acquisition for the construction of the first segment of the widening project began back in 2006. Staff analyzed a portion of the property purchased for right-of-way between 2006 and 2011 from south of 41st Street to 57th Street. This analysis showed that a total 52.54 acres was acquired at a cost of $5,403,281 or an average cost of $102,841 per acre. As the Board is aware, every property acquired had unique factors involved with each individual property, so the cost per acre ranged from $55,600 per acre to $569,117 per acre with some vacant land, some improved land, and some where the County purchased the entire parcel and removed the structures. A breakdown of each individual parcel that was obtained is attached. As the County continues to grow and with the Florida Department of Transportation working on the widening of CR -510 from CR -512 to US -1, County staff saw the need in 2017 to restart the acquisition process for right-of-way to continue widening 66th Avenue from north of 49th Street to CR -510. The widening has been divided into two phases, phase one from north of 49th Street to north of 69th Street and phase two from north of 69th Street to CR -510. Atotal of 75.86 acres of right-of-way and stormwater retention pond sites have been acquired so far for the widening of 66th Avenue from north of 49th Street to CR -510 at a cost of $5,120,996 or $67,505 per acre. It should be noted that 6 of the 28 parcels purchased were obtained before 2017. As the Board is aware, every property acquisition has unique factors involved with each individual property, so the cost per acre ranged from $23,333 per acre to $605,212 per acre with some vacant land, some improved land, and some where the County purchased the entire parcel and removed the structures. A breakdown of each individual parcel that was obtained is attached. The County continues to consider the eminent domain process as an option when acquiring needed right- of-way. Previous Board direction was to offer more funds toward property owners rather than having these dollars end up in the hands of outside attorneys and expert witnesses. As such, eminent domain has been considered as a last resort when staff is unable to negotiate what staff believes is a fair settlement that will save the taxpayers money by not enforcing eminent domain proceedings. The eminent domain process is costly and time consuming from the aspect of property owners attorney's fees, expert witness fees for both the County and the property owner, County outside council fees for litigation, outside appraisers fees, and other fees that the County ends up paying for in most cases. 50 On January 7th, 2020 the Board approved the 58th Avenue Corridor Study/S.C.A.L.E. Report. The acronym S.C.A.L.E., (Safety, Cost, Alternate Alignments, Long Range Planning, and Environmental Considerations) is used to identify the five factors necessary for the most feasible alignment of a roadway. This report is necessary for eminent domain proceedings to show that these aspects have been considered, along with negotiations with the property owner that the County has acted in good faith to acquire the necessary property for right-of-way prior to starting the eminent domain process. On January 7th, 2020 the Board also approved an unconditional offer for right-of-way located at 4740 58' Avenue that is owned by Paulette Brown. Staff started negotiations with Ms. Brown back in October of 2018. However, staff was never able to negotiate an acceptable settlement with Ms. Brown and her attorney so we had no choice but to move forward with the first step in the eminent domain process. This is an example of the use of eminent domain when a fair and reasonable agreement can't be reached with the property owner. Staff plans to continue to consider eminent domain in cases where the County is unable to recommend an amicable purchase arrangement. Past direction from the Board has been to negotiate with the property owner and their attorney to come to a fair settlement that will save the taxpayers money and provide the property owner with some comfort that the County did the best we could to ease the emotional impact on the property owner during the right-of-way acquisition process. County staff believes that we have been following past Board direction with regards to right-of-way acquisition. It is important to consider that right-of-way costs make up a significant portion of the costs to construct capacity increasing projects like road widening. The last impact fee study, completed in 2014, right-of- way costs were 25.7% of the total cost of improvements. As a result, increases in right-of-way costs result in higher impact fee calculations. Whether funded by impact fees, gas taxes, or the Optional Sales Tax, higher right-of-way costs reduce the amount of road construction that can be funded with available resources. FUNDING No funding is needed for this report. RECOMMENDATION Staff recommends that the Board direct staff to continue with the current method of right-of-way acquisition, which includes the use of eminent