Section 11-53, Indian River County Code; and WHEREAS, notice of the time and place of the public hearing was published in the Press Journal Newspaper on Tuesday, July 28, 1992, and Tuesday, August 4, 1992 (twice one week apart; the last being at least one week prior to the hearing), as required by Section 11-52, Indian River County Code; and WHEREAS, the land owners of record were mailed notices at least ten days prior to the hearing, as required by Section 11-52, Indian River County Code; and WHEREAS, the Board of County Commissioners of Indian River County on Tuesday, August 18, 1992, at 9:05 a.m. held a public hearing with regard to the special assessments, at that time the public hearing was continued until Tuesday, September 1, 1992, at which time the public hearing was continued once again until Tuesday, September 8, 1992, W CA OD WHEREAS, the Board of County Commissioners of Indian River County has, by Resolution No. 92-106, adopted July 21, 1992, >1 determined to make special assessments against certain properties in ' ' Glendale Lakes Subdivision (North of 8th Street to 10th Street) to be C? serviced a water main extension of the County; and WHEREAS, said resolution described the manner in which said 9 . "' • special assessments shall be made and how said special assessments are 0 t1 i is to be paid; and U 0 WHEREAS, the resolution was published on July 27, 1992, as required by Section 11-52, Indian River County Code; and J WHEREAS, the Board of County Commissioners of Indian River County passed Resolution No. 92-107, on July 21, 1992, which set a time and place for a public hearing at which the owners of the properties to be assessed and other interested persons would have the chance to be heard as to any and all complaints as to said project and said special assessments, and for the Board to act as required by Section 11-53, Indian River County Code; and WHEREAS, notice of the time and place of the public hearing was published in the Press Journal Newspaper on Tuesday, July 28, 1992, and Tuesday, August 4, 1992 (twice one week apart; the last being at least one week prior to the hearing), as required by Section 11-52, Indian River County Code; and WHEREAS, the land owners of record were mailed notices at least ten days prior to the hearing, as required by Section 11-52, Indian River County Code; and WHEREAS, the Board of County Commissioners of Indian River County on Tuesday, August 18, 1992, at 9:05 a.m. held a public hearing with regard to the special assessments, at that time the public hearing was continued until Tuesday, September 1, 1992, at which time the public hearing was continued once again until Tuesday, September 8, 1992, W CA OD RESOLUTION NO. 92- 16.1 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: 1. The special assessments shown on the attached assessment roll are hereby confirmed and approved, and shall remain legal, valid, and binding first liens against the properties assessed until paid in full. 2. The County will record the special assessments and this resolution, which describes the properties assessed and the amounts of the special assessments, on the public records, which shall constitute prima facie evidence of the validity of the special assessments. The resolution was moved for adoption by Commissioner Scurlock , and the motion was seconded by Commissioner Bird , and, upon being put to a vote, the vote was as follows: Chairman Carolyn K. Eggert Absent Vice Chairman Margaret C. Bowman Aye Commissioner Don C. Scurlock, Jr. Aye Commissioner Richard N.