domain proceedings if an agreement to a purchase right- of-way at a fair price is not obtainable. United States Department of Transportation, et al. BACKGROUND. On March 17, 2015, the Indian River County Board of County Commissioners (the "Board") authorized the County Attorney's Office to file a complaint in federal court challenging the U.S. Department of Transportation's ("USDOT' s") approval of the issuance of the $1.75 billion of tax exempt private activity bonds for the All Aboard Florida project. On March 24, 2015, the Board authorized the County Attorney's Office to include the Emergency Services District as a plaintiff in the case. As the Board is aware, as a result of the decision in that case, the USDOT withdrew its private activity bond allocation for Phase II of the All Aboard Florida project. On December 19, 2017, the Board authorized the County Attorney's Office to file a lawsuit against the USDOT in conjunction with issuance of the Record of Decision for Phase II of the All Aboard Florida project. On February 13, 2018, Martin County, Indian River County and CARE -FL filed a lawsuit in federal court challenging the validity of the private activity bonds and the National Environmental Policy Act ("NEPA") process for Phase II of the All Aboard Florida project. Martin County and CARE -FL have since withdrawn from the case. The court held an oral argument on the motions for summary judgment on November 27, 2018. On December 24, 2018, the court issued an opinion granting Defendants' Motion for Summary Judgment, granting Intervenor -Defendant's Motion for Summary Judgment, and denying Indian River County's Motion for Summary Judgment. On February 5, 2019, the Board voted to file an appeal with the D.C. Circuit Court of Appeals. Oral arguments were held on September 24, 2019. Although the County had meritorious claims on appeal relating to the illegality of the private activity bonds and the insufficient NEPA analysis performed by the Federal Railroad Administration, on December 20, 2019, the D.C. Circuit Court of Appeals denied the appeal. 57 Board of County Commissioners December 31, 2019 Page Two There are three options for seeking further review: (1) a petition for panel rehearing; (2) a petition for rehearing en banc; and (3) a petition for a writ of certiorari to bring the suit before the United States Supreme Court for review. It is outside counsel's opinion, which the County Attorney shares, that these petitions are not likely to be granted. Thus, outside counsel recommends, and the County Attorney concurs, that the County should not seek further review in this suit. If the Board wishes to seek further review, here are the filing deadlines for any future action in this case: 1. Deadline for petition for panel rehearing or rehearing en banc is February 3. 2. Deadline for petition for a writ of certiorari for Supreme Court review is March 19. On November 20, 2018, the Board voted to allocate an additional $1 million to fight the proposed project. This memorandum addresses a 0.22 acre parcel that is needed for right-of-way. Ms. Brown owns a 0.97 acre parcel of property located at 4740 58th Avenue on the east side of 58th Avenue. This site is rectangular in shape with 146.07 feet of frontage along 58th Avenue and is 296.48 feet deep. The property is located inside the urban service boundary and is zoned RS -6, single family, residential, up to 6 units per acre. The parcel contains a 4 bedroom, 3 bath, 2,090 sq. foot wood frame house built in 1990. The residence lies outside of the area of take and will be approximately 70 feet from the new right-of-way line. Site improvements that lie inside the area of take consist of landscaping, approximately two-thirds of a circle driveway and about one half of an ornamental pond. In order to accommodate the planned improvements to 58th Avenue, the County needs to acquire a 0.22 acre parcel of property from Ms. Brown to be used as right-of-way. A copy of the sketch of the parent parcel, the part to be taken, and remainder is attached to this memorandum. The required "Notice to Owner" information and the Unconditional Offer have been received by the property owner. On January 7, 2020 the Board approved an unconditional offer of $70,000 for the 0.22 acre parcel which is 58% above the appraised value of $44,516. A Resolution of Necessity does not require a public hearing. It requires the Board to review the- BCC Memo January 9, 2020 I2 safety, cost, alternative routes, long range planning and environmental aspects of the project in relation to the proposed take. The Board considered all of those factors at the meeting of January 7, 2020 and approved the Corridor Study for 58th Avenue and proposed 58th Avenue alignment in front of the Brown property. A copy of the Corridor Study is available for review at the County Commission office and the Office of the Clerk to the Board. Ms. Brown is represented by David Holloway. The parties have agreed to a pre -suit mediation that will be held later this month. If the mediation is unsuccessful at reaching settlement, the County will file a lawsuit in eminent domain and proceed to obtain an Order of Take. If the Court grants the County's Motion for an Order of Take, the County will deposit its Unconditional Offer amount based on the appraisal into the Court Registry and take title to the right-of-way, and Ms. Brown may access the deposit in the Court Registry, less any taxes, liens or mortgages owed on the property. The parties will proceed with the discovery process and present the case to a twelve (12) person jury trial and the jury will determine the amount of compensation to be paid to Ms. Brown. The attached Resolution of Necessity provides for the following: • The Board finds it necessary to acquire the property using Eminent Domain • Authorizes the County Attorney or outside counsel to file a lawsuit against the owners of the needed property • Authorizes County employees and its agents to take action necessary to prosecute the lawsuit to Final Judgment FUNDING: Funds for this expenditure are budgeted and available from Traffic Impact Fees/District II/ROW/58th Ave- South of 49th Street — 53rd Street, Acct# 10215241-066120-15013. Specifically, the economic and environmental feasibility of adding reclaimed water high in Phosphorus and Nitrogen to the existing wet detention ponds located on Windsor property. ENVIRONMENTAL FEASIBILITY The Windsor development is a low-density single-family residential development located on the barrier island in Indian River County. Stormwater runoff from the development currently outfalls to the Indian River Lagoon, which has been classified as impaired waters by FDEP and is included in the Central Indian River Lagoon Basin Management Action Plan. The Windsor development was permitted in 1990 (permit # 18758-1) prior to SJRWMD requiring analysis of nutrient loading. To establish a baseline for comparison, the Total Maximum Daily Load (TMDL) for Nitrogen and Phosphorus were calculated. Using the development parameters from the ERP on file with SJRWMD, a TMDL analysis for Nitrogen and Phosphorus using data from the Harvey Harper report was completed and the results are summarized below. The analysis assumed that the permitted yearly allocation for groundwater withdraw will be replaced by reclaimed water, therefore 58.4 MGY was used as the volume of reclaimed water to be added to the system. The concentrations of Nitrogen and Phosphorus were taken from a monthly monitoring report prepared by FDEP. The complete calculation is included with this report and the results are summarized below. The results show that adding reclaimed water to the existing wet ponds will increase the TMDL for nitrogen and phosphorus being discharged to the Indian River Lagoon during storm events. Increasing the Phosphorus and Nitrogen discharges to the Indian River Lagoon can cause algal blooms and negatively impact the growth of seagrass in the lagoon basin and directly conflicts with the goals of the Central Indian River Lagoon Basin Management Action Plan as adopted in February of 2013 by the Florida Department of Environmental Protection. ECONOMIC FEASIBILITY The existing force main used to distribute reclaimed water will need to be extended approximately 3,000 linear feet north on State Road Al A to bring the reclaimed water into the appropriate stormwater pond on the Windsor property. In addition, the stormwater pond receiving the reclaimed water will need to be dewatered, isolated, and lined to prevent groundwater contamination. Objective The objective of the Children's Trust is to improve the quality of life for all children in Indian River County by providing a coordinated system of planning and delivery within which children and families' needs can be identified, evaluated and addressed. Se Sec. 7 9 9 9 - Scope and purpose. The scope and purposes of this article are: (1) To implement the provisions of Indian River County Resolution 7 7 7 9 9 9 and provide for the dedicated millage for children's services through the Children's Trust of Indian River County. (2) To establish the general terms and conditions under which Indian River County shall fund, develop and provide for the establishment and operation of the Children's Trust of Indian River County and the support of programs which shall include the enhancement and expansion of existing programs as well as new and innovative programs to improve the quality of life for all children in Indian River County. To establish the Children's Trust of Indian River County Advisory Board, to establish the terms and conditions of membership on the advisory board, to establish the scope of authority of the advisory board and other terms and conditions related thereto. (4) To provide a clear source of lawful authority for the grant of funds derived from a dedicated millage for the development and authorization of continuing programs to improve the quality of life for all children in Indian River County. (3) Sec. 7 9 9 9 7. - Definitions. The following words, when used herein, shall have the meaning indicated unless the context clearly indicates otherwise: Advisory board shall mean the Children's Trust of Indian River County Advisory Board as established herein. Agency shall mean any partnership, association, corporation or individual as well as any governmental body or unit. Children shall refer to Indian River County's children under the age of eighteen (18). Child advocate shall mean a member of the general public with a demonstrated concern for the well-being of children. Children's Trust shall mean the Children's Trust of Indian River County. 108 Clerk shall mean the clerk of the circuit court and clerk to the board of county commissioners of Indian River County. County shall mean Indian River County acting by and through its board of county commissioners. CTIRC shall mean the Children's Trust of Indian River County. Dedicated millage shall mean the ad valorem property taxes as provided for in Resolution ? ? ? ? ? of this article. Department shall mean the Children's Trust of Indian River County or such other department or division within county's jurisdiction, having cognizance over the furnishing of children's services and matters relating thereto. Director shall mean the Executive Director of the Children's Trust of Indian River County or his designee. Exclusive jurisdiction of the school board shall mean matters pertaining to the obligations and duties of the school board pursuant to the Constitution and Laws of Florida and shall not apply to discretionary programs that may be implemented by the school board where such programs may be qualified for funding under this article and the school board held accountable to the county for the development of the program and the provision of services to children. Fiscal year shall mean the county's fiscal year beginning on October 1 and ending on September 30 of each year. Juvenile shall mean children as defined above. Supplant or replace shall mean to take the place of. Words of the masculine gender shall be deemed and construed to include correlative words of the feminine gender. Words importing the singular number shall include the plural number and vice -versa unless the context shall otherwise indicate. The word "person" shall include corporations, associations, natural persons and public bodies unless the context shall otherwise indicate. Reference to a person other than a natural person shall include its successors. Sec. ? 9 9 9 - Millage dedicated. (a) There is hereby dedicated to fund improvements in quality children's development, physical and mental health, and other services for children residing in Indian River County by the levying each year of an ad valorem tax of one-quarter of a mill in 2021, increasing to one- third of a mill in 2023 and increasing to one-half of a mill in 2025 and thereafter which shall be based upon the taxable value of all land in Indian River County. (b) The amount of revenue to be generated by the dedicated millage shall be reported to the advisory board by the director as soon as reasonably possible after the property appraiser certifies the tax roll and shall be accounted for by the clerk separate and apart from all other county funds. (c) Effective in FY22-23 the Children's Trust dedicated millage shall replace existing funding provided by the county's Children's Services Advisory Committee and may be expended only for funding programs and services for children in accordance with the provisions of this article. (d) Any funds derived from the dedicated millage not used during any fiscal year and all interest earned on such funds shall be accounted for and used only for the purposes established in this article for the dedicated millage. 109 Sec. ? 9 9 9 - Expenditures authorized. It is the intent of this article that the funds generated by the dedicated millage shall be used for the development and authorization of continuing programs to improve the quality of life for all children in Indian River County, as provided in Resolution '2 '9 9 '7 '7, this article and as more specifically determined by subsequent proceedings of the county. The dedicated millage may be expended to fund improvements in quality children's development, physical and mental health, and other services for children. Such programs and services may include but shall not be limited to the following purposes: (1) To allocate and provide funds for agencies in Indian River County which are operated for the benefit of children, provided they are not under the exclusive jurisdiction of the public school system. (2) To support programs and services which will enhance academic achievement and assist all children to perform at grade level in core areas such as reading, math and science. To provide and maintain in Indian River County such guidance, psychological, or psychiatric programs and services as the county determines are needed for the general welfare of the children and families of Indian River County. (4) To support programs and services which promote & improve the physical health and well-being of all children. (5) To support programs and services designed to stop child abuse before it starts. (6) To provide funds to programs and services that keep our children off the streets and away from drugs, alcohol and other risky behaviors. To provide prenatal care programs where such programs will improve birth outcomes for all children. (8) To provide for such other services for all children as the county determines are needed for the general welfare of Indian River County. To collect information and statistical data which will be helpful to the county in deciding the needs of children and to develop techniques for monitoring the efficacy of funded programs and services including but not limited to the gathering of data, measuring outcomes, goal effectiveness, research. (10) To provide or coordinate training, professional development and other support to Children's Trust funded agencies which will ultimately improve service delivery and desired outcomes for children. (11)To consult, coordinate and collaborate with local, state and national entities which promote best practices, professional standards and advocacy focusing on the health, well-being and education of children and families. (12) To lease such real estate and lease or purchase such equipment and personal property as are needed to execute the foregoing programs and services. (13) To employ and pay, on a part-time or full-time basis, personnel needed to execute the foregoing programs and services. (14) To provide for administrative expenses limited to Children's Trust of Indian River County staff and operating supplies, directly related to tasks necessary to fulfill the scope and purposes of this article, in an amount not to exceed ten (10) per cent of the annual dedicated millage for that fiscal year, to be determined at the time of budget adoption. (3) (7) (9) 110 Such children's services may be provided in accordance with the provisions of this article and such rules, policies and procedures as may be established by resolution of the county, which may include but shall not be limited to programs providing for grants to not-for-profit agencies for the reimbursement of expenditures for operational and overhead expenses for the creation, development and implementation of programs, grants to not-for-profit agencies or children based upon funding all or a portion of the cost of services rendered, the purchase of services or, where children's services can most economically and efficiently be provided by county, through the establishment of county -run programs. Sec. '? '7 '7 - Children's Trust advisory board. (a) Advisory board established. There is hereby established the Children's Trust of Indian River County Advisory Board which shall be appointed by and serve at the pleasure of the county. The initial advisory board shall be established by April of 2021. To the extent possible the thirteen (13) member advisory board shall be comprised of: (1) A physician, preferably a pediatrician; (2) A licensed mental health professional; (3) An expert in education, preferably from Indian River State College: (4) A representative of NAACP; (5) three (3) child advocates who are not affiliated with any agency receiving Children's Trust funds; (6) one (1) criminal justice representative; (7) The superintendent of School District of Indian River County; (8) One (1) representative from the Department of Health; (9) One (1) representative from United Way of Indian River County; (10) One (1) representative from the Department of Children and Families; and (11) One (1) judge of the family law division. The Children's Trust Advisory Board shall have the power and duty to make recommendations to the Board of County Commissioners regarding the expenditure of the dedicated millage; to consult with agencies dedicated to the welfare of juveniles to the end that the overlapping of services will be prevented; and such other duties as may from time to time be assigned by the Board of County Commissioners. (b) Terms. (1) Except as provided herein all terms shall be for a period of three (3) years and continue until a successor has been appointed, which term shall be deemed to commence on October 1 of each respective year. (2) To achieve staggered terms, the first term of four (4) initial members, including one child advocate, shall expire at the end of FY22-23; the first term of four (4) initial members, including one child advocate, shall expire at the end of FY23-24; the first term of five (5) initial members shall expire at the end of FY24-25. (3) All members of the advisory board shall be residents of Indian River County meeting the qualifications of an elector, except that the judicial position may be filled by the family law judge serving in Indian River County without regard to residency. (4) Members shall be eligible for reappointment for three successive terms without limitation. After one year's absence, a former member can rejoin the advisory board. 111 (5) The county may remove any member who, without reasonable excuse, fails to attend three (3) consecutive meetings. (6) Members may be removed without cause by a majority plus one vote of the board of county commissioners when it is determined that it is necessary and in the best interest of the county and the efficient functioning of the advisory committee to remove such members. The advisory board may recommend removal of a member to the county based upon an affirmative vote of eight (8) members of the advisory board. Any member who has been selected based upon serving in a representative capacity for an entity or agency who resigns or is no longer affiliated with such entity or agency shall provide notice to the Director of a change in the member's status. Taking into consideration the work of the advisory board and the activities and proceedings schedule by the advisory board, the county may ask such representative to continue until an orderly transition may be arranged and at such time as the county deems to be in the best interest of the advisory board or the county may declare the position vacant and fill the vacancy by appointment as soon as reasonably possible. Such appointment shall be for the unexpired term of the vacated office. (8) If any member of the advisory board is removed, dies or becomes disqualified, the position shall be deemed vacant and such vacancy shall be filled by appointment of the county. Any such appointment shall be for the unexpired term of the vacated position. (c) Rules and procedures. (1) The advisory board shall hold meetings as needed to fulfill its duties, but the advisory board shall hold at least four (4) meetings each year. (2) A majority of the active members of the advisory board shall constitute a quorum. (3) All meetings shall be open to the public. (4) Formal recommendations of the advisory board to the county commissioners shall be based upon the vote of not less than a majority of a quorum present and voting. The advisory board shall have the authority to elect such officers, including a chairperson and a vice -chairperson, and promulgate such internal procedures and rules as may be necessary to conduct the business and affairs of the advisory board, which shall not be in conflict with the general law, this article or procedures and policies established by the board of county commissioners. (6) Every member of the advisory board shall be required to disclose any affiliations (such as employment or position as an officer or director) or other conflicts of the member or the member's immediate family with any entity applying for or receiving funds from the millage dedicated to the Children's Trust. No member of the advisory board shall incur any expenditures chargeable to the county without the prior written approval of the director. (d) Powers and duties. The advisory board shall have the power and duty to make recommendations to the county regarding the expenditure of the dedicated millage, to consult with agencies dedicated to the welfare of children to the end that the overlapping of services will be prevented; and such other duties as may from time to time be assigned by ordinance or resolution of the board of county commissioners. In order to accomplish those purposes, subject to policies and procedures established by the county, the children's services advisory board shall have in addition to the powers, duties and authority assigned elsewhere in this article, the authority to: (1) Make independent investigations and gather data pertaining to the needs of children and families and ways of meeting those needs. (7) (5) (7) 112 (2) Consider and recommend innovative and creative programs required to effectuate the intent of the children's services referendum. (3) Make recommendations to the board of county commissioners with respect to modification of programs. (5) Make recommendations and investigations to assure that the dedicated millage is allocated wisely and used effectively. Seca 7 7 7 7. - Needs assessment; establishment of funding priorities. (a) The advisory board shall submit to the board of county commissioners by January 30 of each year an annual report which will be made available to the public. This report should provide an update on Children's Trust activities, a financial statement, agency and program investments, and outcomes achieved in the prior year. The annual report shall include a needs assessment which identifies and quantifies the needs of Indian River County's children and families. In developing the report the advisory board shall utilize data and materials from local, state or national agencies, both public and private; tools such as asset mapping, a focus on the county's "pockets of poverty", an examination of service gaps and capacity gaps; or other appropriate methodologies such as hearings and investigations including but not limited to surveys and interviews of experts, professionals, agencies and individuals, including children and parents, as may be necessary and practical to develop the assessment. The assessment will prioritize the identified needs, service and capacity gaps, and include the advisory board's preliminary determination of the nature and types of programs and services that should receive funding in the upcoming investment cycle. Seca ? ? ? 7. - Procedures for allocation of funds. (a) Announcement of plan. As soon as reasonably possible after submission of the advisory board's annual report and initial funding plan for children's programs and services, the county shall approve or modify the plan and announce the availability of funding for the upcoming fiscal year. The announcement will include a description of services and programs recommended for funding from the dedicated millage. The announcement will include information pertaining to funding applications, rules and procedures pertaining to the award of funds and applicable dates for submission of applications and all details pertinent thereto. (b) Funding request evaluation. Evaluations of agencies submitting funding applications shall include, but not be limited to, site visits, interviews, and application review. Applications received will be assessed on the basis of specified criteria and will include, but not be limited to, the following items: (1) Organization's capability. The qualifications and experience of the applicant in providing quality human services and the agency's financial capability. 113 (2) Need for service. Appropriate goals and objectives in response to the advertisement of funding availability. Soundness of methodology. The goal and objectives, description of services with timeline and documented coordination with other service providers. (4) Evaluation. The program's process and outcome objectives, data collection system and evaluation design. Cost effectiveness. The proportion of budget applied to direct services, funds from other sources, funds requested, current and projected long range efficiency. (6) Children and families served. The extent to which the application addresses services to meet identified needs of the target population. Neighborhood -based initiatives. The extent and degree to which the application focuses on a local area or neighborhood. (8) Response to a specified strategy. The applicant's identification of and appropriate response to a specified primary strategy. Application. The relative completeness, clarity and conciseness of the response to all required items in the funding announcement and application. (c) Funding recommendation. Recommendations for funding, once approved by the children's services advisory board, will be presented to the board of county commissioners by the chairman of the children's services advisory board or his/her designee. This report shall be written or verbal, as requested by the board of county commissioners, presented no later than September 30 of each year, which date or dates shall be established in the announcement provided for in subsection (a) above. The recommendation will include a description of current children's services in Indian River County; an assessment of how current services are fulfilling the needs of the children in Indian River County; the advisory board's analysis and conclusions with respect to compliance with the requirement that the dedicated millage be used to fund additional services and programs and not to replace or supplant existing funding; and a recommended budget and funding levels for children's services for the next fiscal year. (d) Program follow-up. The Children's Trust advisory board or its designee shall review and make recommendations pertaining to the funding application, and request for proposals, the funding agreements and the development of the monitoring and evaluation procedure which shall be prepared by the department. The children's services advisory board shall be apprised of all reports as a result of monitoring programs implemented by the department pursuant to this article. (3) (5) (7) (9) Sec. 2-2-259. - Final recommendations and final determinations. The commission shall, during the hearings and proceedings required for adoption of the county's annual budget, make final determinations with respect to the allocation of the dedicated millage. Any additional programs funded after adoption of the county's budget shall be approved only after notice and public hearing conducted in the manner required for the adoption of county's ordinances. The specific allocation of funds authorized by inclusion in the county's official budget adopted prior to the commencement of each fiscal year or any subsequent amendment to the budget shall not establish a right, entitlement or benefit to any individual or agency. Per the Agreement, SWDD is responsible for the transportation of recyclables to St. Lucie County. SWDD is also responsible for any transportation cost back to the IRC Landfill as a result of St. Lucie County rejecting recyclables in accordance with the appropriate procedures in the Agreement. Since August 2019, SWDD has been utilizing PGL Trucking to transport recyclables to St. Lucie County under a blanket purchase order. Staff is in the process of issuing Bid No. 2020028 for the solicitation of obtaining competitively bid transportation services; however, in the interim, staff is seeking Board authorization to continue to utilize PGL Trucking prior to bid award.
